  1. 1. There is no applying for the Green card. Once you pay the online $220 fee to USCIS (usually paid before arriving in the US), the GC will be sent to your US address. 2. No, you can enter the US at any POE.
  2. For anyone else interested, I think @Loren Y still offers free marriage service in Las Vegas for Visa Journey members. Hopefully, he will clarify this here.
  3. No. They cannot. Medicare Part A is not "free" for anyone unless that person or his/her spouse has 40 quarters of work credit which prepaid for Part A. Medicaid varies from state to state.
  4. Looks like his priority date is current to file for adjustment of status. That is a popular option.
  5. How long will he be out of status? That will be the important question. If he is actually out of status for more than 6 months, he will incur a 3 year ban upon departure from the US.
  6. I would certainly prepare for a combo interview. I was notified only 2 days prior to wife's N-400 interview that I had to attend for a combo. Of course, I had already planned and asked for a combo interview, so I was ready. Good luck.
  7. No. Not needed. Wife filed under 5 year rule. This is everything we uploaded. Only tax transcripts for additional documents. 5 years Tax transcripts Proof of my 1st marriage Termination Proof of Wife's 1st Marriage Termination Wife's Green Card Our Marriage Certificate
  8. In addition, to maintain her legal status, she cannot remain outside the US for more than a year at a time (without a re-entry permit).
  9. How long were you married when she entered the US via the spousal visa? 1. Less than 2 years = 2 year conditional Green Card 2. 2 years or more = 10 Green Card If the answer is #1, then she MUST file for removal of condition in 2 years (can file no sooner than 90 days from that date) to get a 10 year card. No other way.
  10. The Naturalization process was the fastest and easiest part of the entire immigration process. Nice, isn't it?

  12. ***Topic moved to Working and Traveling during US Immigration***
  13. The Consulate is the sole approval authority. Good luck.
  14. What are their thoughts? I hope you succeed. Please keep us updated, thereby expanding the knowledgebase here on VJ. This is certainly not common here. Good luck.
  15. You can argue anything, but in this case, the spouse does not, and has never, lived in the US with a Green Card. The OP also has no clear plans to relocate to the US. IMO, this does not meet exceptional circumstances. The OP is trying to find a way for the spouse to reside in Germany, not join in the US. Just my opinion. Another fact is that the consulate issues visas, not Green Cards.
  16. Technically, the approved I-129F expires after 4 months (as indicated on the I-797). However, as long as the case is still being processed by Department of State, the consulate normally extends that date in 4 month increments. In other words, don't worry about that date at this point.
  17. USCIS must send your case to NVC. Then NVC assigns a DOS case number before you can schedule an interview or medical. Approved I-129fs have a validity date of 4 months, after which the consulate can extend them in 4 month increments up to a year.
  18. Bingo! That's why I suggest withdrawing now. Better to establish a clear paper trail, imho.
  19. Thanks for the reply. You're right. The OP's I-130 will be stuck at USCIS until an I-824 moves it to NVC.
