  3. In this case, the fiance came to the US for a visit. Most people who visit are in no position to suddenly abandon their jobs, lease, and everything for 8 months before being able to return to home country & return. Having a travel visa does not confer any immigration benefits. Even if the fiance was outside the US, he/she could not enter the US as a visitor with the intent to stay and adjust status.

  14. 5 weeks is good, imo. We expedited wife's passport (including 1 day delivery). Took 6 weeks for passport, then 7 additional weeks for NC return.

  16. ***Moved to Adjustment of Status from Work, Student, & Tourist Visas*** There is no 90 day rule. There is no reason to wait 90 days if there was no misrepresentation. A person cannot enter the US as a visitor with the intent to stay and adjust status. Once a person submits a proper I-485 package, he/she will be granted authorized stay in the US until the I-485 is approved or denied.
  17. I have heard of this. It has been said that Lagos is in a fraud category of its own. I have definitely heard of field investigations after interviews. Nothing they can do at this point. Maybe Joe knows why they are asking questions. Has Joe been married there before?
  18. You and she can file the I-130, I-485, I-131, and I-765 packages now. No reason to wait. She should be aware that she cannot leave the US for any reason before having approved I-131.
