  1. Why do you want to wait for the I-130? You do not gain legal status in the US when an I-130 is approved. A B2 would not help you to remain in status for as long as you need to adjust status.

  5. To clarify for me: Your spouse is a Green Card holder. You want to adjust status through her to obtain a Green Card. Your spouse filed an I-130 for you in January 2024. Is that correct? Be aware that an approved I-130 will not grant you legal status in the US. In order to adjust status, you would have to a current I-130 priority date, and you MUST remain in legal status the entire time. It could take years.

  8. I know nothing about California tax laws.....but if you file a joint return, you must report and pay any applicable taxes on both spouse's income for the entire year. That is federal TAX law (unrelated to community property law). If you file MFS, she does not have to file a return at all (I am assuming she is outside the US). I would think most states would require the same.

  12. You can marry before or after he returns to home country, then file the I-130. After you become a US citizen, you can upgrade the visa category to immediate relative if a visa number has not become available. That will, then, make a visa number immediately available.

He cannot adjust status through you as he does not have a current I-130 priority date...per the March 2024 Visa Bulletin, To adjust status, he must have a current priority date, and he must remain in legal status until he adjusts status.
