  2. I've seen several instances of people receiving these. I have not seen any cases of problems using them.
  3. Any document which is not in English or the official language of the country where the interview is taking place must be accompanied by an English translation. No need for notarization from home country embassy. Civil Documents (state.gov) " Please note that all documents not written in English, or in the official language of the country from which you are applying, must be accompanied by certified translations. The translation must include a statement signed by the translator stating that: The translation is accurate, and The translator is competent to translate."
  4. It is extremely important that you cancel the return leg after you have entered the US via a K-1. Otherwise, USCIS could think you used that return leg....that could cause USCIS to deny an Adjustment of Status application. There are actual cases, here on VJ, in which USCIS denied Adjustment of Status at the interview due to the appearance that the person left the US without Advance Parole. That creates a gigantic hassle you do not want to fight.

  6. That's what the OP wants them to do.....then he/she can send a new, correct package. The only downside I see is that the package will likely get there after the I-94 expires....by a few days....and OP pays for only 1 package.

  8. That is playing with fire and rolling the dice imo. The Consulate Officer could still find you are "too married" for a K-1. It actually happens. I would fly to VN, marry, then start the spousal visa process.
  9. 1. As reported by other VJ members, the average processing times are almost the same for a K-1 (510 days) vs a CR-1 (549 Days). 2. Do NOT have any ceremony before the official marriage inside the US (for a K-1) which could be seen as a marriage. Legally marry in the US first, then you can have a ceremony outside the US. You might want to see this: Every couple has their own priorities, and each couple must decide which visa is better for their situation. K-1 (VJ average processing time 510 days) More expensive than CR-1 Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork) Spouse can not leave the US until she/he receives approved Advance Parole (approx 3-6 months) Spouse can not work until she/he receives EAD (approx 3-6 months) Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period Spouse will not receive Green Card for many months after Adjustment of Status is filed. A K-1 might be a better choice when 18-21 year old children are immigrating also In some situations, marriage can affect certain Home country benefits, making a K-1 a better choice A denied K-1 is sent back to USCIS to expire K-1 entrant cannot file for citizenship until after having Green Card for 3 years. Once an I-129F has been approved, delaying the case is difficult to impossible if the need arises. CR-1/IR-1 (VJ average processing time (549 days) Less expensive than K-1 No Adjustment of Status(I-485, I-131, I-765) required. Spouse can immediately travel outside the US Spouse is authorized to work immediately upon arrival. Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport. Spouse has legal permanent Resident status IMMEDIATELY upon entry to US. The clock for citizenship filing starts immediately upon entry to the US. A CR-1/IR-1 case can be delayed indefinitely at NVC if the need arises.

  11. My wife's letter didn't mention our I-751.....but only 2 days before her interview, our local office sent an email which said I had to be there, it it stated it would be a combo interview. I would absolutely prepare for a combo. Wife didn't file based on marriage. Received this email on Dec 12, 2022: "USCIS Applicant, This email is in reference to your upcoming interview at the Dallas Field Office, it is for an I751(Petition to Remove Conditions) and N400 (Application for Naturalization) combination. It is imperative that your spouse accompany you to this interview, also that you bring proof of a marital union. Please refer to https://www.uscis.gov/i-751 for examples. We look forward to meeting each you both at your interview in the near future."

  17. You don't need a round-trip ticket for a K-1. Tell them it's a one-way trip. If they force you to buy a round trip ticket, just cancel the return leg and get a refund after arriving in the US. or choose another airline.

  20. If you cannot get the cooperation of the consulate, you can request an expedite for the I-130 at USCIS....but don't expect any miracles. It will still not be fast. I wish you had come here first.
  21. Possible? Maybe. The nature of his incarceration is important. I would take to an immigration attorney. You can search for "prison" or "incarceration" here on VJ. Good luck on your journey.
  22. Go back and read my comment. Unfortunately, You cannot adjust status when the I-130 is approved. You must ALSO have a current priority date. That could be years from now. If your spouse was a US citizen, it would be different.
