    Not legal...and not up for discussion here on Visa Journey per the Terms Of Service. Adjustment of Status is for people already inside the US. Thus, as your spouse lives outside the US, consular processing is your legal route for a spousal visa. Material Misrepresentation can be a sole reason for denial.

    Please see my reference above. You must enter either with the petitioner or after the petitioner has entered the US. You cannot enter prior to your spouse.

    Entry on an Immigrant Visa - U.S. Embassy & Consulates in the United Kingdom (usembassy.gov) "You may not enter the United States to take up residence ahead of the U.S. Citizen petitioner."

    The risk isn't even worth the worry. Good luck. Like I said, ask your attorney for some data concerning the number of people with valid AP turned away.

    It's the I-797 receipt notice you received after filing the I-485. It's not really necessary with a valid EAD/AP document. Yes, you have a combo card.

    It means the member had overstayed his/her authorized stay, then adjusted status. Even that didn't cause any issue when re-entering the US via AP. In other words, with a valid AP document, you shouldn't have any issues re-entering.

    One Visa Journey member (in a thread you have seen) said: "I traveled 7x in the last year on advance parole as a long time overstay and never had any issue. I did a ton of searching on this forum and others and could not find someone with issues using valid AP to re-enter. It's not zero risk, but it's minimal. Matter of Arabally has not changed and this issue has not changed. "

    I am truly sorry for your loss. I have always found that advice from an attorney to be boarding on absurd. Ask him how many people with a valid AP document has he known to be denied entry. I recall none since I have been a member here (April 2016). Travel is why they issue AP documents. Many, many people travel and re-enter the US via AP every day. Bring passport, AP document, EAD, and receipt for the I-485. Personally, I would go. Do you want to miss this trip based on a fearful attorney's advice?

    Never heard of that even being in the scope of CBP duties. The visa is approved at the consulate...not at POE.

    Visa Journey history says otherwise. Where are you seeing this stuff? I have heard of only ONE K-1 entrant being denied entry...ONE!!!!!! That was because when the CBP officer asked "Do you plan to marry withing 90 days?", the guy said "Maybe...maybe not". Stop reading FB and Reddit horror stories. They are not good sources. Among valid reasons to worry, this is NOT one of them.

    Yes, They do background checks on sponsoring spouses during AOS. Very, very good attorney territory, imo.

    $625 for online filing for an I-130 is paid to USCIS upon filing. The two NVC fees will be paid to NVC after I-130 approval.....that could take about a year.

    Personally, I don't expect a problem. The photo doesn't look a wedding to me. It looks to be just a photo-shoot. I don't recall your country as having been an issue with "too married for a K-1" in the past. All problems of this kind are normally handled by the Consulate Officer at the interview. I wouldn't worry about it.
