    1. Did your cover letter mention you are filing a divorce waiver petition?
    2. For Part 1, Question 10, you selected "Divorced" as your martial status?
    3. For Part 1, Question 13, date of divorce is included?
    4. For Part 3 Basis for Petition, you checked box for 1.d ?

Both of the addresses below are for the Phoenix Lockbox, just depends on how you choose to send it. Fedex & UPS cannot deliver to a PO box, so you must use the street address. However, I think, USPS should be able to deliver to the street address, as long as it is addressed properly.

Update: Today I got the following email response from USCIS for my e-request:

"The status of this service request is:

U.S. Citizenship and Immigration Services (USCIS) records indicate your Receipt Notice was never initially ordered.  We have requested the notice be sent to the address listed in our systems. You should receive it within 10-14 business days."

Hoping to get my NOA1 (extension) letter soon.

I can now track my case status on older version of USCIS website and ironically, older version provided me upto date info whereas newer version still says, your case received with no updated info

Your work authorization (& your LPR status) does not expire when your 2yr conditional GC expires, as long as you have filed I-751 petition & it is pending. And if you used your 2yr conditional GC when you starting working for your current employer to fill the initial I-9, then your employer cannot re-verify your work authorization again or ask you to complete the I-9 form again.

If your 2yr GC has not yet expired, I would suggest applying for the unrestricted Social Security card. For a new job, you can also use unrestricted social security card + driver license to fulfill the I-9/E-verify requirements. Here is more information on this:

You are correct. Since you are filing as divorce waiver and your divorce has been finalized, you can file I-751 anytime before your 2yr GC expires.

USCIS Lockbox facilities are operated by a Department of Treasury designated financial agent, JPMorgan Chase has this contract for some lockbox locations.

The I-751 filing address for the Phoenix Lockbox sent via USPS is:

In recent times more and more GA districts have signed up to assist ICE. So, it is a really a coin toss as to how police can behave here.
A Canadian woman was jailed recently for not carrying her passport and driving on Canadian license. (This is actually legal)
So,I just don't want to take any chances with gray area status and no valid ID to carry around.

I don't think Tier-2 officers are helping either as i have talked to them twice and they mention 2 more weeks or 1 more month to wait for notice and till now my file is not touched.

So, i am taking your advice and mailing our congressman.

Thanks a lot for all your guidance.

H-M got a reaction from Springleaf in Printout of case acceptance as proof of legal status
Firstly, I am not a lawyer and this is not legal advice.

INA Section 264(e) / 8 USC §1304(e) is part of Federal law. In general, it can be enforced by any Federal law enforcement agency, usually it would be done by CBP & ICE. This specific provision has been on the books since 1940 and historically it is not widely enforced. But things are different these days unfortunately.

CBP has jurisdiction anywhere within 100 miles of a land or sea US border or at the Ports of Entry (International Airports). They can do random traffic stops & check your immigration status. If you have driven through Southern Texas, New Mexico & Arizona, CBP has checkpoints on Interstates & US highways where they stop everyone (including US Citizen) and ask your status.

ICE has jurisdiction all over the US, they usually go after aliens with removal orders or criminal convictions. They can do random worksite enforcement,  however they do not (& also cannot) conduct traffic stops randomly.

In addition, I know there are atleast 2 states (Arizona & Alabama, not sure about Georgia) where under state law, local police can ask for your immigration status during a traffic stop.

H-M reacted to GBOS in RFE for Late filing (but filed in time)
    First thing first:

The RFE must be responded to, regardless of whether the fact sides with you or USCIS.  You cannot call or visit a local office to resolve RFE.  RFE can only be closed out by the officer who issues it, or by subsequent officers if the file is later transferred internally.  Therefore, the RFE must be responded timely to the issuing Service Center.

    Second:

RFE is specific in terms of what USCIS needs you to do.  In most I-751 cases, it takes over a year for someone to get to the file after it was filed.

Assuming that USCIS has misunderstood that you filed I-751 late, and that the RFE requests for your explanation, you should draft a simple one page letter stating the fact you just tell us here with supporting documents (the expired GC and the I-751 receipt date).  Highlight clearly that you have filed prior to the expiration date of the green card and that you believe this is a misunderstanding.

If your RFE actually asks for additional evidence for “good faith” marriage, which is a common (standard almost) for most people who have received one, then send any additional evidence you may have.

    Third:

Based on the fact you told us here, it is clearly you are in the right — meaning you filed with 90 days of your 2nd anniversary (aka GC expiration date) and not after.  What generally happens for people who actually file late is, the file MUST include a letter explaning the “good cause” for late filing — serious illness, financial hardship etc. — and most cases are accepted with a short letter scolding the applicants that “USCIS doesn’t have to accept this, but considering your good cause, the Service Center Director has determined that your late filing can be accepted. Blah blah blah.”
  20. Thanks
H-M got a reaction from Springleaf in Printout of case acceptance as proof of legal status
Printout of the case acceptance webpage from the USCIS site is not proof of legal status. Your gut feeling was correct, the CS representative was trying to get you off the call and gave you false information (They do this all the time!).
For conditional residents, only the following documents are proof of your valid LPR status:
Unexpired GC (I-551) Expired 2yr GC + NOA1 (Extension) letter I-551 (ADIT) Stamp on passport or on Form I-94

H-M got a reaction from bigjailerman in Request for evidence/I797/Separation
    Sorry about your situation.

If you are currently separated and going through divorce, you can request USCIS to amend your petition to Divorce Waiver. In this option you do not have to file I-751 again.  USCIS will issue another RFE for your final divorce decree with an 87 day response period.
Here is more information on this:
    https://www.uscis.gov/green-card/after-green-card-granted/conditional-permanent-residence/remove-conditions-permanent-residence-based-marriage

Also, here is the USCIS policy memorandum on this topic:
    https://www.uscis.gov/sites/default/files/USCIS/Laws/Memoranda/Static_Files_Memoranda/2009/i-751_Filed_ Prior_Termination_3apr09.pdf

You must respond to the current RFE you have received before the deadline. Maybe you can include the request to amend the petition to divorce waiver with the RFE, I am not sure about this. Maybe someone with more experience with this can chime in?

You also have the option to file a second (new) I-751 as a divorce waiver (& also pay the fees again) and withdraw your first I-751 petition. This thread has more information on this option:

Doesn’t seem right, especially since your card is expiring and you’re without proof of your status, through no fault of your own.

They need more transparency.  I understand an issue ocurred, but they need to get those notices out immediately, or offer infopass.

Informed Delivery shows I have a letter from USCIS, which I’m guessing is the biometrics appointment letter.  Once I get that done and over with, I can breathe easy til next January when I submit the N400.

My husband woke me up (at 2:30am) the other night bc he found an article in the local paper that a USCIS Naturalization ceremony was being held this month literally right next door to where we live.  Said a small amount of people will take the oath (approx 50).  HE was excited bc he thinks I’ll have it approved and an oath ceremony before November 2020 so we can vote together.  He is mistaken, I think, but I’ll let him stay excited for now.

I know it must be frustrating. I had the same issue. The first time I called them, they won’t let me get info pass because the reason I gave them was starting a ne job, which is true, but they don’t care.

I called a week later for info pass, the officer called me and asked for reason. This time I said work related travel, he gave me an info pass appointment.
