She'll have to do it if she moves to the United States anyway if she keeps the property and continues to rent out. All foreign income is reported on US tax returns. By the way, It's also possible the apartments are illegally built? In which case, she's got a number of issues she needs to clear up. Good Luck. Make sure you have a ton of documentation for a bonafide relationship on your K-1 application if you decide to go forward.

Maybe the OP needs to answer the marital status question before anything else and any other advise given. When the I-129F was filed, what was checked on Part 2 (Information about your Alien Fiance) Question 9 (Marital Status)?

Widowed
Single
Divorced
Depending on the OP answer to that question we will know how to respond. The answers have been given in previous threads but going forward if we know the right answer then everyone can be on the same page. If the OP does not answer then the answers will continue to be all over the place.

Not sure on your I-94 and being able to come back in before the deadline but more importantly, what has changed in the short time you were gone that you both are now ready for marriage and you weren't before? Just missing each other wouldn't be enough I would think to overturn such a life changing decision. Deciding to get married and then once you are together, you call it off. I know it's not answering your question but maybe it's not the answer you are looking for.

Submit 2015 Tax Returns plus W-2s - Note: A printout of Turbo Tax is not proof of your Tax Return. A transcript from the IRS is definite proof. Your current situation, since you changed jobs, calls for A Letter of Employment and copies of all the paycheck stubs you have so far to show what your "Current" income is. Commissions is tricky because it is not an indicator of what your future earnings will be. I know because I process commissions payments for thousands of reps each month. Are you on a draw? If so, then that also does not indicate what your future earnings might be. Take a deep breath. I know it's frustrating. Good Luck.

You might just have to bite your tongue on this one and just distance yourself. I bet Karma bites him in the ### at some point. However, if you want, contact ICE so they can make a note. Tough situation. I am sorry that you know someone who defrauded the government when we are trying to do it legally. Further, I am sorry that people are so desperate to come to the U.S. that they'll lie and cheat the system.
If it was me in this situation I would contact ICE - I would send them an e-mail with the name of the person and what I know of the situation. In all honesty, ICE probably won't go to his house and pick him up, they don't have the resources to focus on one particular person. But they may make a note in his file for when he files for girlfriend.

I used the USCIS number starting with WAC.... no problems at all here and we processed thru the CDJ consulate.
