Joe&LuMa reacted to Cyberfx1024 in Conditional Permanent Resident
Hello po. Yes, as they said before you will have to wait 5 years after divorce before you can file for someone. But before then you would successfully file for ROC with a divorce waiver. But when you file for your asawa expect to be heavily scrutinized because you divorced so soon, and they will think you did all this for immigration intent. Because with everything you have presented thus far it does look like that is why you got married.

Joe&LuMa reacted to Tahoma in Can I legally make my wife leave my house? Also, is it too late to cancel pending I-864?
OP...Do not allow your wife to make your life miserable. You need to be proactive in protecting yourself.
1. Withdraw your affidavit of support immediately.
2. Move out of your residence and have contact with your wife only through your divorce lawyer.
3. File for divorce.

Don't respond to the RFE. Write and cancel the I-864 immediately. Call and ask to speak to a live person and tell them what you've told us. Contact a lawyer immediately and file for divorce.
You might want to just take all your paperwork and move out yourself, immediately, to a safe place; contact the local police and get it on record that you're very afraid she's going to claim abuse so she can stay in the country.
Documentation would be a good idea, in case she does go the VAWA route. You're the one being abused here, unfortunately.

As far as I've understood it you should act as fast as possible with withdrawing any petition. Because I-864 is not invalidated with divorce.

On a positive note, though, we don't need citizenship for fishing and fishing is more beneficial than voting.
Happy Weekend everyone!

Also if you need any mental health help at low or no cost, Sandhills center will provide it or will refer you to someone closer. It's in West End NC, south of Raleigh.

Don't worry about this. They had this problem with ELIS in end 2016/ beginning of 2017, after which they suspended e-filing of N400. Unless any of you have filed with ELIS you got nothing to worry about. If you mailed you application just relax. Yeah, they are slow, but processing time are decreasing.

Well... Maybe all together, but reading this article, I am not expecting quick processing

You're in NC. Stop having contact with her before YOU get in trouble as well, which will happen because of the DV/no contact laws and how they are enforced like crazy here. You're violating that order and North Carolina will go hard with either party they find out violates it, even the abused person to make a point. I've seen it happen a few times. She can use this against you in NC as stalking and harassment if she wanted to.....
My advice, if you know the name of the person in VA, get the address ASAP be it from her or google or even paying 50$ to a PI. You will want to inform USCIS where she is. I would personally offer to pay her ticket back home and drive her to the airport or have someone trusted do so. Pull your i864 after you find out what is going on in court. I would make an infopass after that and do it in person.
I know DV court is rough stuff, and you mentioned you don't really have anyone to go with you, I'm hoping you have the strength to get through the court date and stand firm on having done the proper thing. Don't hesitate to reach out to all local DV groups because DV is not a women's only club, they will assist anyone however they are just majority familiar with abused female situations. I'm in NC and have some experience with similar, you may PM if you like.

Ask the lawyer if it's okay for you to tell Customs and Border Patrol when you enter on the VWP that you intend to stay, marry, and adjust status. See what he saids.

As already pointed out by other members, coming with a esta/ vwp with the intention to marry and stay is visa fraud, steer away from this line of thinking

I don't think you know what it means to have no contact with her. Having your pastor talk to her and relay things back to you is contact. Stop it now, do not talk to her or anyone else that talks to her for you.
She has no way to adjust her status, she goes home or stay illegal.
Of course she is remorseful she just found out she has no legal way to stay in the US. She is a master at manipulation and your pastor is just another person for her to manipulate.
Stop second guessing yourself, you called the police on an abusive person and now she pays the cost of her actions. Her actions caused this not yours.
You show up in court and tell the truth plain and simple. Ignore what is going on in her life now, she is trying to suck you back in and your falling for it.
