    UPDATE:
     
    I crossed the Canada US border by land (through Buffalo, NY) with no issues.
     
    CBP asked timeline of stay, and what was the purpose of the trip. I am filing for a divorce from my ex this week. Not looking to reconcile, or immigrate to the States.
     
    I hope I do not experience any additional issues when trying to enter to the states, but who knows. BP can be unpredictable.

    You will not know until you try to cross.

    You will not be arrested or detained.  They would simply turn you away.
     
    Here's the rub.  USCIS will likely presume that you are attempting to enter the US to start a new AOS with your USC husband.  The burden will be on you to show strong ties to Canada to overcome this presumption.

    As long as you have a USC husband, then you have a strong tie to the US.  

    Nobody can tell you when you would be okay to enter the US.  There is no set time.

    UGH this process is so frustrating!! I can't believe it takes this long to give a person who is in the country legally the temporary authorization to work. What benefit does it do for the country to have people just sitting around when they could be adding to the economy!? My husband is being so patient, but I am going crazy. I try not to talk to him about it much because it's not his fault he can't work, but having 100% of the financial burden on just me is so stressful. How do you guys deal with it??? I make plenty of money to support us, but I've definitely had to sacrifice a lot (which I would do my entire life if I had to, don't get me wrong). Sometimes it just feels so overwhelming to know that everything relies on you. 
     
    I keep coming back to this forum hoping to see other April filers getting their EAD approved, but seems like there still is no movement. We also had filed an expedite request, but the job offer he was supposed to get fell through because he didn't have the EAD (how freakin' ironic, right). So now I'm worried that requesting the expedite just screwed things up even more - we sent a fax response asking them to disregard the expedite request and just process it normally but who knows if it's been properly handled or not.
     
    And the worst part of all, my husband's grandpa passed away last week. He was devastated and felt so guilty that he couldn't go home to be with his family because he doesn't have AP. It made me sick knowing that him being here in this country to be with me kept him away from being there for his family when they needed him. 
     
    Anyway, no real point of this post. Just felt like venting to people who can relate to what I'm going through!

    and we got the interview letter today, 7 days inculding weekends.
    on june 21 status changed to inteview is scheduled, and today june 28 we got interview lwtter for july 30 at 10:15 am at Indianapolis.
    my AOS interview took 3 months after filied.

    I had my interview on friday… and got approved on the spot! It was a super simple interview. She basically went through the I485 form and confirmed all my responses, asked how we met, and asked for proof of relationship. I had 5 pictures, auto policy, Costco membership, and a house contract. She only kept my costco membership and house contract for her records. 
     
    My card should be arriving this week. Goodluck to everyone! Much easier than the K1 process!

    As of May 8, 2018 the case is ready to be scheduled for an interview. No updates since just yet.

    I really wanted to try to expedite my EAD but just like @KozmicBlues said, it's hard to get an offer letter when you don't have the EAD. Companies will be like: "Give us a call back when you have your work permit or green card. Unfortunately there's not much we can do for you now." Or at least that's what's been happening to me!! It sucks to be waiting, but for now there's not much I feel like I can do. But I keep trying to find an opportunity that will be willing to give me an offer letter even with no EAD so I can try to expedite. If that happens I'll let you all know.

    Ugh, that's rough. To feel so close, yet so far. I guess companies are just covering their butts. I understand, but sucks for us waiting around at the mercy of USCIS.

    We tried it, but it's a tough situation because most jobs won't consider you without authorization to work and they won't expedite EAD without a job offer letter. So how do you get a job offer with no EAD? We requested an expedite and they sent an email asking for additional evidence (proof of financial hardship, job offer, etc). So my husband started inquiring with some small restaurants and such, but most people have already asked about the work authorization. We're struggling a bit for sure, but definitely not in financial hardship so I'm not going to submit anything based on those grounds. Now I'm realizing it wasn't such a great idea to request an expedite and I'm more worried that asking for an expedite took it out of the normal processing. So I just hope the EAD/AP gets processed in general. LOL.

    I highly do NOT recommend them. Two people I’ve seen had Rapid Visa mess up their process. One guy had his visa flat out denied after the interview. Another one, the other day, Rapid Visa told them they’re  NOA 2 (approval notice) doesn’t expire for a year and that’s not true at all! Their NOA 2 is expired now and that sets them even further back. Don’t use Rapid Visa.
     
    i had 0 knowledge on immigration when I first started and I’ve managed to bring my husband over to the US on a K1 with no problem. We’re doing adjust of status now!

    Hello everybody - another April filer here for AOS. Entered on a K1 and filed April 18th. Biometrics completed May 23rd. Case now changed to "Ready to be Scheduled for Interview" as of June 6th.
     
    I guess, having read these posts about the prioritization of GCs over EAD/AP, it's now pot luck under the new system whether or not our case gets picked up quickly by the local field office (in our case, Albany NY) or just sits there for a year!
     
    Congratulations to the couple of people I've seen who already have interview dates! Best of luck

    My husband and I married in March, and we filed for AOS, EAD/AP at the beginning of April. Turns out, marriage isn't going the way we wanted it to, and he refuses to seek any help (ie. Couples therapy, marriage counseling) to possibly workout our issues. 
     
    If he files for a divorce before my AP is approved (as the wait is getting longer by other ppls accounts), how long do I have before i am required to move back to Canada, and do I run the risk of not being allowed back into the US if we are divorced and no longer seeking permanent residency? 
     
    Any help would be appreciated.

    Her 90 days as a fiancee ended in April. 
     
    While she hasn't overstayed yet because of the pending AOS, she will have overstayed her I-94 if they file for divorce and do not complete AOS.   That is the point that I am trying to make.  Not completing AOS has consequences for people who stay past their I-94s.

    With an abandoned AOS, you will have overstayed your I-94 and this will create problems for you in the future with entry into the US.
     
    With a divorce, AP is worthless.

    I came with a K-1 visa in early January, and married within the 90 days. Filed AOS a month later, all within the validity of I-94.

    With a divorce, AOS is dead.  AP would be worthless without a marriage to a US.
     
    Since you filed for AOS, you have shown immigrant intent.  This will make it harder for you to enter the US in the future.
     
    How long have you been in the US?  If you have been here longer than 6 months, you have overstayed.  With a cancelled AOS, your overstay will count against you.

    If you get divorced, your AOS application will be denied as it is based on that marriage. There technically is an exception (see Matter of Sesay), but it requires him to be cooperative by continuing to provide an I-864 to support you, and is otherwise a very uphill battle.
    How long it takes depends on why exactly it happens...if he pulls the I-864, then they will deny shortly afterwards. Otherwise, it would likely be denied when you either skip the interview or attend it without him (or attend it and tell them about a pending or completed divorce). You are not required to inform USCIS of your change in marital status beforehand, but that's only buying you a little time before the inevitable result.
     
    I don't see how VAWA would apply here...it just sounds like a failed marriage. It happens. Sorry that it's not working out, and I highly encourage you to continue to try to work things out, but there's nothing suggestive of abuse here.
     
    Assuming you filed for AOS within the 90 days of entry on the K-1, you won't have any overstay. You are free to seek entry as a visitor, although a recently filed AOS application usually means they will assume immigrant intent and likely deny entry (at least for the near future).

    First of all i'm very sorry to hear that about your situation. I pray and hope everything turn out for the better.
    Depend on what the circumstances are between ya'll. you may still qualify for an AOS. if he is the doing who are doing the wrongs. and you have proved of what his doing. I'm not sure if you filled AOS base on a K1. if it is. remember they gave you an envelope a Congratulation paper on your visa approval at the embassy right after your interview that a has INSTRUCTION OF WHAT TO DO if you being mistreated physically, emotionally verbally........ etc by your usc petitioner spouse. with all the details of what to do if you happened to be mistreating by your spouse. therefore base on what the situation are; you may still be able to continues with the adjustment of status without him. the AOS will take longer but it will happen. i don't know if you still have the paper. if you do you should look at it and read the instruction to see if you can get the help you need.
