    my husband has only been working one month when we sent ours, we included recent pay stub and a letter from employer, we included tax transcripts but he was a student at the time so don't help much. we had a joint sponsor but the lawyer told us it wasn't necessary, hoping it will be enough.

    Wrong. Perfectly legal to stay and adjust providing that it was not the plan on entry. It is not abiding his visa to AoS otherwise USCIS would not allow it.

    If possible you should at least try to consult with an immigration attorney experienced in waivers. Recommendations can be made here if that's something you're interested in.
    I personally wouldn't advise anyone to try and file an I-601 or I-212 themselves without at least speaking to an attorney, even if you ultimately do not wind up hiring them.

    I know that a Conviction is the same as a Caution but I have never heard of a reprimand?
    Shoplifting is a CIMT
    Age is immaterial as far as the questions of a J and VWP are concerned, a mitigating factor in deciding a waiver or deciding if it is required.

    Juveniles by definition can not commit CIMT's?
    That is a very odd comment, thought if that was the case then it would have been mentioned somewhere. Any supporting documentation? Anyway you only have to worry about Convictions and Cautions, the former is proven guilt, the latter agreed guilt.
    Reprimands sound like nothing at all.

    They would have to hit you with a misrep charge, sounds unlikely, they should then give you the I 601 waiver opportunity.I doubt if the Lawyer knows diddly about UK Criminal Law. I remember a Lawyer specialising in waivers commenting that in this sort of situation she would need to liase with a UK lawyer to translate into US terms, obviously looking to mitigate the situation.
    Could it get that far, theoretically, sounds unlikely.

    Does it really matter how many letters? The important thing is they confirmed your case was sent to London. Hope you've been preparing....police certificate...shots....so you can book your medical ASAP.

    Yes, before your interview. Everybody needs to meet immunization requirements to get a greencard. K1s have the option to delay until they adjust status in the US (apply for greencard). You are essentially interviewing for your visa and greencard at the same time in London so must be marked complete by Knightsbridge.

    Just wanted to tell people that you can continue to visit the US even after sending in the DS-260 application. I'm on my way back to Sweden now after spending a week in the US, having entered under the VWP. We have an approved I-130 petition plus have paid AOS and IV fee and sent in the IV application. The POE officer only asked how long I was staying this time and when I'm planning on coming over permanently,that was it. I did bring proof of employment back home and mortgage papers to show ownership of apartment but he never asked to see it.

    Hello everyone! Just wanted to let you all know that our visa was approved!!! No questions about the caution or the previous US visits! It was all over in 5 minutes! I think it was a big help that his caution is from 2007 as cautions became much more serious from 2008 onwards.
    Anyways, thank you all for the help!!! Next stop, California! ))

    For US immigration purposes, when they say "have you ever...they mean EVER in your whole life, even prior to your 18th birthday. For the OP, a UK police certificate will say "no live trace" if something is hidden...meaning it is no longer "live" but a record exists. The Embassy in London will know there is a hidden record by looking at the police certificate and will want documentation on the hidden offense. They send people away from the interview to order the record and submit it. The actual offense will not cause a denial, but the embassy in London will want the whole record before they approve.
    He says his worry is that the visa interviewer will dig into his past visa and use of VWP. His choice to worry if he wants to I suppose. Or he can order a police certificate and find out if he actually has a record or if it says "no trace" which means he was never charged.

    I wouldn't worry about it too much. during the interview you could let them know, if it doesnt appear on the certificate of good conduct its unlikely they would care.ive heard of cases where people have serious criminal records and still manage to get a green card.

    A UK police certificate says "no trace" if there is no record. If it says "no live trace", the record is hidden but exists.
    Others here on VJ in the UK forum have had the same worry as you. Nobody went back into their VWP record questioning their answers on ESTA. The interview was about the current visa qualification and not an inquest into previous use of VWP.

    I can't think of the other names. I have been reading UK forum for seven years and can't remember every user name. I did an advanced search on "traffic+cone" because I knew that was in many posts. I couldn't think of Chris's user name at first. You can do an advanced search with him as author, no key words, if you want to find other discussion by him.
    My personal advice to Chris was don't go in waving a flag saying "I misused VWP". Go in and interview for a visa. Don't bring up topics you are not asked about by the interviewing officer.

    okay thanks i fall into those 3 it was one traffic cone and i had it on my head yes it was halloween i wanted to be a road witch honest i know it is stupid but really is my one and only thing so i should fall into the petty exception tight ???
    im going to be honest about but never knew because of a traffic cone that it would be theft seen as i got it from a hedge and it was on my head
    i am a honest guy and iv always stayed away from crimes it was one of things where i was pulling a stupid joke ooooops

    A quick note on that from rich personal experience. US border officers often use intimidation techniques (as in "being a j*rk") as a tactic to bring up the worst in you. They hardly ever smile back, and don't usually laugh at your jokes (in fact, joking is the fastest way to get in trouble). They may ask the same stupid question several times, and speak condescendingly. They may act like they can't hear you and make you scream on top of your lungs from your car.
    You should never take such behavior personally. It is not directed at you, it's just a tactic - and it works because people who do have something to hide are very easily destabilized by this behavior. Your best bet is to be calm, collected, serious, have respect for yourself and for them as officers. And no, you shouldn't smile too much, otherwise they think you're weak and nervous.
    Of course, it also depends on your profile. An older lady can smile as much as she wants, and will be taken as cute. For a younger male, the "Yes, sir!" style seems to work best.

    Hi guys. I want to share my experience. I hope it helps somebody.
    I flew to the US in December 2014 on a tourist visa to visit my husband for Christmas and New Year while waiting for our I-130 to be approved. I had prepared for my trip (letter from my employer with the statement that I was a current employee and was on vacation in that period, my property certificate, my car title documents+translations).
    I worried a lot not just because we started the immigration process but also because I had to renew my passport before my trip as I took my husband's last name and my old passport was going to expire in December. So, my tourist visa was issued on my maiden name and it was in the expired passport. As I found an info on the US Embassy site in that case you need to have with you both passports (old and new) and your marriage certificate (in case of your last name change). But Delta Airlines representative who was checking me in to the flight from Germany to the US didn't want to do that because my visa was issued on my maiden name. I was lucky to get an assistance of another Delta airlines security officer. He found the US Embassy representative right at the airport, who checked my documents and in 2 seconds said "OK". I didn't know that in big airports like Frankfurt they have Embassy representatives who can resolve problems like mine.
    I was very nervious during my 9 hours trip to the US. But once I was at the Point of entry in Chicago the CBP officer asked me:
    1) What is your purpose of visit? I said I was visiting my husband.
    2) Where does your husband live? I said in the US
    3) Where do you live? I said in Russia. Then he just noticed "Oh, it must be hard to have a long distance relationship". I answered "Yes, it is. We are travelling back and forth to see each other".
    4) How long will you stay in the US? I said "Untill January 31".
    I noticed I could show him my marriage certificate cause my current last name didn't match my visa info? He just waved (meaning he didn't need it) and told me "Welcome to the US"
    That was it!
