    If you’re a Canadian working remotely in Canada then you don’t need a US employment based visa. You can work for them no problem.

    OP, if people are not giving you the type of feedback you seek, it is because you are not explaining your situation fully or clearly.  
     
    I don't see you getting a waiver for a B visa.  But, why not just apply and attend the interview and see if they say that a waiver is available?  That is all you can do.

    A B1/B2 is a tourist/business non-immigrant visa
     
    Why else would you ask about gaining a visa other than to get back to the US?
     
    Your case has so many legal pitfalls that any further discussion in this forum is pointless - You really need to discuss this with an attorney. The people in this forum are just trying to let you know that with your circumstances, you basically have zero chance of legally entering the US. Embassies / CBP will not care about your claims of abuse, coercion, malicious prosecution, etc. because they are precisely that - Claims that have not been proven in a court of law. Please, if you want to pursue this, talk to an attorney. I wish you the best of luck

    I think your odds of getting a visa are extremely low. Many are focused on the cost of the trip, but I am sure you can save up for it. I'm guessing you live with family and have minimal expenses. On the other hand... On paper, you're a prime candidate to come here, overstay your visa and work under the table. I mean never say never, and I would be delighted to be wrong, but yeah, I wouldn't hold out much hope if I were you. Good luck!

    Well, it's pretty much a pattern:
     
    - You bring extra evidence -> Nobody looks at it
    - You don't bring extra evidence -> You get asked for it
    - You bring spouse -> Nobody talks to them
    - You don't bring spouse -> Officer turns sour and starts grilling you over marriage
     
    OP's case already has few little flags, such as moving a lot. I wouldn't risk it. More evidence and spouse present is the day to go.

    Your posts are coming across as very aggressive to people who are just trying to help. 
     
    All I said is that flights were leaving in 2020 so the pandemic wouldn't be a valid reason for overstaying that long. 
     
    There's nothing you can do but wait and see what happens. What document was requested on the 221g?

    No one here will be able to give you that answer. It's up to the officer to make that decision. But since you've had one in the past and did not abuse it, I would say your chances are more favorable. I have a bunch of friends in Argentina/Brazil and if they've had a B2 before, they generally haven't had an issue getting another one.

    My wife's visa Journey is nearing the finish line. The timelines are in a previous post 
    So the updates:
    February 8, 2023: We went in for the N-400 interview but were told on the spot that the i-751 Interview would also be done, which threw us off. It was our fault for not doing more research and bringing a hard copy of what we sent. Thankfully, we were approved for the i-751 removal of conditions. However, the N-400 was canceled pending rescheduling. July 18, 2024: Received notice: "We are actively reviewing your Form N-400, Application for Naturalization. Our records show nothing outstanding at this time." August 26, 2024: Received notice: "We scheduled an interview for your Form N-400, Application for Naturalization. (September 30, 2024 Irving)" September 30, 2024: 8 am: Complete interview 9:30 am received notice: "We recommended that your Form N-400, Application for Naturalization, be approved. Your case was submitted for quality review." 12 pm: Receive notice: "Your Form N-400, Application for Naturalization, was placed in line for oath ceremony scheduling." 1:30 pm receive notice: "Oath Ceremony Notice Was Mailed (October 19, October 2, 12 pm Irving, TX)."   We got there at about 7:45 am. They only let her in, and I stayed in the car.
    According to her, she went through security and had to wait 10-15 min for them to call her. The officer interviewing was pleasant and spoke good english. She starts with an oath where she stands, raises her right hand, and swears to tell the truth. No small talk at all. The first thing was to read and confirm her full name. Then the officer asked my wife to read out loud one sentence. Then the officer said, "California has the most people," and my wife had to write it on a tablet.
    Civics Test:
    -Name of national anthem
    -Where is the Statue of Liberty?
    -Who makes laws
    -Who signs bills to become laws?
    -I forgot the last one.
    From there, it was an N-400 walkthrough. The first minor hiccup was how long we've lived at our current address. We have lived in the same building address for 4+ years but moved apartments, so technically, our current apartment has been there for only two years, but the building has had the same address for 4. My wife had to point that out to the officer.

    Things got really tense once it came to how long she'd been out of the country. The officer said, "You've been out of the country longer than you're supposed to, which is more than six months in a year."
    My wife had only been out of the country 2-3 weeks a year for the past five years, so this was very confusing. The officer showed my wife the screen, and it showed a bunch of dates that we did not submit on our N-400 or I-751. As it turns out, the system added the 1+ year she needed to wait outside of the country for her CR-1 to be approved and lawfully enter the US. We are really grateful the officer showed the screen and a willingness to listen because it allowed my wife to walk through with the officer that it's counting time before she was a lawful resident and we lived in Colombia right after getting married because our understanding was to change her Visa from visitor to spousal, we HAD to leave the USA until the CR1 was approved, a new visa was added to her passport and mailed back to her. 
    The officer said that made sense and let my wife know that if she hadn't clarified that, she would have denied her and was actually wondering why my wife came to the interview if we knew she was going to be denied based on being out of the country for so long. 
    After that tense back-and-forth, the officer made all the updates in the system and said my wife was recommended for approval.

    We were shaken at the fact an error happened that was no fault of our own, and that error was pointing us to being denied. But we are SUPER grateful the officer was willing to let us explain our side and not just try to push us through to get to the next person. Overall, it was like a 45-minute interview, and the happiness kicked in with them being so quick to schedule our oath ceremony (October 19).

    I called my CBP friend currently working in Tampa. She said the only way they confiscate a passport is when you are taken into US custody, and then only until they can release you to to the authorities from your embassy. Just like a US passport is the property of the US government, your Passport ( Unless you had a US passport) is the property of your government agency that issues it.  She said there is no way they would parole you into the country without any form of identification, that right there would get someone fired, along with taking something they legally have no right to do unless you are accused of a crime and in custody, and if that was the case, they would have notified your embassy that they have arrested a citizen of their country for x charges, and it would go from there. She said at the most, they could remove, or more than likely VOID the visa in the passport, and then admit you with a parole hearing date, but she is astounded that you are in the US, and CBP took your passport. So, just to be clear, you are inside the United States, with no form of identification? If so, I would get to your nearest embassy and file charges against the US. Bet that packet would show up really soon, like instantly. Your embassy should have a hotline to call, and they could probably figure this whole thing out quickly, or at the minimum get you a travel document to return to your home country.

    I know you want more info on the K1 visa, but I’ll just second what others have said: my suggestion would be to get married and have him file for a spousal visa. We went the K1 route way back when K1 was actually a lot quicker than CR1, but in hindsight, we would never do this again. It felt like forever for us to get my work permit and advanced parole approved, but back in 2017, it “only” took us about five months. These wait times are a lot longer now. And that’s not even a green card yet. As suggested, I wouldn’t get hung up on the couple of months you *might* shave off with a K1; it really isn’t worth it. Marrying would be relatively easy for you guys assuming that, since he can’t leave the U.S., you are the one usually making the trip. Just have a court house wedding next time you visit, and then file the necessary paperwork. You can plan a reception with all of your family and friends once you have set up shop together. 
    Should you still want to pursue the K1, it should be relatively straight forward. The guides on here are very helpful, and the necessary documents needed should be relatively easy to obtain for you in Switzerland (at least that was my experience).

    You can check the tracking on USCIS, as they will update when they've sent your petition to NVC, but it is currently taking a while.
     
    For reference, our NOA2 approval is dated 2nd August, but they didn't dispatch to NVC until 28th August.
     
    It's frustrating, because the NOA2 specifically reads "We have sent the original visa petition to the Department of State National Visa Center (NVC)", but in reality they haven't. The wording suggests that by the time you're reading the NOA2, it's already on it's way. They should really re-word the NOA2 to say "We will send the original ..." so you immediately understand to give it some time.

    Why would you care about the time and effort you've put in thus far? Wouldn't you rather find out BEFORE he gets to the U.S. that he's going to skip out, after you've put in MUCH more time, effort and money?

    My fiance purposely ditched out on his K1 Visa interview claiming “cold feet”
    He did not notify me or the embassy until after the interview date that he had done so. 
    I am so hurt to say the least. But I still want to be with him.

    I think it depends on the POE. I used the free app last time I returned to the US (last June) and the mobile app line was pretty long. Took us 45+ minutes to get through immigration. Definitely better than the "normal" line but also much slower than Global Entry.
     
    But yes, when you have checked baggage, it often doesn't matter. Even though it took us 45 minutes to get through immigration, the bags just started coming out in baggage claim when we got there, so even if we had Global Entry, we would have had to wait quite awhile for our luggage.

    I have a friend who received Global Entry for free, as an airline frequent flyer bonus (He's a million miler).
    He used it once.  Never used it since.  He says it is always way faster just to enter using the free US Customs app.  No one uses that, so there is never a line for it.
    Any citizen can download this app for Android or iPhone and you will basically immediately enter the country without waiting in a line, without needing to fill out an application form, or be fingerprinted or interviewed, or pay any fees.

    I'd try this before I signed up for Global Entry.
     
    Another thing to consider:  Every single time I've waited in the regular line for the standard passport check WITHOUT Global Entry, I've had to wait on the other side for my baggage for several minutes before I could proceed.  The baggage processing time is always greater than the passport processing time.  So having Global Entry would have meant I would be waiting on the other side of the passport check in the room where you retrieve your luggage to have it possibly screened for taxed or prohibited goods, but wouldn't have reduced the waiting time at all.  That's the single reason I don't have Global Entry.  It's wait here, or wait there.
     
    Now, if you aren't checking luggage when you travel internationally, by all means, go for it.  But otherwise not worth the time, expense, and privacy for me to do enroll in Global Entry.  Of course, those who paid up for Global Entry and see the much shorter line they go through are going to sing its praises but in the end I don't see any benefit...

    Visa Journey history says otherwise.  Where are you seeing this stuff?  I have heard of only ONE K-1 entrant being denied entry...ONE!!!!!!   That was because when the CBP officer asked "Do you plan to marry withing 90 days?", the guy said "Maybe...maybe not".  
     
    Stop reading FB and Reddit horror stories.  They are not good sources. 
    Among valid reasons to worry, this is NOT one of them.

    If you’re really worried, why would you have her travel at all?  Seems the safest option would be to stay home.
