    Then you should definitely wait for someone who has already been through the interview stage to respond here. But the tax return, as far as I know, is not one of the documents that needs an original signature. In fact, you only sign it when you submit it to the IRS in the first place, and they keep that document. So if you DO end up needing it, then you could tell him to scan it and e-mail it to you and then you print it, without it going through the mail or anyone else seeing it.

    You need 5x the current poverty level for you and your fiancée, which is $19,660 per year, ASSUMING your particular consulate/embassy accepts assets as proof of financial support.
    If it were as easy as you think it is, you could just get someone to deposit the required amount in your account, print off the bank statement as proof that you magically have the close to $100,000 necessary, and then return the money the next day. They'll see through that in a second.

    The loan option is not viable. You can either find a way to earn the required income yourself, do more research about the cases in which Manila accepts a co-sponsor (which are rare, from what I understand), or you rethink your reluctance to get married. I believe they have to accept a co-sponsor for the CR-1, but someone else can confirm that for you.

    If you get married, you apply for a CR-1, not a K-1. Like I said, I think I remember reading that the embassy must accept a co-sponsor for a spouse, but not necessarily for a fiancée.But wait until someone else confirms that or do some research on these forums. It shouldn't be hard to dig up.

    Not to be a jerk, but just trying to think from a CO's point of view...
    You two started the K-1 process but never completed it and are not even sure of the current status of your case. You refer to him as your fiancé but say you are "on amicable terms", as if the relationship was over but you remained friends or something. The uncertain nature of both your pending K-1 application and relationship with this person is going to come up at the B-2 interview if you indeed apply, and you need to be able to articulate the entire story better than you've done here. Hard evidence from the hospital will be necessary but probably not sufficient.
    I hope for the best possible outcome for you two, whatever that may be.

    That's what I meant when I said to tread very carefully with these types of questions. Just because you can't see it on e-verify doesn't mean the government can't see it. If a question has the word "ever" in it, you have to take your whole life into account, not just your "record." Answer truthfully and you won't have any problems, assuming your past doesn't involve anything that would prevent you from being a petitioner.

    No offense, but it sounds like your lawyer is approaching the problem from the wrong angle. Based on the info you've provided us with, this is NOT a LGBT issue. The information you need to find out is exactly why you got denied, so if I were going to contact anyone in power, it would be my senator/representative. I would also have my lawyer filing a FOIA request ASAP, which someone else mentioned already a couple pages back.

    If I'm understanding this correctly...you were in a romantic relationship with this person back in 2010 when you applied for a "nanny" visa on her behalf to visit you in the US? You see how that would cause some problems, right? If you misrepresented your relationship to the government in the past, it could most certainly have consequences now.
    Again, I'm not sure if I got that right, because the story is somewhat confusing.

    But lying about the nature of their relationship on the application for the B2, and inventing this "nanny" story as the motivation for the OP's fiancée to travel to the US back in 2010, is misrepresentation.I can't provide one set of circumstances to the government because same-sex marriage isn't legal, and then when it becomes legal provide another set of circumstances. The COs are going to see right through that and know that at least one of the times, the applicant wasn't being truthful.

    If she was always your fiancée, and you lied about this when you/she applied for the tourist visa, that's a problem now. It doesn't matter if DOMA existed or not when it happened. That does not make it OK to lie about your relationship to get around the laws in place at that time. I'm 99% sure your denial has something to do with that, so you need to address that issue specifically with your lawyer. If your lawyer told you to lie back on the tourist visa application, then it's time to find a new lawyer and report that one to the appropriate bar association or equivalent.

    I also sympathize with you and your situation. However, my original point still stands. If you said she was your nanny four years ago just to try to get her into the US on a tourist visa, and now you're saying she's your fiancée...which is it? That's how the CO probably saw this situation.

    Everything you sent will get returned to you and you'll have to re-send it with a check for the correct amount included this time. You'll lose a couple weeks' time, but nothing that will affect the success of your petition in the long run.
    EDIT: Many people on these forums will tell you to do this process by yourself instead of hiring a lawyer, and in most cases I agree. But you're dealing wiht the federal government, and you have to be extremely detail-oriented for things to go smoothly in the least amount of time possible. Every time you read instructions for filling out a form or submitting anything, make sure you understand all the terms and ask here first if you don't.

    I can't see how anyone at POE would know about the return portion of the itinerary. The problem would be with the airline, since most of them prohibit doing this (it's known as "throwaway ticketing"). But the chances of them taking any action against a passenger over a single instance is basically zero, especially if you cancel the return flight in advance (but after you've completed the flight to the US, of course).

    She can attempt entry on her expired green card and valid extension letter, but when CBP see that her status is revoked they will probably ask her to voluntarily relinquish her green card. If she refuses, they will likely give her a Notice To Appear in front of an immigration judge and they would ask the judge to permanently revoke her green card.
    You should consult with a lawyer, as you have galactic-sized problems.
