aussie_jason got a reaction from Ad3line in AOS approved on the spot but had to complete I-508?
We had our AOS interview this morning, got there 30 minutes before the appointment time but weren't called until 30 minutes after the appointment time so getting there early didn't seem to help. It was all fairly straight forward except for:
1. The IO was of the opinion that as I was adjusting from an E3 visa that I needed to complete I-508 in triplicate to waive my rights, privileges and immunities but I'm not employed by the Australian government so that shouldn't have been required but I went along with it as I wasn't about to argue with an IO.
2. We had a blonde moment and got the date of admission from the I94 mixed up, we put the 23rd instead of the 16th as I was admitted until the 23rd so CBP must have given me an extra week after my current E3 expired
3. My wife noticed something about a potential denial due to not having certified court records but thankfully I had them with me
It was very casual she asked the standard questions about the various dates (when we met, our birthdays, marriage date etc), asked for our proof of bona fide marriage so we handed her the package we had for that and she kept the entire thing, she flicked through, complimented us on how pretty our wedding was when she got to the photos and asked my wife who some of the people in the photos were. The package I put together for the proof of bona fide marriage included:
- A confirmation of my benefits through work listing her as a beneficiary for health, dental & vision and a 100% beneficiary on my life & AD&D insurance
- An account statement from a joint savings account we started back in 05/2012
- Copies of our store cards from Victoria Secret & Express showing we have cards for the same account number
- My emails with her dad (he doesn't speak English and I don't speak Spanish) asking for his permission to marry his daughter
- An article from houston.eater.com reporting on our engagement at a local restaurant
- A couple of itineraries to NYC together for thanksgiving and christmas with family there
- About a dozen photos of random social and travel pics with a bunch of our wedding with family
We also had our 2013 tax transcript that we filed MFJ but I had that filed with our copy of the I864 and she didn't ask for it so I didn't offer it up.
Once I completed the forms and she had finished asking questions she left the room for a while, then came back and told us we could put our ID's away now but she still needed my passport for a little longer (at that stage I knew I was approved AND was going to get my passport stamped without even asking), then I saw her pull out a stamp and I noticed the APPROVED so I started doing a little chair dance, from then she just had to stamp the file and my passport, write in some details, punch a few things into the computer and then we were good to go after she went over the process for ROC etc. The online status hasn't ticked over yet but I'm not worried about that as I already have my I-551 stamp so already am officially a permanent resident!

aussie_jason got a reaction from ShawnSpiker in Bad Interview Experience :-( - Fairfax VA
Lets look at this from the perspective of USCIS for a moment:
- Someone is visiting the US on a B2 visa from a country that has recently suffered from a lot of civil unrest, they would have been admitted by CBP for a max of 6 months but they could have extended that through ELIS while in the country but they likely don't have that long left on their period of authorized stay
- They meet a USC citizen
- Date for a "short time"
- Get married at what appears to be a civil ceremony with just the required one witness
- File for AOS
To prove their marriage is bona fide they provide a long list of accounts, insurance and other paper work that people can generally be quickly added to (and usually just as quickly removed from) along with the marriage certificate, a small number of photos and some "cards from family". The OP's family apparently lives in the US but her husband is yet to meet them due to financial reasons yet here they are in the middle of AOS and with a lawyer.
Don't get me wrong I'm not questioning whether the marriage is bona fide or not but if you look at it from the point of view of USCIS then I'm not surprised they were given a hard time at the interview.

aussie_jason got a reaction from Darnell in I'm terrified--USCIS is giving a blatant scammer a GC and I don't seem to be able to stop them
It is right there as an option on the official form to file for annulment http://www.courts.state.nh.us/forms/nhjb-2245-fs.pdf the sixth result for a google search for New Hampshire annulment fraud.

Perhaps the guides or the tips for K1 should be updated to include that you should prepare your I-485 package ahead of time and ensure you have the fees before you enter the US.

Overstays are forgiven when AOS based upon marriage to a USC as long as the beneficiary entered legally they are fine to adjust.

An I90 requires biometrics to be done again to verify it is the applicant requesting it.

aussie_jason got a reaction from Harpa Timsah in Can you travel to the Caribbean with just your Green Card (no valid foreign passport)?
The site you quoted is out of date.
If you travel outside of the country without a valid passport then you are going to have a hard time regardless, your friend should not even be entertaining this idea, either they renew their passport or they can't travel internationally. Stop trying to prove this by quoting various websites, that is not going to help you with CBP, Passport Control etc.

We don't even know for sure what country the OP's friend is a citizen of.

aussie_jason reacted to Harpa Timsah in AOS interview in 9 days - Still no EAD. Is that normal?
Your EAD has not come yet because your interview is scheduled so fast, just 2 months from when you filed. EAD takes 90 days. So if your interview is super early, you might not get an EAD, nor have need for it. You should count yourself lucky.

Lawyers don't like their authority/knowledge to be challenged. Mine has told me similar to other things when I read online otherwise....Lawyer's can have big egos....I've learned over my years, you need to have your own knowledge on how things work and don't just blindly trust and accept what lawyers say.... They simply don't have time to spend following up thoroughly on your case and will say stuff to get you to leave them alone and things happen when they happen.

aussie_jason got a reaction from sumitlesia in How much this misdemeanor will impact my application?
My bad, go with what Harpa said not me as check forging is fraud and that is a crime of moral turpitude.
-
aussie_jason got a reaction from sumitlesia in How much this misdemeanor will impact my application?
It shouldn't be an issue as long as you provide a certified disposition from the court, if you don't provide a certified disposition and instead just provide a copy then they will deny you.

aussie_jason reacted to Sandra G. in Possible bigamy?
There is no abuse here at all.Let's stop with the VAWA song. USCIS said 1000 times when issuing RFE in Vawa cases that " drunkenness, cheating, failing to file AOS ,lying, misleading, being mean, they consider "MARITAL DIFFERENCES, UNPLEASANT SITUATIONS", (their words), BUT NOT ABUSE. I can't see any abuse going on here.

I believe the I-485 form fees are 1,070 not 1,010.

aussie_jason reacted to Harpa Timsah in EAD request terminated
The GC replaces and supersedes the EAD. A GC is proof of travel permission and work permission, plus a lot more.
No more need to EAD, so that is why they cancelled your request.

aussie_jason got a reaction from noncompute in How long should I be waiting for the Green Card after approval?
Did she not apply for an EAD or Advance Parole?
I can't see how the "USCIS GC production unit" would be that backed up, many people have been getting approved and getting their green card in about a week recently, myself included. Sounds like the IO at the infopass appointment was spreading FUD.

aussie_jason got a reaction from jetblued in AOS Medical Examination, PLEASE HELP!!!
You only need the first vaccination in a series for the I-693 so I don't know why they made you come back, did they give you a sealed I-693 to include in your AOS package after the first round of shots? If so then I wouldn't worry about it and just hold on to the extra one you have in case you need it for an RFE or at the interview, both of which I doubt.
If you were to send it in though you would use the address on the I797.

aussie_jason reacted to Hypnos in Traveling within give 50 states on expired stay
Have you filed an I-485? You can probably travel within the US without issue (unless you happen to run into a CBP interior checkpoint; fortunately they're rare) but you're still out of status and deportable if your I-94 has expired and you haven't filed an I-485.

aussie_jason got a reaction from kehills in ARE YOU SERIOUS USCIS???? REALLY???
Ditto, that is pretty much our national motto in Australia but to me my legal status is important so I did worry enough to make sure my AOS went through without a hitch.

aussie_jason reacted to sweet cakes in Filing AOS today but have question - URGENT
You need to submit a total of 6 pictures. You missed the DS-3025 (Vaccination sheet). Also, if I were you, I would wait for the official (or certified true copy) marriage certificate. Some have been given an RFE for not submitting an official marriage cert.
What evidence did you attach with the I-864?
You also need duplicates for the other requirements for I-765 and I-131.
http://www.uscis.gov/sites/default/files/files/form/i-765instr.pdf
http://www.uscis.gov/sites/default/files/files/form/i-131instr.pdf
I also added 2 more G-1145 as notifications for each applications are separate.
No need for the SSN receipt.

aussie_jason reacted to Caryh in Combo card rejected at Peace river Canada crossing....
Exactly. A USA green card holder can enter Canada, before that is in possession it depends if their passport holder's country is accepted to enter without a visa. You can travel and re-enter with the combo card, but you still need to follow the visited country's rules on who can visit and if a visa is required.

aussie_jason reacted to aaron2020 in Wife on 2nd 10 year tourist visa, thinking of staying for extended time this visit
Why don't you guys want to get the green card?
For a couple of thousands, you could avoid the complex need to leave every six months.
Also, leaving for Mexico or Canada does not reset the clock. Meaning, she cannot get another 6 months if she visit Mexico or Canada.
Why complicate things when a few thousands to get a green card would make your life easier?

aussie_jason reacted to novedsac in ARE YOU SERIOUS USCIS???? REALLY???
Not encouraging at all, but I also don't see the point in berating the guy for taking a few months like he did.
I agree, planning the paperwork, logistics and funds ahead of time is prudent and avoids unnecessary trouble. I'm surprised at the number of posters who are shocked there is more to do after their loved one arrives in the US. I'm surprised at the number of posters who struggle with meeting the finincial requirements of the I134 and I864. Personally, I'd want all these things ironed out and 'in the bag' before I'd even consider asking someone to come live with me and start a life anew.
Some like to worry about everything. I don't worry about much at all.
