I know you can certainly claim US citizenship, not sure about Russian or Ukrainian. If you read the links, you may not have Russian citizenship since you were born overseas to only one Russian citizen (your mother), and not two as it states (consider the source though). Completely anecdotal. I was on a recent work trip with 8 other collogues. Some USCs, some LPRs, and one on an H1B, we all entered through Detroit Metro Airport, and none of us were sent to secondary. Additionally, the non-citizen line was long, but was moving, and the USC/LPR line took only a few minutes to pass the immigration officer. This was with three international flights arriving around the same time. A lot of fear mongering going on, and CBP may have stepped up vigilance of irregularities such as LPRs with long absences, or other things, such as questionable countries visited, etc., but if you are legal, expired CGC and extension letter is legal, you will be fine.

You need to do whatever you feel you need to do related to an attorney. This is a fairly common RFE as most people do not realize that the W2 information is already included in the IRS transcripts, so I assume an attorney will tell you the same thing wrt responding to the RFE. If it were me, I would send in everything the RFE asked for even if some of the information is duplicated such as sending in additional copies of your W2's with the corresponding 1040's (don't assume common sense with USCIS). This may be the issue. Is the RFE requesting copies of tax returns? As @K1visaHopeful stated, W2's are not necessary when submitting IRS tax transcripts. There have been examples of people receiving RFEs when they combine transcripts and W2's which does not make sense, but apparently USCIS can be easily confused. If what I laid out is accurate, I would respond to the RFE by providing what they ask for rather than potentially creating more confusion by moving to an I864EZ. Good Luck!

AP is fairly common, but you mentioned they returned his passport which does not seem to indicate it will be quick. Is your spouse from the UAE, or are they from another country?
