  2. The last paragraph in the story is kind of telling. Does he still have a valid DL when his LPR status expired and a deportation order was decided by an IJ? Also, the family, even dealing with a personal issue, remembered to keep filing taxes, but didn’t worry about his LPR status?   6. I do love the biased reporting. “Endless forms”? Heck if he had filed the I751 properly, he could have naturalized as early as 2016/2017. “Petition to Remove Conditions on Residence,” was just one of the endless documents he needed on his decade-plus journey to American citizenship.
  7. Seems like it might be able to be cleared up most likely with legal help, and a proper filing of the I751. I say legal help as supposedly he was required to file that form in 2015. He certainly cannot naturalize if an ROC is required, and most likely he was ordered deported by an IJ in abstentia. Sounds very similar to this story, although this was about filing an i485. The question is what should a USCIS IO do when they find a situation like this assuming an IJ has ruled?
  8. Does it seem to be from the proper source? There is a little bit of grammar issues with the message, so it could be phishing. I would try emailing the consulate with the pertinent case reference information to see if this is real, and if you are sure, go and see. As to a file review, I suspect they are talking about the file the consulate has regarding the beneficiary. Good Luck!

  10. Always wondered about the Iowa 80 Truck Stop. We have never stopped there, thought about it once, but there was a backup on the exit ramp so drove on. Is it a tourist trap like Wall Drug, or is it pretty good? As to road trips, yes, we tend to prepare ahead of time. Full tank the night before, and a good breakfast before setting out, and the aforementioned meals/snacks in the car (we have an plugin cooler we position strategically). Our longest trip together was from Cody, WY to SE MI. We tried to take an extended break at rest areas in Southern WI, and also SW MI (just inside the state line), but the most we could get was 20 minutes before we gave up and kept driving. I bring along a good sleep mask so I can catch a few zzz’s when my wife is driving, and that usually works.

  13. There is not a biometrics specific appointment for a K1, but there may be fingerprints and photos taken at the interview (it has been a long time sine my wife went through this process). As to taking a copy of the package to the interview, this is not required, but it is a good idea just in case a CO asks for it. Good Luck!

  16. Is it the exact same thing? Wasn't Biden simply paroling a bunch of people from some countries while they wait for an asylum hearing, but in the case here these folks have been vetted through the congressionally authorized refugee program. Keep in mind asylum seekers and refugees are not the same thing. The entire Biden thing was based on an EO, so not rooted in the law, so it can be easily corrected or modified via a new EO. We shall see how it all shakes out in the end.

No one can get the original of any civic document as the original is always kept by the issuing agency. this is one of my pet peeve's when it is requested that someone provide the "original" of something like a divorce decree, birth certificate, etc. It is simply not possible to get the original, but rather only a certified copy by the issuing agency. The issue here as @top_secret stated, is that the consulate wants that certified copy with the stamp/embossing, and not a copy of it. Good Luck!

  19. With all our road trips, many through Iowa, we generally do not look to gas stations for meals. My wife is meticulous in packing relatively healthy meals annd snacks for our trips, and we eat on the drive. Our interest is more in bathroom cleanliness, and we usually find Loves Truck Stops to be the best although YMMV.

  22. To clarify, he will not be able to return except after going through a spousal visa process and obtaining a valid CR1/IR1 visa. It appears you will be good and have now done the filing the proper way with the inclusion of the I130. Good Luck!
  23. There have been instances where a consulate has asked for an I864A from the spouse of the sponsor or joint sponsor even if the spouse is not employed particularly when the sponsor or joint sponsor files taxes jointly. Probably best to have the spouse fill out and I864A. Good Luck!

An unexpired immigrant visa (IV), reentry permit, or other valid entry document is required of an immigrant under INA 212(a)(7) except as indicated below. b. Waiver for Certain Children Not Required to Obtain Visas: (1) Child Born After the Issuance of Parent's Visa: A child born after the issuance of a visa to an accompanying parent who will arrive in the United States with the parent and apply for admission during the period of validity of the visa issued to the parent is not required to obtain an immigrant visa. (2) Child Born to an LPR: A child born of a Lawful Permanent Resident mother during a temporary visit abroad is not required to obtain an immigrant visa if (a) seeking admission within 2 years of birth; and (b) accompanied by either parent, who is applying for readmission upon first return after the birth of the child. The accompanying parent must be found admissible for the accompanying child to be eligible for admission without an immigrant visa. (3) Requiring Reentry Document of Child’s Parent: The provisions of 9 FAM 201.2-3 paragraph b(1) and b(2) above apply only if the noncitizen parent is in possession of a valid Form I-551, a valid reentry permit, refugee travel document (lawful permanent resident only), an SB-1 visa, or other appropriate documentation consistent with 8 CFR 211.1(a).
