    35 years old is not young. Compared to the 65 year old husband, yes, she is younger, but she is no ingenue to the world at 35. She should've known better. My suspicion is she had plans to 'manipulate' the husband (with respect to property, money, immigration, benefits) but the husband was smarter than her and moved to checkmate.

    What I find curious is the spin that somehow, it's Obama's fault. It's Congress that has plenary power over immigration, for crying out loud! Congress made immigration law, Congress is the one that needs to be lobbied to introduce changes to the law. That's what immigrant rights advocates need to do.

    Detention and removal proceedings only started in July, several months after OP got married in March or April. OP cannot then be accused of marrying just to avoid deportation. The problem is the failure to adjust status before removal proceedings.
    OP now needs to hire a lawyer, file the I-130, have removal proceedings terminated in front of the immigration judge as OP has a pathway to permanent residence or citizenship via the wife. Once removal is terminated, only then can the adjustment of status be adjudicated by USCIS.

    If he was a student, then he did not enter illegally. He would have entered on a visa then overstayed. Overstays of spouses of US citizens are forgiven if the alien spouse entered on a visa. Since you claim that an unlawful presence waiver is required, that means he entered without inspection and he was not a student on a student visa.
    Someone who entered without inspection will have a very difficult time getting a green card, so hire a very good immigration lawyer.

    The ban is 3 years if you overstay more than 180 days but less than 365 days.

    The Supreme Court decision means you will not be allowed to adjust status as a derivative beneficiary of your parents' approved petition (as sibling of a US citizen).
    Probably best that you leave the US and wait in the Philippines for your F-2B priority date to become current. Because you applied to adjust status, the US knows you are here and where you live in the US and you will be subject to removal proceedings once your I-485 is denied based on the Supreme Court ruling.

    Someone else already pointed this out but what boggles the mind is he was employed as a manager at Best Buy. Everytime he hired someone, he had to check their eligibility to work even as he was ineligible to work! It's like the fox guarding the chickens inside the fence.

    There is a Board of Immigration Appeals case in 2012 that dealt with a similar situation as the OP. Basically, even if an AOS applicant was out of status but received an AP document, then he/she should be able to re-enter the US and the 3 year/10 year bar should not apply.

    Congratulations on coming out of the shadows and for finding a pathway towards finally having legal status. I can't imagine how tough your young adult life must have been.
    As to your questions, just search VJ for similar stories of others who adjusted status from expired visas.

    It took almost 2 weeks from approval at the USEM interview to getting the visa in hand? Wow, that sounds too long.

    My case status on the CEAC website still says Administrative Processing 2 days after being told at the interview that I was approved. I did notice that my case was last updated on 19 February 2014. I hope the 'update' is related to my medical data being received late by the US Embassy. When I was interviewed by the American consul (an Asian-American), he mentioned that they're still waiting for my medical, so I told him I finished my immunizations at St. Luke's clinic around 6 PM of the 17th but the clinic staff promised me that they'd transmit my medical result to the embassy on the 2nd batch on Feb 18, around 9 AM. I was interviewed on the 18th of Feb.

    I was approved for the K-1 fiancé visa at US Embassy Manila a couple of days ago! Woo-hoo!
    We booked our flights to the USA on Delta Airlines on the same day the visa was approved. MNL-NRT-SFO
    So now, we're just waiting for the visa to be issued so we can pick it up at 2Go. We are so relieved to finally have this approval and the chance to re-start our life together. My future in-laws were crying over Skype as we talked about the approval and made plans for the wedding.
    Lots of luck and good wishes and vibes to everyone still going through their fiancé visa process!

    You only need to worry if you have criminal cases filed against you that led to your conviction or if you have open, unresolved cases.
    I had to go through Quality Control at the NBI Manila main office. I had a namesake who had criminal cases filed against that person. I was made to sign an affidavit stating that I was not the same person and that
    I did not commit those crimes of which the other person was accused of.
    Right after giving the investigators that affidavit, I had my NBI clearance (no derogatory record) printed right next door to Quality Control.

    I am extremely irritated that I got caught in the migration of NBI data from their old provider to their new system. My lining up for payment, encoding and biometrics at the NBI satellite office at the mall last December 20 was useless because it does not appear in their 'new' computerized system!!!

    My question is this. This is the line for applying for NBI clearance at the main office on Taft Ave. in Manila. Is there a separate, hopefully shorter line, for those going for releasing already?
