    Salaam alaikum,

Because your family member is imprisoned on terrorism charges I would anticipate that your security checks will take longer than other individuals at the minimum.

United States State Department will have to assess if you are a threat to the national security of the United States before granting you any visa regardless of your marriage to a U.S. Citizen.

If the State Department and other intelligence agencies find with the help of Moroccan National Security that you are a high-level threat due to your relationship with this family member your visa will either politely get stuck in "Administrative Processing," for years or be outright rejected.

    Best Wishes,

nomadnoor got a reaction from Shae n Stalin in I'm so lost at this. Can someone answer a few questions
    Hi Shae n Stalin,
So once your i130 is approved by USCIS your case will move to the national visa center aka (NVC).  You should have a receipt number that you can plug in at this link to tell you where you are at with USCIS - specifically, if they sent your now approved case to the NVC - https://egov.uscis.gov/casestatus/landing.do

If they haven't - you can call USCIS and ask them when your case will be sent to the NVC AND you can also contact the national visa center for your new case number.

The national visa center has a nice FAQ located at this link - https://travel.state.gov/content/travel/en/us-visas/immigrate/national-visa-center.html

You have several steps to go through before your national visa center gets sent to the consulate in the DR for your loved ones interview.

This link should help you understand what those steps look like -http://www.visajourney.com/wiki/index.php/NVC_Process

You have no need to get a loan or any such thing - at this time the fees in total from start to finish will never cost $10k as all of this paperwork can be done by yourself and your husband.

I also just noted that the date you shared is 2007 - you need to contact USCIS and NVC at least every 6 months to a year to maintain an open case with them or you may have to start this whole process over again.

    We wish you luck.

No worries if you find that flight carrier unreliable.. see if you can get a refund and purchase a different flight.  Avoid code sharing flights that are across multiple flight carriers.  Kayak.com I think lets you select "no code shares," or something to that affect.  Royal Maroc is ok.. but often loses luggage FYI.  If there is an alternate route not requiring a transit visa - ex Munich, Germany airport route.. check that out as your back up plan.

    Salaam alaikum Younes,
    Mabrook alik on your baby!
Your K-3 should automatically convert to a CR-1 visa process.
As you haven't filled out your timeline on the Visa Journey website I can't tell you what to expect based on what stage of the process you are in.
You can once you get to the National Visa Center (NVC) attempt to expedite the visa process however not specifically for the pregnancy.
If you want more details feel free to message me.

Woman can work right up to birth.   And pregnancy is a preventable illness so there is no reason to expedite a petition.

@Kat123  I did submit both and as someone who does know what they are talking about - the K-3 was dead in the water - it never went anywhere.  I think everyone's voice and experience on this thread and forum are VALUABLE because each visa and immigration story is unique.  You can agree to disagree with me.

If one does submit a K-3 and start the CR/IR1 visa process at the same time.. and the i130 is approved first - which is what usually happens it merges into a IR/CR1 visa case.

Long story short @mery mery remember this is a saga with three different stages and it can for some take longer than others.. don't give up as its can cause a lot of stress and strain on your relationship.  You can do it!!

Only one person said that the K3 doesn't exist and maybe they should have wording it differently. But the truth is the K3 has a small approval rate. Only a few hundred gets approved.

True, anyone can still apply for a K3 but the what will most likely happen is the K3 will get denied and simply converted into a CR1/IR1. Only a small percentage of K3 visas were approved in the last few years compared to the tens of thousands of the family based visa applied for. So if you still want to go the route of the K3, have at it.

The stats are on the government website.

    Hi,
The K-1 Process is not open to you because you are married
The K-3 visa process is no longer processed by USCIS or NVC

The Consulate can deny the visa for multiple reasons including they just don't believe its a real marriage.

A few words on polygamous marriage in the US according to ICNA - Islamic Council of North America and ISNA these groups of Islamic scholars have said Muslims living in the USA should follow the laws of the land meaning not engage in polygamous marriage as its considered illegal as is bigamy.

Please do not engage in a temporary marriage of any kind also known as an "orfi" marriage because it provides none of the legal rights or protections that an Islamic marriage will for yourself or any children that result from the relationship - children from these marriages are not considered to exist in some countries ie Egypt meaning they have no citizenship or rights under the law nor are the fathers of these children legally bound to care for them in anyway.  This is a legal form of prostitution in the majority of Islamic scholars eyes because it makes sex legal between two people for a set amount of time whereas a marriage is entered into with the intention to last until death.

Be sure to have an ironclad marriage contract - anything can be laid out in it - from dowry to child custody upon divorce.

I encourage you to read and educate yourself on both Pakistani culture, language and customs as well as Islam the religion your future spouse is coming from.

Some books I recommend are -
Islamic Marriage -Initiating and Upholding - Hedaya Hartford
Your Islamic Marriage Contract - Hedaya Hartford - it even has ones you can tear out and edit for your needs

    Hi,
There is a lot of homework to be done
    1. K-3 visas are no longer processed.  You will need to either do a fiance visa or a IR 1 / CR1 visa.
    2. The paperwork you need from the US is listed here - https://ma.usembassy.gov/u-s-citizen-services/local-resources-of-u-s-citizens/marriage-information/
    3. Your fiance will need to go to the local court and get a list of the documents they require and its subject to the whims of the court officer you ask - it may or may not look like this list from my blog post -https://americanmuslimahsmusings.wordpress.com/2013/03/29/getting-married-in-morocco/
    4.  Know that the timeline for the fiance visa is shorter but more likely to be denied to due Morocco being considered a "high fraud visa country," and that your fiance will be unable to legally work in the US for an amount of time where as the IR1/CR1 visa will allow him to land and get a green card (depending on the length of the marriage) get either a conditional - 2 year green card or a unconditional 10 year green card after landing in the US.

    I wish you both luck!

    Salaam alaikum,
So here are things you need to be aware of and take into serious consideration-
    1. The countries on the ban list can change at the will of Trump and his cronies
    2. Although you are a green card holder you will probably encounter secondary screening on your return to the US and that looks like being detained, possibly handcuffed, denied food, water and access to a bathroom for hours, being asked to unlock your computer and phone for the USCIS staff to gather information on your family, friends and community and being pressured to sign a I 407 to give up your green card - while be interrogated about your political, religious and other beliefs.
    3. CAIR Director for Florida who is also a lawyer - Hassan Shibly in his facebook live video recommends Green Card holders NOT leaving the US at this time until this ban is stopped completely or it stays in place.
DHS officials have confirmed that the ban is being used to impose exile on LAWFUL PERMANENT RESIDENTS (i.e., green card holders).
My husband is also Moroccan and a green card holder like you and we are not taking any chances with returning to visit family and friends in Morocco even though we desire to do so whole heartedly.

    Hi Sunny,
So I am a convert and my husband is a born Moroccan Muslim. There is no reason islamically speaking for him not to go to the funeral/wake. If he is concerned that alcohol will be served - then just don't order or drink any drink with alcohol in it.
See the information below for more insight. InshaAllah your husband will come to a choice - tell him to pray isthakara - the prayer for seeking guidance from Allah(swt) if this is causing such a hardship for him.
    Allah knows best.
    Ally & Omar
According to Grand Mufti of Egypt Ali Gomaa, attending a non-Muslim funeral is in fact consistent with the ethics of the Quran (60:8), which commands believers not to cut themselves off from non-Muslims who are not fighting against them. In addition to expressing good manners in a way that attracts non-believers to Islam, Muslims can avoid jeopardizing their own spiritual state by making sure that they do not participate in shirk or other prohibited behavior at any non-Muslim funerals they attend, such as praying for deceased individuals who had worshipped gods other than the one true God of Islam.
Hadith on Respect: The Prophet stands up for the funeral of a Jew out of respect for his humanity Abu Amina Elias • March 30, 2011 Qais ibn Sa’d reported: A funeral passed by the Messenger of Allah, peace and blessings be upon him, and he stood up. Salaam alaikum and Hello,

The most important thing is to attach your STRONGEST evidence to your expedite request that you first send. The second is that because NVC doesn't have a webpage explaining how to do the expedite - or a format for the email - its a stumbling block for 99% of those who request an expedite - that they get denied or an email telling them to send in the correct information in the email.

The reason for an expedite must be extremely compelling specifically the following are listed on the USCIS website and also apply to the NVC:

Severe financial loss to company or individual
    Extreme emergent situation
    Humanitarian situation
Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States
Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)
Use this outline when you send in the request the next time -

Subject Line of Email: Case Number : XXXXXXXXXXXX Expedite Request, PI Supervisor

    Case Number:

    Invoice ID Number:

    Beneficiary ID Number:

    Principal Applicant:

    Date of Birth (DOB):

    Email Address:

    Phone:

    Petitioner:

    Date of Birth (DOB):

    Email address:

    Phone:

I, ( Insert Name of Person Requesting the Expedite) am formally requesting that my (insert relationship ex. husband, fiance etc) (insert full legal name) case is expedited.

State the main reason for your expedite request clearly in the first sentence here.

Then follow up with your reasoning to support your expedite request in the following paragraphs.

Attach any evidence or documentation to the email.

    Send email to : NVCexpedite@state.gov

    InshaAllah this information is helpful
