    Update: She was able to use the return ticket, that she had originally came on, that had expired, but after explaining the situation with united airlines was able to update and use the ticket. She is back home in Brazil, recently had the baby, will be able to get her old job back (as a firefighter).  I hope she is able to do DNA to prove fatherhood, so she can get some child support.

    Basically, if she has no intent on residing in the US (and it sounds like she'd rather go back to her home country), she just leaves---there's nothing she needs to do on the immigration end of things.  She can proceed with the divorce once she is safely back home through a US-based lawyer if she wishes (or no lawyer at all if she wishes).
     
    Situation with child support won't begin until she actually delivers the child and goes through legal proceedings to request child support.  If the husband goes on to claim the child isn't his just to avoid support payments, then she can prove he's the father through a court-ordered DNA test.

    My wife is Brazilian. We live here in USA, and have no problems. However, my wife has made friends with another Brazilian that is desperately in need of help. Her friend lives in a distant state. She came here 4 months ago on a tourist visa. She married the American that paid for her plane tickets. She is also here with two kids  that are also hers. What started out seeming like a good relationship turned bad. He has went as far as putting her and her kids outside in the freezing cold during an heated argument. She doesn't know English, has no phone, no money and he is more or less holding her hostage in the fact she wants to go back, has no money, no job to go back to in Brazil, can't drive here...He leaves and comes back every other day or so. She thought about going to a shelter for help, since the food is limited, but was told by the shelters lawyer that she will be illegal in a few days, since her spouse has not filed papers to acquire a green card, so would be better off staying at her spouses house.
    I know that there are some very knowledgeable people on this site, and am hoping you guys can give me some advice to pass on to her. I know, as well as she knows, she chose to marry on a tourist visa, which is illegal to do, but want to know if there is anything she can do at this point, or just continue being abused...   Thanks in advance!!

    Oh my that’s very sad, I’m sorry i can’t really help but 
    I hope she can get back to her live in Brazil and be somewhat at peace! This does not sound like a good experience!
     
    Best od luck to you and also her, very very nice of you to help and put as much effort in this as possible!!
     
    Oh and as for the child support, I think for now it’s most important to get her out of there and back to her family...Child support is going to be a really long and annoying thing but at least it’s better than fearing for my own and my kids lives I guess!

    Since she doesn't know English, possibly she wasn't clear at first, but in the mean time, the lawyer did have a police car pick her up, and she is now at the shelter.

    She was just now served a mutual restraining order and a complaint for divorce. She simply wants to survive. She DOES NOT want to be with him. She wants to go back to her country, but has no money. She had a very good job in Brazil, but once you leave the type of job she had, you can't go back. She is worried about the childs future, he is telling her that he is going to get custody of the child.  It's messed up...

    The womens shelter sent a police car and picked her up to bring her back to the shelter. The shelter has a lawyer, and is going to reply to the divorce complaint. She is planning on going back long before the baby is born, but wants to try to get what she wants settled before leaving, and also has to figure out how to get money for airline tickets.  I hope she gets some assistance from the shelter.
    She was a federal government firefighter in Brazil, which was a very hard to get job there, but gave it up to come here, and therefore, not allowed to return to it...

    Just a thought, but can he get the county clerk/court house to certify that it is in fact him? Maybe a just a note saying that there was a typo, or that it is in fact the same person, and possibly they could use their stamp on that letter? I think the main thing is to prove that it isn't someone else's paper.

    Since he got a RFE just now, THEN decides to stop the petition, I think there is something he is hiding. Already married, in trouble with the law...
    Whatever the reason, I would not give him a second chance. I would want someone that would put a fight up to be with me.
    I was in a shaky relationship before...I learned not to keep patching it up.
    As someone said, everything happens for a reason. I am very happy with my new relationship. Just pray, it works!

    Just wait to get the hard copy letter about the RFE, it will have everything listed that USCIS will want as extra evidence ok.
    no need to freak out. just means they need extra information.
    i got one back in may 2011 and when i sent it in, our petition was approved 2 weeks later.
    just send them what they want. they will give you some time to gather all extra info they want to see.

    I am recovering from a broken ankle, and am not able to easily retrieve documents. I am trying to get sufficient documents together for the I-134. I work for the Federal Government, and can print out several documents with my name on them and the numbers requested. I can print out my 3 most recent pay statements, my annual salary, and my thrift savings plan showing my investment accumulation in stocks and bonds.
    I also have online banking, and could print out my account summary of my savings/checking account.
    Would that be sufficient? If I read the directions correctly, there only needs to be two of the mentioned proofs included? Do I also need a statement from my boss at work, or would the Employee Personal page that shows my starting date etc. be sufficient?
    I really appreciate any information.
