my suggestion for you is NEVER EVER stay alone with your wife, not even for 30 seconds, she just needs to be alone with you and call the cops and say you slapped her, or try to strangle her or you or hit her on the face hard and pushed her in the chest etc, when she realizes she doesn't have enough prove to ROC she can try to be alone with you just to call the cops and make her case strong to file I-751 waiver based in domestic violence. Report her to ICE.

There arent any shortcuts. Why would all of us on this website be hanging out waiting if there was. If your relationship can't survive a separation, then marry a British girl. The oversimplified marriage based way to live in the US--
Marry anywhere (even on VWP in the US)> start process with a petition I-130> receive a CR1 spouse visa> enter US as a permant resident (greencard arrives in a few weeks)
Get engaged anywhere (even on VWP)> start process with a petition I-129F> receive a K1 fiance visa> enter US with no resident privileges> marry in the US within 90 days> apply for a greencard> wait 4-5 months or so to be approved as a permanent resident. (you can apply for a work permit (EAD) at the same time and that should be approved before the greencard, 3 months, then you can begin work and get a US drivers license before the greencard comes)
The employment visa is not that easy to get. The company bears the cost (thousands of dollars). You have to be so awesome that there isn't anyone in the US they can find to do that job. Visas for each year are limited and applications usually exceed number of visas by the first day applications are accepted for the next year. (Think: hot concert tickets go on sale. You won't get them if you don't get in line the first day). The employers wait. They plan their hiring and workforce with the visa times in mind. The big consulting firms come to mind like Deloitte, Accenture. What is your field and experience. Do you have a degree or highly specialized skills?
You need to read what is allowed on a B1 visa. Working as a contractor isn't allowed. Read this for things you can do http://travel.state.gov/pdf/BusinessVisa.pdf

AP. advance parole. A travel document that allows K visa holders to leave and return to the US before their greencard is approved. A k1 fiancé visa is one entry. If you leave, you start over. So you need a greencard or AP, which comes faster, if you have a need to travel internationally before your residency is finalized.

US immigration does not happen quickly even for those who have employment visas. Part of the reason is that the US is hyper nervous about terrorist activities and immigration fraud and believes everyone is some sort of terrorist or fraudster wanting to enter the US. The immigration process is set up to meet the US government's perceived 'needs' to ensure there are no threats to US security from potential immigrants. There are time-consuming security checks and investigations that take place and these are based upon specific documents that are required by the sponsor and the beneficiary. This all takes time and money which leads to one of the other reasons things take a long time: US immigration is user funded. It does not receive funding from the US taxpayer, thus it is often understaffed and overworked for the amount of work that is required for processing visas.
Every potential immigrant to the US requires some sort of sponsorship - either by a family member, by an employer or by 'self' as an investor in the US economy. Employment and investment based visas are given priority over family based visas, but even still there is a lot of paperwork involved that still takes a lot of time.
The immigration year 'starts' October 1st and that is when new visa numbers are made available. Employers who want to hire foreign nationals must submit a sponsorship application that proves first of all that there are no Americans available to do the work, and second to prove that the foreign national is qualified to do the work. They can pay an extra fee to expedite the paperwork and many do in order to obtain a well-qualified employee. That is the fastest route to get to the US. It is up to the employer to initiate the process. If you are the person they want, they are willing to pay the fees and to 'wait' until the visa is approved.
Family based visas for partners come in two varieties - fiancee visas and spousal visas. Both are processed through the overseas Consulate but are initiated by the US partner submitting a petition requesting permission for their foreign partner to apply for a visa. Confusing? Yes! The US partner's petition must first be approved, then the foreign partner is invited to apply for a fiance or spousal visa, provide lots of documentation and paperwork, go through security checks and have an immigration medical. They must then attend a scheduled interview at the overseas US consulate and assuming that they pass the security checks, that their relationship 'checks out' and that the US partner meets the minimum financial income level to support the foreign partner, a visa is issued.
A spousal visa will give the foreign partner a green card when the cross the border into the US and as soon as they obtain their SSN (Social Security Number) they are able to work. A fiancee must get married within 90 days then apply to change (adjust) their status from non-immigrant fiance to permanent resident. They must also apply for permission to work and to travel while waiting for their green card to be approved, and they cannot leave the US without their green card or travel permission.
Everyone who goes through US family based immigration fully understands and sympathizes with your annoyance and distress at both the time this process takes and the separation that this entails. Immigration is not a 'right' - it is a privilege granted by the US government and they are the ones who hold all the cards.
There are some good guides available at the top of every page in the header tool bar that explains the different processes involved. You will find them very useful to read over and help you decide what course of action to pursue. If your potential employer is willing to sponsor you, then that is your fastest legal route here.
Please disregard the information sent to you by that lawyer you quoted. He/she has absolutely no idea what they are talking about - or if they do - then they are unethical and only interested in getting your money at which time they will tell you the timelines have changed. Both possibilities are valid reasons for avoiding their services.

Dump that lawyer like a hot potato! He is wrong, wrong, and wrong. I'm sorry but what a dumbass to be giving out wrong immigration information like that when he is an immigration lawyer!
Also, the K3 (marriage non-immigrant visa) is not used anymore and hasn't been for some time.

Ah, so they do look at it sometimes then. Good to know. I'm just going from reading a bunch of people here that did not get any RFEs by not sending any relationship proof and only having a line or 2 about when and where they met and also USCIS instructions which only specify that you must prove that you met, and do not require proof of a relationship at the petition stage.
Keep in mind that proof that you met also includes photos of you together which could be considered as proof of relationship too.

they also need to prove that they have an ongoing relationship, merely meeting once and having no other proof is a recipe for disaster. And yes, they do have to be engaged. A k-1 visa is a petition for her to come here and marry within 90 days.

Actually no it's not. If she hasn't been diagnosed with anything, who are they to be suspicious of it? They were told she was grieving for someone. Not that she was diagnosed with depression. The OP made it clear. So if anyone of us had someone die in our lifetime they could deny us on psychological grounds? I don't think so.

Contact US Senator for your state! I've seen where they can get a new interview and have a fair interview afterwards! I agree with the unfair treatment, which is very common for sub-saharan Africa unfortunately.

Depression is none of their concern. Completely NONE of their business. They should be looking for communicable diseases or things that would indicate she would be a danger or burdento the public. Even if she is depressed, it shouldn't prevent her from getting a visa. I would complain.

As of today there are only 43 signatures and the goal is 25000 by Jan. 21 2013.

forgives us everyday and we still keep doing wrongs, this she did with a married man, so maybe she was not looking a relationship

Im very sorry for what youre going through, and Im really hesitant to offer any kind of personal advice as I dont know you or your spouse and this is a hugely personal situation. A lot of the posters here have already offered some very good points to consider.
Some of the things you have posted though do give me pause for concern. Putting your feelings aside- look at the facts of the situation.
-there was an "incident" a few years ago where she admitted that she had previously kissed another guy and now an affair- not a one night stand, a more then one occasion affair with a married man. There is currently a lack of trust in your relationship. As others have posted w/o trust your relationship will not succeed. In order to rebuild it both parties need to be committed to it. You need to decide for yourself if the relationship is worth saving and evaluate if your spouse is equally committed.
And as for your statement to Sandra of "She never lied directly to my face as far as I know. She just didn't tell me." Im sorry, I strongly disagree with that. Lying by omission is a lie. Or are you suppose to ask your spouse every day- Hi how are you, did you commit adultery today?
As for a possible ROC filing you may want to start a new thread in the ROC forum (snipping a bit of this post explaining youre a CR1 and may be filing due to adultery, have been here 6 weeks this is your evidence is it enough) posting it there would get more attention by more knowledgeable people. Im not a ROC expert but I believe if you do as Sandra suggested and have the divorce granted on grounds of adultery thats a big +. It would explain why you separated after only being in the US for such a short period of time and offset any appearance of 'gc fraud'.

Hi everyone!!
First of all, I want to congratulate all of you that got your I-130 and/ or I-129 approvals these past few days! We are all getting closer to the end!! Yay!!! But, this is not what this post is about.
I'm feeling a little unhappy today since I came across a few articles explaining how the US government is making things better and easier for illegal immigrants to become lawful permanent residents, which I don't completely agree with, since I feel that those who are doing things right should get the help. Oh well, that is just wishful thinking. Anyways, I feel like it's unfair that we have to go through this whole process without any consideration for our situations. We all miss our spouses and family in the US and would like to be with them as soon as possible, but we still decide to do things the right way, and I know it will pay off in the long run, but, wouldn't it be nice if the government did something for all of you, US citizens, trying to get your families back together doing things the right way? I know the illegal immigration issue is now a big deal in the United States and that it needs to be addressed but, come on! There should be some compromise from the authorities that shows people that following the law is the way to go but they make it seem like is the other way around.
I talked to my husband today and told him that I feel that we should send a letter to our congressmen and complain about this situation, let them know how we are also afflicted but this situation, that it also hurt us to be apart from our loved ones, not only the people that willingly decided to break the law and stay illegally in the US. We count too! And I know that most of you think that writing a letter wont change anything, I often thing that way about many things, but reality is that if we don't say anything, things won't change. I'm writing this post to ask you, US citizens, filing for your spouses, parents or children to step up and do something. Write a letter and speak up your mind, complain, tell your congressmen how you feel, what you think and what you'd like. The change starts with us. This might not change our situation, but it could mean a change for those behind us.
People, we have more power that we thinks we do, lets use it! I hope you compromise too, I'm sure that one person won't be heard, but but all of us can make a lot of noise!
Maybe I'm going a little crazy today, maybe I miss my husband too much, but maybe, just maybe, this crazy idea could work!

In my case, I went with my now husband to my interview. There were only 2 cases of k1 visa that day, a girl and mine. This woman went alone and her interview last almost 30 min, mine only 10? 3 questions to me, 2 for my now husband and that was it. we both were approved but the experiences was totally different. Also, having my then fiance with me was the best. In Venezuela, you can be all day long waiting for your turn. In my case, we arrived at 7.00 am and walked out at 1.00pm. I was very very anxious and my fiance hold my hand the whole time, made jokes to me, I even felt sleep in his shoulder. I m not saying that having your fiance at the moment of the interview, grants you the visa, but Im sure it DOES make a difference. And if is not\, at least you have the one you love right there

Hello there, here for support Our NOA1 was Feb 1st and NOA2 was Oct 2nd, 2012 by VSC. No RFEs. We did contact the congressman, but not sure if that helped at all. & Filed a service request with USCIS as well. Again, it's just a waiting game. Hang in there!
One thing we missed was that we were so focused on NOA2, that we weren't very ready to move forward once it arrived. So I'd suggest finding out about documents you need for the Packet 3. Good luck!

VERY GOOD ADVISE! My love and I have used the time from the delays to insure that all our paperwork and etc are in order as much as possible in hopes that we can move on things following our NOA2 Approval without much grief. I know it's tough waiting (we're going through the same thing with a NOA1 date of 20 July) but we can only focus on moving ahead to ensure we're ready to go to the next step.

I was not allowed in. However, I hand carried all the documents for the interview and was there for moral support (aside from the fact I got to be with my fiancee!) The CO asked my fiancee during the interview the last time she saw me and she told him that morning as we waited in line for her to go into the interview. She also took my passport inside with her to show the CO my most recent arrival stamp. While I may not have been let in, it was important for me to be there with her.
