    No. Intent alone is not a reason for AOS denial. Getting married and staying is fine too.
    There are plenty of others that did it before, on tourist visas, Canadian visitors, VWP entrants, student and work visa holders alike. They were not lucky. It is the law. It is perfectly legal to do so.

    It is not fraud to decide to marry after entering the US. If you want to marry and file for AOS, then you legally can. She would not be able to leave until she had AP or her green card though.     Unfortunately not living in the US and working in another country doesn't mean you don't have to file US taxes- you will have to back file those taxes before you can apply for AOS. Read through the i-864 instructions, it has some necessary information I think you need.

    In this situation, I would just send a letter that explains the situation. You have other, strong evidence listed here that I think will be sufficient. Don't forget to include tax transcripts that show you filed as married, and good luck!

    If you want to stay married, then file your ROC as married, get his signature in jail, and send it in. Not sure why all this discussion is needed.

    Probably worth noting that you would have to register your US/Japanese baby's birth abroad, which could take some time ... Although the baby would be able to acquire US citizenship through the US citizen parent, it's not a quick process. The baby may be denied entry to the U.S. since you would be entering with an intention to stay, unless you have a US passport for the kid, or other legal documentation proving the child is entitled to live in the U.S. too.

    Don't jump for a divorce in a hurry, maybe one day you and your wife will work it out, just go to the interview as a married couple, let them know she moved to attend school, and you stayed Becuz of work, they might have noticed that your wife social security is registered working in a different state, just explain things, don't run gettin a divorce just to file roc, people work things out all the time, you might never know

    I do think your folder is very nice, but it's also known that the USCIS officers have a set organization method and agree that it would probably be better to leave the folders out.

    Wow. Day 24 - they cashed my check. Good thing I didn't send a second package. No NOAs or emails, but hey, it arrived. So relieved. I don't think I've ever been this glad to see money disappear from my account

    No, they do not take your Green Card away. Your Green Card has your photo on it and a magnetic code and lots of information about you, and the NOA1 has none of that. The Green Card extends the validity of the Green Card and both go hand in hand and thus belong together.
    You will not be able to get an I-551 stamp in your passport, simply because you have a valid I-551: your Green Card, now extended for another year.

    Hypnos, people get I-551 stamps without a NOA1 all the time. In fact, that is the main reason that people go to get a I-551, because they did not get the NOA, and need proof of extended LPR. Furthermore, I have seen reports of people getting denied a I-551 stamp if they do have a NOA1 extension letter, because the stamp would be superfluous.
    Mac: You can call and talk to a Tier 2 person today to get your case number, as the others described. Then go to your infopass, show proof that you send your package, that it was received, that the check was cashed, and that you have a case number. Explain why you need the stamp. I don't expect you will have any problem at all, but if you do, don't take no for an answer.
    My husband did not need to get a stamp (letter eventually came after 5 weeks), but a ton of people in my month group for ROC did because they did not get the NOA1, and no one reported any problem getting a stamp without a NOA1.

    My understanding of removing conditions is proving "jointness" with documentation. A joint tax return is just another piece of evidence like a joint bank account, joint lease, etc. You don't have that joint tax return to beef up your pile of evidence of a good faith marriage. So send what you do have. A tax return is not a requirement. It is simply evidence most people have. You don't.
    I have a few questions--
    Did you earn no income since you have been here? You may need to file your own return if she did not include you. This a an IRS issue and not for the I-751. You will have issues if you file for citizenship in 3 more years because they want to know if you ever failed to pay Income Tax. So figure out if you earned enough to file.
    Are you serious that her Dad "won't let her" file a proper tax return? Is she a captive slave or a grown woman?

    You appear to being chasing adjustment of Status, judging by the forms you filed, but you are 1) calling it a visa, and 2) posting in the spousal visa forum.
    If you find the Adjustment of Status from work, student, and tourist visa forum, you will find a bunch of people doing the same thing as you, plus a lot of information on the process.
    You have EAD/AP approved, so that is good. Now you wait for an interview letter, and at the interview, they will decide on the I-130 and I-485.

    Adjustment of Status is not a visa. Visas are used to enter the US. You are already in the US, presumably on some other visa. What you are doing now is adjusting your status from whatever visa you had to that of Legal Permanent Resident. Legal Permanent Resident, or Greencard holder, is not a visa. Good luck.

    Why, oh why, after my repeated attempts to explain that you can get a I-551 stamp now, or weeks ago, to get your license back, have you not done it?
    You cannot call Vermont.
    You can get a I-551 stamp. That is your only choice, or wait.

    The I-130 in and of itself does nothing for getting your spouse legal in the US. All the I-130 does is prove you have a relationship based upon which he can apply for an immigrant visa (from another country). You need to file the I-485 to obtain a green card for him without him having to leave the US. I suggest you boot the attorney as they don't seem to know what they are doing.
    Read the guides at the top for concurrent filing http://www.visajourney.com/content/i130guide2. Since you have already filed the I-130 you can attach the NOA-1 (the receipt showing the I-130 was received) and continue with the process for the I-485. There is absolutely no reason to wait for approval of the I-130 prior to filing the I-485.
