It depends on how busy your local office is, they needs to find an available appointment for you. It can take up to a year. Be patient and good luck.

No chance of you having any joint accounts of any kind? Car insurance/title? Memberships like Costco/zoo/YMCA/etc? You might look into having a will written up as well, those are simple yet pretty solid proof of relationships. They really like to see joint financial ties, so without them I would think the chance of an RFE and/or interview is high.

If she does have your passport (and hasn't done something else with it), I would have the police get it returned to you or have your divorce attorney file a formal request. There could be an identity theft issue depending on the state you live in.
If you had anything such as joint utility bills you can contact the company directly and have those sent to you. Same with car insurance etc. If you had something such as a lease, contact the property management company directly for a copy, or if you owned your residence with your spouse you should be entitled to request a copy of the deed from your city or county.
Good luck, hope your lawyer is a good one.

I agree with Nancy, explain in a cover letter and expect an interview. In addition, I would send the full tax transcripts from the years you filed together. You can print those off at the irs.gov. Affidavits from people who aren't related to you might help as well, it's worth a shot anyway.

Please clarify did you file i-751 jointly or with divorce waiver? You can't send what you don't have. Your best bet is to explain it on a headletter and expect an interview.

For removing conditions, the case number you want is on the biometrics letter, not the one on your NOA1. Try the one on there when you receive it.

That's what I did too. To be honest, I was pretty lazy and didn't save anything over the two years. We just did taxes, printed bank statements from online, and did a picture collage with a descriptions of places under each. Also car titles, DL with the address on it and stuff like that, but nothing that was compiled over the period.
However, it would probably have saved me a lot of time if I had done a "drop box." Good luck amigo

This is a common misperception, and it is not true.
While the AOS is pending, one is authorized to stay in the US until the matter of the adjustment settled, even past the expiry date of the F-1. But that has nothing to do with the F-1. Until a final decision is made on the AOS (i.e. the green card is either granted or denied), the F-1 is still valid and continuing.

No you're still wrong. People travel to the States all the time with an immigrant visa processing.
It is solely at the discretion of the CBP officer at the POE as to wether they believe that the person will return home at the end of the trip to determine if they can enter or not.
The CBP officer obviously didn't believe your wife would leave at the end of her trip so she was denied. That doesn't happen to everyone.

Can you clarify when you say "detained"? Do you mean you had to wait at the border while CBP decided to refuse you entry? You say "years ago", but unless something has changed since then, a visa isn't a REQUIREMENT (for Canadians), let alone a criminal act, to enter the US to visit a fiance(e). I certainly crossed the border several times while the K-1 process was underway, and I'm sure many others have as well.
If they simply didn't believe you had enough proof of ties to Canada at that time and thought perhaps you were going to stay permanently, then they would have turned you away. However, I don't think that you sitting in a room while they worked that out would count as being legally detained. Obviously if there's more to it than that, then that would need to be taken into account.

You started by saying that it was both your intent that she come here as a Tourist stay and adjust, so not sure many people would suggest you lie.
Presumably your wife just said she was visiting when asked about the purpose of her visit?
Usually this question does not arise at an adjustment interview.
The K3 is effectively dead, the alternate option would be CR1.
She is legally married in the US, what the Philippines think is not relevant for adjustment purposes.

    You are being awfully rude.
OP: When I filed (about 2 years ago or so) the instructions specified that they wanted copies of ALL passport pages for the US citizen. Bio page and visa pages for the immigrant sufficed. However it doesn't specify that anymore for the US citizen, so I would assume bio page + stamped pages are fine.

Nancy didn't tell you to do anything. All you have to do is to read and follow forms' instructions, not looking into some manuals, which are not for applicants.

Please don't just google and spread these above information to confuse others. That policy manual is for USCIS employees, it is not for applicants to follow. Applicants is to follow forms instruction. They even returned whole package with missing I-693, not just RFE for it. I-485 is main form, and it clearly states I-693 is initial evidence.
By the way, the text above should be understood IF applicants didn't send in I-693 with I-485, DON'T send IT seperately because USCIS will not know it is for what. Instead, Applicants should WAIT for RFE from USCIS to submit it.

seth2013 reacted to SkeeWee in My Naturalization Interview 2014 (Nervous for no reason) :-)
So, to begin I was very excited to start the naturalization process. So excited that I had been doing the self-study exams on the USCIS website for about 2 years before I even sent in my application.
I mailed in my completed N400 at the end of April and everything went super fast after that. I had my biometrics done a month after and my case sent for scheduling 3 weeks after my biometrics. This is where the process seemed to stall a bit. My interview wasn't scheduled until September. No biggie I thought, I've waited this long, what's another month or two.
Now, at this point it's just a waiting game, before I know it, September 03 will be here. Now, waiting can be bliss or torture for some. For me, it ending up being the latter. The most gut-wrenching thing happened to me 3 weeks before my interview... I got a SPEEDING TICKET!!! I've never, ever gotten a speeding ticket in my 10 plus years of driving. It was all I could think about in those weeks leading up to the interview. I've ruined it!!! How could I have been so stupid!!!! I contacted a traffic attorney to handle the matter for me as it's my first offense and I don't want to just pay the ticket and be done with it. Unfortunately, the matter won't be resolved until after my interview date. I was devastated!! I beat myself up every chance I got. Finally, I had to let it all go, leave it up to God. I knew he had safely brought me through this whole process and this ticket would not stop what was to be.
The day before the interview, my nerves REALLY started to kick in. I didn't sleep at all. I was up early and ready to go the next morning. My appointment was at 9:30am and I would NOT be late. I entered the USCIS building and went through the security check-point at around 9:10am. I had left my purse and phone in my car and only took my documents in with me. Now, I may have gone a bit overboard with all the documents I brought but better to be over prepared I always say. I'm told to head to the open office where the lady at the front checked my interview notice and tells me to have a seat and wait for my name to be called. I wait for what felt like about 25 minutes before an AO comes out and called my name. This is it I told myself, stop with the stomach gurgles and dry mouth already!!!
We walk to his office which seemed to be all the way in the back of the building. I longer walk I have never taken (at least it felt that way) I enter his office and he shows me where to sit but before I do he tells me to take out my passport and green card. I lay both out on his desk and ask if he needs my driver license as well (I had received the yellow letter telling me to bring it along with all travel documents). He says yes. I sit and he walks around to his desk and asks me to stand and raise my right hand. I swear to tell the truth and then the interview begins. He asks me how I pronounce my name and I state it for him, he then asks me about my name change. This had already been done by a court so I only needed to show him the court document. He starts to go through my application with a red pen, circling and checking things off. After doing this for a few minutes, he asks me what's my current address, where I work (we had a laugh here, the first and only during the interview). He keeps going thru my application for a few more minutes. He stops and moves on to the civics, reading and writing portion of the interview. I was asked:
    1. Who is the Governor of Florida?
    2. Where is the Statue of Liberty?
    3. What is one promise you make when you become a U.S. citizen?
    4. What movement tried to end racial discrimination?
    5. Name two U.S. national holidays?
    6. Who was the first President?
I was asked to read, "Who lives in the White House? and write The President lives in the White House.
I guessed he heard my sigh of relief once I finished writing the sentence because he said "We're not done yet". He goes back to the application and starts to ask the rest of the questions, have you ever been a prostitute, have you every been an habitual drunkard, etc. Then comes the question, I'd been dreading. "Have you ever been arrested or detained by any officer in the U.S?" Now, I did sooooo much research on this and other websites about traffic violations and naturalization interviews. I had made up my mind that I would definitely disclose it at the interview even if it was asked or not. He never asked me if I was cited, just had I ever been arrested or detained. I said no, he then asks "Have you ever been arrested or detained by any officer in any other country" I said no. Before he could move on to the next question, I said, "I was just issued a speeding ticket" He dismisses it but then halts his circling and checking and asks, "Do you have it now?" I said "Yes, but I have paid a traffic attorney to handle the matter for me" He waves his hand and says "it's just a speeding ticket", and continues to ask the rest of the questions on the application.
After all the questions have been answered, he has me sign the bottom of my N400. He then prints out a form with all my biographical information on it and tells me that this is the information that will appear on my naturalization certificate. I had to verify that it was all correct and then sign. He then pulled out the 2 pictures I had sent in with my application and had me sign along the left hand side of each (face up). After that's all done and he placed all the signed forms and pictures in my file, he tell me then he was recommending my application for approval!!! He prints the form telling me that I've passed the civics and English test and the Congratulations box is checked off. He tells me that everything is done by mail. My file will be reviewed and if anything is needed I will receive a RFE by mail. He said if everything is good with my file, I will receive an Oath Ceremony notice in the mail in 30-120 days. He asks if I have any questions for him to which I say yes. I ask, "Will the ceremony take place here in this building?" He said most likely it will, but if not my letter will let me know where to go. He walks me back to the waiting area and it's all I can do to stop myself from bursting into tears of joy. I am beyond grateful and blessed. The whole interview lasted no longer than 20 minutes
Thanks to this site for all the useful information I was able to find while going thru this process. Good luck to every one who will be going through this process in the future.
Oh, today around 2:00pm, I received an update on my case. I was scheduled for the Oath Ceremony!! Just a day after my interview. I'm so overjoyed!!! Thank the Lord for all His blessings.

While I can appreciate your frustration with the wait, doing what you suggest is immigration fraud. If your wife attempts to enter the US and fails or does not correctly declare her true intent, the outcome is likely to be that instead of waiting the time it takes for the paperwork to be processed, she will be faced with a permanent ban for mis-representation. Her immigration intent is already in the system. If she does declare her intent, then she will be denied entry until she has the correct documents. That in itself should tell you that this is not a viable option.
If you really love your wife and she is important to you, why would you even begin to consider jeopardizing your future life together in such a way? Good things are worth waiting for, even if it is the frustrating, annoying, bureaucratic dinosaur of the proper US immigration process.

Sorry but you are the wrong one, the article you quoted mean they don't accept I-693s which are older than a year. They don't say anything about not submitting I-693 with I-485, please read I-485 instruction again, I-693 is one of most essential ones. No one read your post because it is not accurate.

read the text you pasted in its totality.
if you waive joint filing, you are filing alone. if you are filing alone, it has to be because of one of the following reasons:
    1. you are divorced but entered marriage in good faith
    2. usc spouse deceased
    3. usc spouse battered you
    4. your dependents were battered by the usc or you are a battered dependent
    5. your removal would cause extreme hardship
in case 5 which you are attempting, they dont care about your (immigrants) hardship. they only care if your removal causes hardship to an american citizen. hypothetically if you had a disabled usc child who needed you for care or something.
you are trying to complicate something very simple: file for roc between 21-24 months of your gc grant date, have your usc spouse sign it and be done with it.

Unfortunately not living in the US and working in another country doesn't mean you don't have to file US taxes- you will have to back file those taxes before you can apply for AOS. Read through the i-864 instructions, it has some necessary information I think you need.
