    You don't need to take evidence of it, but apparently you do need to disclose it, I would. At your interview the officer will ask about it, you explain it, they'll probably change it to no and have you sign the form. you won't be denied because of it.
    Some people don't mark the form and the officer brings it up and then dismisses it. Some people don't mark the form and THEY bring it up, the officer doesn't care.
    Some mark the form, show the docs, officer changes it. Basically a speeding ticket/traffic infringement isn't a big deal as long as it's less than $500 fine and didn't involve alcohol or drugs.

    Bad idea.
    You will simply be RFE'd for the missing I-864 almost as soon as you file, which will halt all processing on your case until you submit the missing affidavit of support.
    Any overstay (be it two days or twenty years) is not penalised for immediate relatives of a US citizen, so rushing to file to try and beat the deadline is not really necessary.

    I came from England - a country that has a common language with America and many similar customs and culture and it took me a YEAR before I felt comfortable here. Coming from a sheltered world to a totally different culture with different custom and practice I can totally understand your wife being overwhelmed and intimidated. You don't mention her age, so it's hard to know if she was unable to cope and gave up trying.
    Did you spend any time trying to find her suitable friends to welcome her into your home town, find stores where she could find familiar foods from home, find her a library with books/newspapers/magazines in Hindi or Punjabi or whichever regional dialect she reads and writes? Did you attempt to find other Indian families in the area to see if they could help her adjust?
    Something tells me that you were so focused on getting your wife here that you overlooked the fact that, for you, nothing changed but gaining another person in your household. For your wife, her whole world changed. The people she loves are thousands of miles away, the friends she has grown up with are no longer in her daily life and America is seriously different from India and all that is before she copes with a language change and cultural differences. It's not simple. Most of us do it with a degree of willingness because we are already in love with the person we are marrying, but I can appreciate that your wife didn't start with that advantage.
    Back track, don't go blaming her family for sending you someone you obviously feel has failed in her part of the marriage agreement. Contact her and her family and ask what her expectations were, what she wanted from the marriage, what she needs to be happy enough to want a sexual relationship with you and work from there. Be honest in what you need and want from the marriage and come to an agreement as to whether you made a mistake. Stop seeking to blame her or her family for the lack of communication between you. Such things happen and are often connected to both sides of an argument.
    Marriage is a two-sided relationship. Both partners have to be happy. If not .... you simply join the 50% of divorcees and move on to find someone who is better suited to you in what they want and need from life.

    I-751 is a required step. But it is unclear in your post where you are in the process. Please elucidate what you have done in immigration so far.
    It sounds to me like you recently had an interview for a GC (for AOS from K-1) and were given a RFE there, for more photos and proof, is that true?

    StephAnn, most everything you wrote is incorrect. This is not the Philippines. We do not have any document here that says you are "legally able to marry." Legal status is not a requirement to marry here, and nether is a SSN.
    I will repeat, I am sure the OP can marry with just a passport. A SSN is not required, by federal law. An ITIN is not required. This case is not complicated actually, so no need to go to immigrate2us.net. The only issue is a simple overstay which if she stays here is not an issue at all, and the financial issue. She needs a co-sponsor or her husband needs a job, period. They can get married this week. People seem to think that the internet has all the answers, but googling this and this will be a waste of time. They need to physically go down to the courthouse and talk to the clerk, in person, and get married, in person. Most local governments don't have the time or interest in writing up every situation on their website.

    Yep, the wife used some sort of scam/fake documents company. If the SSN is a USC's, she is in for trouble.
    Personally, I would have thought twice about marrying someone who would do this, but oh well...
