    Due to the fact that you have a spousal visa you are fine. Your visa serves as a green card for a year once you cross. They do this so that you can cross back and forth if need be before you get your actual green card. So yes you will be fine.

    The questions I would like to ask are:
    1. Besides the point of the first relationship not working, even if it did, why would you get illegal employment? Why not consult with some friends and family, get a ticket back to NZ back then?
    2.When the first relationship did not work out why did you not go home?
    These are just questions as things would be a whole lot simpler if you left the country and did not gain illegal employment. I know you made the claim that you having illegal employment is almost the same as a person filing VAWA, but the fact is that they will ask you about employment on certain forms and they will find out. I'm sorry, but this is the truth. Honesty is the key when filing out immigration paperwork.

    What will happen is at your POE the CBP will stamp your passport and the stamp will be your temp I-551 until you get your Green Card (GC) in the mail.

    As I am sure others would tell you, it won't be a problem. Once your wife enters the USA her immigrant visa serves as a temporary I-551 for one year after entry so that she can go back and forth if she wants. I do not think that having a return ticket will be a problem at all. What I would advise is to pay the immigrant fee ($165) before she comes down so that there is no delay in her receiving her physical green card after entering the USA.

    OP you have to get married within 90 days of entry. People will suggest that you do the AOS within the I-94 period, but if you have to say a month or two that is fine. Applying within the 90 days protects your status and you do not accrue days of unauthorized stay. But as said in this post you can wait if you have to.

    The CD, I believe, will not be accepted by USCIS. What goes with the AOS is the DS-3025 that the Doctor in Knightsbridge did for if it was marked as complete. What I believe you are going to have to do is take either the DS-3025 with your Walgreens receipt of MMR shot or take a record of all of you shots to a Civil Surgeon and get them transcribed to a I-693. Getting the shots transcribed should only cost around $50.     No need to worry, if you do not get an interview by the time your petition expires the CO (Consular Officer) at the Consulate at your interview will automatically extend the validity of your petition.

    Yea God!!! So you have the visa in the passport and the envelope that says "Do Not Open." What happens next is you enter the USA through a POE (Port Of Entry) such as the airport or a land border crossing. What happens is when you get to the POE is you will go to secondary, the CBP officer will take your envelope and verify some of the information on your petition such as the address you will be living at. Then after you have cleared the POE you and Kyle will get married within 90 days of your entry. After getting married you will wait for your marriage certificate and then file forms I-485 AOS (Adjustment Of Status), I-131 AP(Advanced Parole) so that you can travel and I-765 EAD(Employment Authorization Document) so that you can work while the AOS is in process. The AP/EAD will take from 60-90 days to get approved and then it will take anywhere from 4mths-1yr for you AOS to be approved. After AOS is approved you will receive your 2 yr GC(Green Card). With the SSN you have the choice of getting it before or after you get married. I would suggest getting it before and just changing your name on it once you get married.

    I do understand where you are coming, but the Bible does say concerning not just taxes and giving to gov't what is their's, but laws that we are to respect the laws of the land. I am trying to undermine your faith in God as I am a Christian as well, but God does want us to obey the laws of the land.

    It is $1070 and is is VERY important that people know this beforehand. While there is no deadline to AOS, until you do so the immigrant will not be able to work, not be able to drive, not be able to travel abroad, and many other things. Filing ASAP is the best plan.
    All K-1 people, please know that AOS is $1070 and PLAN accordingly!

    The 2 passport photos is of the beneficiary. They want you to send them to them and then what I did was took 2 to the interview in case they asked for new ones.

    Hi there,
    I would say that yes you can use the passport but take the marriage certificate to prove the name change. The people should understand that this is a process and that you cannot just change everything overnight when you get married.

    Now that they are doing electronic I-94 you go here to retrieve your I-94:https://i94.cbp.dhs.gov/I94/request.html;jsessionid=rKc1SQTBnGQcFvPRyTKsBsHVLpl624N1lYTznDnvJQMJRP4CSmkn!271044983 . The I-94 should be there immediately although some have reported that it takes a bit of time.
    The 2 weeks rule for the SSN still stands as your info needs to be inputed to the SAVE (System of Alien Verification for Entitlements) system.

    He is now here illegally, therefore he is liable to deportation and if he does not leave on his own there may be a ban. Since you did not go through and get married he now has no reason to be here and needs to go back to his home country. His opportunities here now are void because in order for him to work and travel legally he needs to have the EAD/AP card to do that and since you did not get married he is not eligible for this. Once he leaves he will not be able to come back for a period of time, if not for life. Not to mention that I believe it is fraud to let him go on and get any sort of benefits if you are no longer together. If I am wrong in any of my statements someone please correct me. As for the financial once it is found out that you did not marry/ you withdraw the application you will no longer be financially liable for him.

    So from what you said I see no misrepresentation, so I do not see why this might hold everything up. You may get asked about your previous denial at your interview in Montreal, but I see no reason that your P4 is being held up. It says on the Canada Immigration guide to keep calling DOS until your P4 has been sent out. I would also keep checking your email to see if you have received your P4 by email.

    This is proof that the Consulate has recieved the package. I received P4 3 days after sending my P3. Do not know what to suggest here. I would keep calling DOS to see if P3 has been logged. If I am wrong someone else please post so.

    Here is the DOS phone number:1-202-485-7600 To get to a visa specialist press 1 then 0.
    Once P3 has been sent, for the sake of your own sanity give it at least a week before you start calling about it. Again, Montreal is notoriously slow processing documents so there’s no use fretting if you know it’s physically there and it still hasn’t been logged. At this stage, you’re back to calling DOS. They’re open M-F from 8:30am until 5, except for Wednesday’s when they’re closed from 11:30-12:30.
    -You’ll want to ask them if P3 has been logged. If it hasn’t, you’ll have to keep calling.
    -Once they tell you P3 has been logged, you’ll ask if Packet 4 has been sent out yet? If it has, you will be eligible to schedule your interview.
    Note: There have been a LOT of cases of people getting incorrect information from DOS at this stage. Every consulate is different, so even if a representative tells you that your interview will be scheduled for you, this is not the case for K1s right now. As soon as P4 has been sent, you are about to schedule.

    -On your passport there is a page that has your photo with your info on it, where you were born, where passport was issued, issue and expiration date, that is the biographic page.
    -Yes they would like a letter of intent to know that you still intend to get married and this time they want one from the petitioner within 30 days of the interview. Remember the letter of intent that you sent with the original I-129F? You can use that one and just change the date and addresses. Instead of the Lockbox it would be whatever Consulate you are interviewing at.
