    Hey Dido, show a few statements from the joint account you opened together. Send a copy of the paperwork that shows you being added to the account, and show statements from the time you were added, even if you name is not on them. You can use a statement from every 2-4 months instead of making copies of them all. You can provide a statement along with the paperwork that shows you were added explaining that your name did not always appear on the statements themselves and you went through a great effort to rectify that.
    it should be fine, since you will have other evidence too. I kind of think having his parents on there with you could even be helpful for proving your marriage is valid. Your whole family is accepting of you and willing to sign to put you on their bank account.

    The decision on an AOS case takes less than a year. Very rarely, it takes a little more than a year and people have to renew their EAD/AP card.
    As a K-1 holder, you may or may not have an AOS interview.
    You are in a period of authorized stay for 90 days once your enter with the K-1. Filing for AOS puts you in another period of authorized stay until a decision is made in the case. If the 90 days are passed and AOS is not filed (generally because of financial issue), you have technically no status which is not ideal (can't work, ...). That is why it is best to file before those 90 days are up, which is your plan.
    Because a decision on your AOS case will most likely take less than a year, you will get a 2-year conditional green card (granted when the marriage is less than 2 years at the time of the decision). You will have to file for removal of conditions (ROC) no more than 90 days before the expiration of your GC. You will then receive a 10-year GC.
    Some people get a 10-year GC directly because:
    - they either filed very late (and were out of status for a long time) and so, their marriage was more than 2 years old at the time of the decision on their case, or
    - they got it after an IR-1 visa (spousal visa) because they were married for more than 2 years when they entered the US with their visa.

    If you read the instructions, as I suggested before, it tells you that as an AP applicant you do not fill in the whole form. Please read the instructions.

    It was not rude to simply post the correct information. I did not even only post the link to where the correct information can be found. I even posted the quote directly from the USCIS website. For you and others reading about a topic such as this, the links to the current and correct information is a lot more helpful than simply posting a dollar amount and nothing else. Trusting the information that comes directly from the USCIS and DoS is better than trusting hearsay.

    Yes, your husband's A# (if he's naturalized) is in the certificate of citizenship starting with A followed by 8 or 9 numbers. It's indeed labeled as USCIS registration number. This could also be found on his GC if he still have it.

    Yea, because they will give you forms to fill out, which basically gives them the information to fill out the actual forms.
    We had a lawyer initially because my husband felt more comfortable going that way. It took them about 3 months before they finally sent it in. It isn't a priority for them to send out your forms, and they will focus on higher paid clients first. They made a ton of mistakes, so I basically had to redo my forms on my own. They also gave us bad information (not relevant to you, but they stated that I will go to my interview in Toronto, that I don't need a medical because I was from Canada and that once I cross into the USA, that I automatically get my green card...ALL WRONG!). I wish I found this site sooner, because we would have been approved much faster and we wouldn't have wasted $3000 on the lawyer.
    Even if the lawyer doesn't make mistakes, and knows what they are doing, you still are basically paying them to copy your information into the forms. It is super easy to do on your own.

    Sure, but it will cost you $380 and you probably will not get to use it anyway, since it takes as long to receive as the I-94 is valid for. Just file for AOS as soon as possible and the fees for the EAD and AP are waived then. The EAD you receive that way through category (c )(9 ) will be valid or a year, which is usually enough time while waiting for the green card approval. Sometimes people have to wait longer for their green card approval, but the EAD can be renewed in those cases and will still be free to do so.

    I know it is a waste of money, and I have advised people of such many times. I was asking why you stated it would 'be denied, on the lack of grounds to support your request'. That made it sound as if they were not eligible to file for it before getting married, which is not the case. They are eligible, could have it approved, and it would still be a waste of money because there would not be enough time left on it to actually be employed with it.

    You should put "Seattle" for your port of entry. and the estimated date of departure should be any realistic date in the future. This won't have any bearing.
    As others already mentioned, registering online is highly advisable as your information will already be in their system when you get there, regardless if you fill it up on a holiday or a weekend. You just have to print this out and show to the guard as you enter, together with the rest of your documents, as online registered applicants have a different line, and faster too.

    Holy #######! After making some phone calls, little research, etc etc (I've become very resourceful and quick even deployed)...I told my wife not to give up! Go back with a print out from the USCIS website saying I don't have to be at the interview and go fight! Be cool, but give the facts and appeal to them...explain how it's incorrect that I have to be there, etc etc. She fought...got the interview and was APPROVED on the spot! How crazy is this? Thanks for reading and the info! Fortunately, this is a non issue

    OP, the previous responses are accurate and appropriate. One of VJ's premier members frequently has said, "Your success throughout the immigration process depends on your ability to read carefully, interpret instructions literally, and respond completely and accurately." As others have said, and as embarrassing as it might be to realize this now, the advice in boldface was not followed. Marriage to the beneficiary is a prerequisite for applying for AOS.
    I would swallow hard, reconstruct the AOS package with the valid marriage certificate, and submit it all over again. What you choose to do in regard to the previous payment is your choice, but I personally would not tie up senatorial or congressional staff time with a complaint like this when thousands of other people have unquestionably legitimate issues to confront.

    Wow, people here are trying to help you understand what went wrong and you're speaking to everyone as though they are a bunch of knuckleheads. No one is being harsh, they are giving you facts.
    The fact of the matter is, it was YOUR mistake, not theirs.Just because they had the cover letter, doesn't mean they read it. NOA1 simply means they received your petition, it doesn't mean they had actually started to process it, doesn't mean they read a single thing. It merely means they opened the contents, made sure the payment was there and put in line to adjudicate. You cannot adjust status ahead of time. Let's say they went ahead and approved your petition, and you didn't marry? Then what? Nothing about your case is a mistake on their part, NOTHING. They are under no obligation whatsoever to waive the fee for the second petition, hopefully for your sake they do, but don't bet the farm. Good luck.

    Usually when taking in documents, they check the basics such as the correct fee being submitted, signatures all in place etc. They don't actually look through your file in any detail until it's your turn to be adjudicated, many months later. That is when they caught the fact you'd filed for AOS before marrying.
    Well, no. Just because you tell them to do something doesn't mean they're obligated to. You need to follow the rules like everyone else and file for AOS AFTER marriage, not before.

    You should definitely help her meet some people in your area that are also from Columbia. It helps a lot! It's not easy to move and quit family and friends, but making and having new friends, that especially come from the same home country is a great thing. I, and by consequent we (my husband and I), met some other french-american couples in our city and it's always great hanging out with all of them.
    Coming back to France is always a big "bowl of fresh air" (don't know if that's also an english expression?) and I miss it for sure. There are some good aspects living there, like there are some bad ones. But it's the same here in the US. In the end, it's about realizing all that and finding a balance.
    It's not easy to adjust for sure, so make sure you understand her and help her feeling better. She should also be aware of what's coming... so she knows what to expect.
    If you want a positive review, I like living here and don't regret taking the big decision of moving to the US. It's easy to complain (especially since I'm french ) about everything that is different here and not "as good" as in France but there's also lots of new things to experience here (talking about food especially ). Plus there's still a possibility that one day we'll move back to my home country for a few years...

    Hi! Since I'm from a country close to your fiancee's, I figured I'd share my experience with you. I moved to the US in November last year from a small city to a big, different one. I used to work long hours and live in a big house with my family and pets... so coming here to a small, empty apartment, in an area that was not exactly safe to go to the store without pepper spray and on top of it I was a minority was hard for me. My husband worked night shift, falling asleep by myself was very hard... needless to say, I cried a lot for a couple of months and got very depressed, my hair was falling, I put on some weight, I felt like I was happy to be with him, but I wasn't whole because my family wasn't here. He understood this was a huge change for me and we talked about it many times, he made his best to support my hobbies so I wouldn't get bored and started thinking, making myself miserable. We were blessed with a shift change for him and now we get to sleep together at night and most of the time he has the weekends off so we can go out and do things together, also things are looking up and we're moving to a better area. Bottom line, she'll be sad for a while, I think it's natural... she might even tell you she wants to go back home, I know I did, specially because at "that time of the month" we girls get extra emotional. But technology is available and there are so many apps now to call home, text, etc, that will make her know her family is still there and they're doing ok. The most important thing is to love and understand each other. About positives I've found coming here, DUH! I'm married to the man I love and that's the most positive thing I can think of. Also all the new places I've got to go with my husband... The weather is mostly nice, that helps too

    30-90 days from the date on your hard copy NOA1, providing you don't have any RFEs to delay the process. From what I've seen, it generally takes about 7-10 days to get the EAD once it goes to document in production, to being mailed out, to finally receiving the card in the mail.
