    IV Bill now shows paid!!! Will have to wait until next week to send IV packet though . Waiting on one document!!! So NVC gets a break from me for a few days!!!

    This is in regards to the same person stating they don't need their native documents to be translated into English. Seems there's a counter-reply she/he has to a lot of responses from members trying to help. I agree with you MCMLXXXII - "No one is going to try and convince you here on this forum, in the end you can do whatever you feel is right."
    I just feel it's wrong for people to ask for advice in these forums and then argue with members about what's wrong and what's right.

    You're mother in law is filing your wife's 2011 taxes?
    I know from experience here in the US, you need to file your taxes in the name that your social security card is under. If you don't you get hate mail from the IRS saying your name does not match their records and the return will be delayed.
    I would highly suggest to file in the name that matches her SIN.

    so uhhh , we kinda....umm...yeah...
    WE FINALLY GOT A FREAKING HOUSE!!!!!
    We close on April 23, but were given early possession gratuit, since the owners are in California and we are in Illinois. OMFG I cannot believe it...I dont know whether to scream or cry or do both today. And the kicker? Not only was this another short sale (no i did not learn my lesson from last time ) BUT Citi did not give anyone any problems and DID NOT EVEN COUNTER OUR OFFER. Our offer was 15k less than list price, and like 40% of what was owed on the house.
    We had seen the house on November 30th, put the official offer in on Dec 4th, and got the Approval today (Letter is actually dated yesterday).
    I'm completely surprised, because when i was looking at other houses and the local forclosure Sheriff's sales listings just YESTERDAY, I saw this house listed. And of course I completely FREAKED and called my lawyer the realtor etc. thinking " OMG they are goign to do it again to me. they are going to auction this house off and not sell it to me, they are going to screw me again". Then when i saw that a mortgage for the house was discharged i bascially started panicking this morning.
    So when i got the approval letter today, it was like someone took a cast iron frypan and whacked me in the face!.

    It was completly reno'd in 2006, with new windows, new kitchen, new appliances, new roof, new front and back doors, new laminate floors etc. New furnace, new A/C, Its like a brand new freakign house. And has a gorgeous vaulted ceiling in the living room. We are on cloud freaking 9 right now. I have a perma grin on my face.
    Saturday we are doing the inspection and getting the keys.

    Hi everyone
    Great thread here, and lots of useful information. Thanks to everyone and especially Saylin for compiling everything.
    I received my NOA2 on 3/16 and NVC received it on 3/19. Called 10 minutes ago and spoke with Amanda from NVC. She told me they have not yet typed it in but it is there.
    She said it takes between 10-20 business days and for an I-130 I am still in normal processing time. She told me to try and calling back next week (of course I will not wait that long)..but she was friendly. Hopefully I will have good news soon.

    I just phoned them yesterday and booked an appointment for next Monday. They did have availability for this week too though, so no need to book it way in advance. But since your case is complete it might be better to do it sooner rather than later. Then you only need to think about the interview, at least that's how I'm looking at it . I would have done it this week but it was just easier for me to get time off work and arrange transport for next week.
    Maybe saying the wait for interview is worse than the wait for the petition approval wasn't quite right. I think it was more a case of expecting a long wait for that and now that we're soooo close to the end I can't wait to find out the interview date, my patience has ran out lol.

    Guilty. But I didn't do it that dramatically... But I did start my own thread.. it had been forever, I was excited!
    The people that mentioned their 'encouragement' of "oh we only had to wait (30 days, 40 days 4 months, 5 months) I know yours is taking so long..." in every thread about waiting that annoyed me. 'goway fool, you're not even a June filer!'
    The first person I told, after hubby of course, was Shell!!

    I take it your husband was already in the US before you two were married. Did he come as a visitor and then marry you, or was he here for a few years/months before hand? Either way..
    Your mother and brother are trying to intimidate you. They can call ICE all they want, call the sheriff or the state police, no one is going to arrest and detain him. IF they continue to harass you or your husband, I suggest having a protective order served on one or the both of them for harassment.
    Think of it this way; the night of the incident, as your husband spoke to the police, and they knew he was in the US with out a green card, by mom and bro's logic, hubby would have been arrested that night, there on the spot. He wasn't. There is your answer.
    Even if the DA prosecutes either your father (brother still insisting on the assault) or your brother (false police report), it has nothing to do with your husband, other than he is a witness.
    Your husband is eligible to adjust his status, this isn't going to effect his eligibility for a green card. Once you send in the AOS papers and when AOS is approved, his overstay will be forgiven. (Tell your brother to 'stick that in his pipe and smoke it)
    The DA has better things to do than to detain a Canadian with no criminal history.
    oh and if you've already mailed off the AOS papers and your mother signed the I-864.. sorry for her. It's a legal binding document. It's going to be a legal nightmare for her to get out of it.

    USCIS information line is notoriously wrong. The DOS link here: Can The Medical be done in the US?
    We tried to get my husband his medical at a civil surgeon in Johnson City, TN during his visit at Christmas. When we called to make the appointment we were told that medicals done in the US are for Adjustment of Status cases only and not for CR-1 visas originating in another country. My husband would have to get his medical in Canada, she then gave me a list of US civil surgeons in Canada.

    It is shame when parents do not have the best interests of their children at heart,they are missing a lot and so are their children. Unfortunately you cannot associate with people who would do YOUR family harm and that is what YOU have now. That means find another sponsor, just in case.
    I would not worry about deportation so much as finding a way to live life on your own, you cannot do it this way. Your husband HAS TO BE number 1, he is your future, he is the person that is supposed to be with you until you die and the father of your children, the head of your family.
    I suggest you eliminate ALL contact with these people. Begin now. No talking, no phone calls, no email, nothing. Fall off the face of the earth and concentrate n your family, no one else will. 40 years from now when YOU have a life threatening health issue your HUSBAND will be with you, these other people will not be. Focus. The police will contact you if they need to. Your parents and brother need to work this out for themselves. Any time you feel someone may want to harm you or "get back at you" then you have to insulate your life from them so the CANNOT do that. That means you CANNOT be dependent on them because they are not DEPENDABLE. That means they CANNOT have ANY information about you because that can be used AGAINST you. It means that anyone they know cannot know about you because then THAt person is jeapordized. People THEY know have to be insulated from them by being able to truthfully say "I don't know"
    If you do not do this your marriage WILL fail. A spouse can only tolerate this for so long.

    Yes, estimate your income. Be aware that they will look closely at your most recent paystubs, so an estimate based on those would probably be a very good idea, even if you think you'll earn more later in the year. As long as your income is above the required amount for your household size, you shouldn't have anything to worry about...

    My lawyer, who apparently works saturdays ,emailed me saying that my sons visa fee bill had showed up on friday already and she had paid it then! Hopefully mine will be accessible on monday so she can send our last documents in soon!! Now I really really really want it to be monday already

    Yes you have to have the medical by a US civil surgeon in Canada. You can go to Vancouver, Toronto or Montreal. All CR-1 or IR-1 spousal visas go through Montreal.
    My husband is in Calgary and we too will be spending a week in Montreal to get the medical and interview done in one trip.
    I wonder if there is a way around this for the affidavit of support. I wonder if we can use our current income or something. I think we can only use my income if it will continue from the same source when I move. If anyone has suggestions on this, it ould be greatly appreciated. I'm going to
    Nope. Your income from Canada will not count. Either try to gather all your asset documents, or the USC moves a few months early to get a job and establish a US income. As much as that would suck, it might have to be done. You could also look into getting a joint sponsor to help you out. Canada has no problems with the USC using a joint sponsor.
    At the moment my income is $0 because I lost my job in November and I'm a full time college student. They only way to get my husband here is with a joint sponsor.
    That being said, I spoke to an immigration lawyer (only to see how much it would cost to have someone else fill out our forms and take care of the rest, and they said doing it this way takes about 2 years to enter the country.
    That lawyer is a fool. At the most it takes a year. You don't need a lawyer for the process unless one of you are on probation for murdering someone or have any other felonious Background.
    where would I find the proper timeframes for Canadians wishing to file I-485 once the notice of action is received?
    I-485 is only to adjust status once you are in the US, doesn't apply for you.
    After your I-130 is sent to Chicago you don't know where it will end up. California is a little slower than Vermont, cross your fingers for Vermont. Sometimes it is expedited if the USC lives abroad with the spouse, sometimes it isn't. Sometimes (like us) you're stuck in USCIS limbo for eight and half months. It's a dice game.
    NVC usually goes pretty quick if you send in all the documents and do not get a checklist. Montreal is eligible for electronic processing, so everything is done on-line and by email. The average for Canadians in NVC is about 22 days. After NVC you will be scheduled an interview in Montreal. It's about a month and a half to two months AFTER NVC the interview will be scheduled. You will probably look at mid to late summer.
    Keep in mind if you are expedited through USCIS, you can take your sweet time submitting documents to NVC to meet your schedule.
    We were going to stay here for another couple of years, but the winters up here in Alberta are just too much for her.
    HAHAHAHA Alberta winters are nothing! I spent two winters in Winnipeg, I was outta there! -45 for two weeks straight is enough to make anyone move! Hubby said he moved to Calgary for the nicer weather. Now he's moving south for even better weather.
