    Make sure we are speaking the same language:
    1) The total process normally takes 8 - 10 months, so the odds of the baby being born are high. It can take less, but don't depend on it.
    2) You will NOT file for the baby as an immigrant if you quickly register the birth at the local embassy. It is quick and painless, and then the baby is a USC and there is no additional paperwork required.
    3) You won't file any of the sponsorship papers until you are through the USCIS which is normally about 5 months, although it has been quicker than that recently. Once you are through the USCIS, you will then pretty much know if the baby is more likely to be born here or there--that's when you make the decision, but in the meantime I am not kidding when I say you better fill out the forms NOW so you know whether the sponsor meets the requirements or not. There is NOT a single reason to not do that, so do it now. You need to know if he qualifies before you get further down the road and then discover he doesn't qualify until it is too late and you have to scramble to find someone else. One thing is for sure, if he won't disclose his assets, you don't have a prayer of him being approved as a sponsor.
    Listen...just do it, and if you still have questions, then ask them. You haven't told us a single thing that we can use to help advise you other than the SS payment.

    Certificate--no license--for the immigration folks. They want PROOF That you are married and with the exception of one or two states, the license proves nothing, so get the cetificate just liek it says in all the directions you have read

    I can honestly tell you that if you question that someone loves you, the answer is NO they do not. When someone loves you, you will not have to ask, you will know it. You are thinking you have done something wrong. You can not make someone love you. They either love you or they don't. There is someone out there who will love you.

    Sorry to be so blunt, but it sounds like you were thinking with the wrong part of your body when you entered this "relationship". And she knew it and took full advantage of it. You are being scammed, used,or whatever words you want to use. I suspect you knew this some time ago but your rose colored glasses prevented you from getting out sooner.
    And this point you need to get out and get out now. No more trips. No more money. Nothing. Just one phone call to say goodbye, you are filing for a divorce and hang up. She will get upset because she is losing the money train so expect that to happen. But this is not a relationship and IT WILL NOT CHANGE. I feel sorry this happened to you, but you will be none the worse for wear in a short time.

    I think in your heart you already know the answer to the question you are asking. How can you work out a marriage with someone who won't even talk to you? You should file for divorce in the USA and move on with your life. My ex-husband also became cold and distant after we got married. He made my life hell. It does seem as if she only married you to get a visa. Most people that run these scams will at least pretend they love you until they get over here but she can't even do that for you.
    I can tell from your post that you are unhappy and in a lot of pain over this relationship. Once you move on with your life you will feel better and God willing you will find someone that really loves you.

    People can get deported for a variety of reasons and being married to a US-born citizen does not preclude people from having to follow the law. So, your past came back to hunt you and your application for citizenship was denied. You can hire an attorney and spend lots of money in trying to appeal the decision. Or, you can do as you were told an re-apply in 3 years. Why the hurry to become a US citizen? As long as you are a legal permanent resident you have the same rights as a US citizen -except the right to vote.
    On a different note, it is terribly bothersome and tiring when people point to the right-doings of others as part of THEIR moral character. How does it make YOU a good moral character if your spouse is a physician? What have YOU done to deserve citizenship in the US? Apparently, the issue has already been decided; you were denied. Good luck on your appeal.

    You have been detained for shoplifting, charged with petty theft and paid the fine. You did not do that because you were accused mistakenly, but because you were guilty as charged. You are a thief.
    Yet you did not disclose this, wrongfully assuming the Feds are too stupid to find out within a comprehensive FBI background test.
    Tell you what: if I had been the I.O. I would have seen this as a deliberate misrepresentation and declared you a persona non grata for the rest of your natural life. If I were you, I would thank my god for sparing me deportation and keep my mouth shut for another 3 years. If I was the judge getting your complaint on my table, I would order you deported before going to the bathroom.
    You apparently have no idea how lucky you got.

    Well, it is almost over !!
    We had our interview today at the San Jose Costa Rica embassy, and other than taking quite a bit longer than we thought, it went without a hitch and Emma Rosa can pick up her passport with her visa Monday afternoon. We'll post all the details at the Costa Rica embassy portal.
    She won't be coming to the US until late October or November since she has some business to wrap up here in CR first, and I'm headed back to NJ Sunday--9/11--and I expect lots of extra scrutiny at the airports since it is the tenth anniversary. I don't know about you, but I will certainly pause a bit in my travels and be thankful that we live in the US and that we are all trying to bring our loved ones home to build a good life. Immigrants are the backbone of our country--documented or undocumented--so let's all do our part to make it a better place each and every day.
    I want to wish everyone here the very best wishes, and no, you can't get rid of me that easy just because we are done for awhile. This is like a huge extended family to me and I will stick around until I don't feel helpful--I hope that means forever.

    I don't know if this help, but I put "none" on that question for my wife, I personally don't think the married name matters at all.

    Your US citizen spouse will file Form I-130. Once approved, you will file the DS-230 for an immigration visa. A waiver is not necessary since you have only 8 days of unlawful presence. A ban is not trigger until you accumulate more than 180 days of unlawful presence. As long as you are honest about your overstay, you will be fine. Do lie about it. It's not the overstay that you would be punished for, it would be the lying. (I am Asian so I am going to put this out there - do not try to save face by lying or hiding the truth. Americans don't like to be lies used to cover up past wrongdoing. Wrongdoing can be forgiven. Lying after the fact is usually not forgiven. Look up Anthony Weiner - it's not the photos that got him busted - it was the lies to cover them up.)
    Do not hire this attorney you had the consultation with. While it is a remote possibility that your USC spouse would have to file for a hardship waiver, it is unlikely because you are not subject to any ban. This attorney is probably wrong, ignorant and uninformed, or just want your money.
