    CBP will be there to accept passengers whenever there is an international arrival, including 5:30am. They will be able to process your fiancee's entry at this hour.

    Yes, you can get a SSN, bank account, insurance, gym membership, library card etc etc before the green card. For some of those things you just need to show you are living here, by showing a bill or something with your address on it. If you are getting health insurance through your spouse's work, you should enrol as soon as you get married, as most companies have a one-month period after a "life changing event" (such as marriage) in which you can enrol. Otherwise you will have to wait until the next open enrolment period, or get your own insurance. Once you get the EAD you can work and get a drivers license, even before you receive the green card. In some states you can get the drivers license before you get the EAD, though it is usually a temporary license that expires when the I-94 expires. You are living in the US the minute you step on US soil with the K-1. There are some things that will need to wait until you get the green card, but very few. You should start building your life in the US as soon as you arrive.

    Sammie, I've heard of people doing this, it's not usually a problem for Sydney. Your visa won't be approved on the day but they will approve it once they get the required documents.
    However how do you know which vaccinations you need? A lot of the vaccinations on the list are waived. Also why do the vaccinations take 3 weeks? Are you getting both rounds of vaccinations? You only need the one round for the visa. If you want to save time, and not get unnecessary shots, I would just get them at the medical.

    You don't need to have the SSN the day you start work. You just have to show that you have applied for one.

    As soon as you get married, you can start using your married name. This is regardless of whether or not your marriage certificate actually shows your married name, because some states don't show the new married name [only the maiden name] in the marriage cert. This means you can definitely use the marriage certificate as proof for a legal name change.
    Also, you can fill out your AOS forms (including EAD and AP) using your married name, even if you haven't changed it yet with SSA.
    For the name change on your SS card, that is a separate process. You can check with your SSA office, because some folks mentioned here that one only needs the MC for the name change. However for non-USCs, SSA will typically look for a valid immigration document showing that your new name like EAD or GC on top of the marriage cert, because they will have to check your name on the SAVE database.

    This is exactly what we did. We had the legal wedding at the courthouse to get the marriage certificate, so I could file AOS as soon as possible. Later on we had our ceremony with family and friends. We had a friend of ours "officiate" the wedding. We had the walk down the aisle, the vows, the reception etc. The only thing that was different was that the legal part - the signing of the wedding certificate - had already happened. Most of the people at our wedding weren't even aware of that - why should they be told, and why would they care?
    Lots of people in your situation do it this way. The hardest part is figuring out which anniversary to celebrate in subsequent years.

    University students often have several months available at a stretch. Someone independently wealthy and not in need of a job has the time available. Someone who can telecommute if necessary can afford 3 months away. Please do not try to 'stir the pot' by introducing suppositions not based upon any fact or evidence. If you have nothing constructive to add to this thread, then do not participate. Any further comments of this nature will result in a thread ban.

    It's a mistake on the Visajourney example form. I noticed that when I went through AOS. Ignore it and use your new married name as the family name, and only put your maiden name where it asks for "other names" or "name as it appears on I-94"

    "If your failure to file was through no fault of your own, you may file your petition late with a written explanation and request that USCIS excuse the late filing. Failure to file before the expiration date may be excused if you demonstrate when you submit the petition that the delay was due to extraordinary circumstances beyond your control and that the length of delay was reasonable".
    If you don't submit a letter of explanation you will be denied for being late. You will need to include some kind of explanation. I have recently seen people here submit their I-751 petitions late with a letter of explanation, and their petitions were accepted.

    Submitting an I-131 will not slow the process of your other applications. The applications are processed separately.
    I-131s are routinely approved without any strong reason or evidence of a reason to leave the country.
    RFEs for I-131s are very rare. The form is extremely simple to fill out and requires a minimum of attached supporting documents. Follow the instructions and you will be fine.

    Hi, not sure if one could say 'used' you in the real sense to get into the US. He could travel to the US anytime with the visa waiver, and also he left to return to Germany. So if he had used you he would still be in the States.
    It probably was a mere break up and he got fed up staying with your larger family and wanted you and young child to be a nuclear family, but without deep consideration for how it can be achieved in the long run with limited finances.

    You cannot apply for an EAD until after you arrive in the US on your K-1.



    You have two times when you can apply for the EAD:



    1. AFTER you arrive in the US you can apply for an EAD by filing the I-765. It will cost $380 and will take 60-90 days to arrive. Unfortunately it will expire in 90 days after your arrival in the US. So at best you will get a couple of weeks in which you can actually work using this EAD. It is a waste of money.



    2. AFTER you arrive in the US and get married, you can apply for an EAD either when or after you apply for your green card (it costs $1070 to file the I-485 for the green card). It is free to file the I-765 when you file it with the I-485. Again it will take 60-90 days to receive the EAD which will allow you to work while you wait for your green card.



    By the way, you may be waiting up to a year after you apply to get your green card.

    Get married in a courthouse within the 90 days, then have the big ceremony and reception with your family and friends when you are ready. Lots of people do it this way.

    If you no longer wish to be represented by a lawyer, you have NO obligation to stay with your current lawyer. Clients fire their lawyers all the time. No lawyer should be telling you that you're obligated to use their services. All the file materials and documents you sent to them, or that USCIS/NVC sends to them, are yours. You have the right to request them as long as you have paid your lawyer's fees.
