    Vietnamese owned nail salons are a dime a dozen in my state. They've pretty much driven everyone else out of the market. And they are legit businesses, not the type you're referring to.

    There is not problem being a stay at home wife. Many people chose that path and its not a negative thing. The people who were denied were working. And I'm fairly sure it wasn't for the amount they were sending, but because one person who had income was not commingling their income. Instead treating her marriage as an OFW would treat her employer. I'm sure there were other red flags going on in those relationships also, red flags we'll never know about because the entire story is never told. You'll have nothing to worry about just because you're staying home and will be a student. That all goes into planning for the future of your marriage together.

    I hope you spend longer getting to know each other before jumping into a K-1 this time. If there's one problem I see much too often here, its too many are in love with the idea of being in love and not the person. Rather they have filled in the blanks of what they don't know, with what they want that person to be, instead of who that person really is. Then when they're suddenly together and married, they discover how wrong that person was for them and then things get ugly.

    None of which will matter one bit to USCIS, she has no legal path to stay. His case was closed when the visa was issued and used. Had she filed to adjust status after marriage then a new case would have been opened. At the current time there is nothing for him to do. There are no open cases. The only thing open is her I-94 which allows her to legally stay in the USA for 90 days if she marries or not. He didn't marry her, what she does now is up to her and not him. Even if she chooses to stay illegally, he can't force her onto an airplane.

    We only provided 3 per year for my wife's ROC. It was approved in 63 days with no interview. They were not that busy back in 2014.

    You can validate feelings without agreeing with those feelings.
    Your wife feels hurt and says her sister and mother are bad because they didn't invite her
    You respond, I understand you're feeling hurt, and it must make you feel bad not being included. I think I might have felt bad to not be included in something like that with my family. I guess they just weren't thinking. Maybe when you talk to them next, you can ask them to give you a call or text next time they go out like that.
    You challenged her feelings, and basically said she was wrong to have them. People can't control their feelings, what they feel is what they feel, even if you might not feel the same way in that situation. The example above shows empathy and caring for her feelings. Yet you're not agreeing her mother and sister were bad people and you're not challenging her feelings.

    I guess we can just go to the interview with as complete a picture as possible, and show them we won't become a liability.

    You are missing the big picture.
    What are you going to do when it comes time for the ROC on her 2 year green card? How are you going to show a bona fide marriage with you in Dubai and your new bride in the US?
    Have your wife move with you to Dubai and then apply for an immigration visa when you are ready to come back.

    She needs at least her AP before traveling (60 to 120 days after filing to AOS). But if she's going to spend over 6 months out of the year out of the country, there's a good chance the green card will get yanked. You have to maintain residency in the USA. In other words she's still going to need a full time place to live in the USA. Both of you may have to travel back on short notice for a green card interview if called.

    If your wife moved back to Texas in February of this year, she hasn't been a resident long enough there to file for divorce. She must have been a resident for 6 months before she can file. You can challenge the divorce based on the residency requirement, but this will not stop her from going forward again once she has residency. And yes it is very likely she's playing nice to get the divorce agreed to and completed. This is not a bad thing, divorce is much easier when the parties don't turn vindictive. You can't force someone to stay married to you.
    I don't know what assets or debts you've accumulated or how she's asking them to be divided. It could be your best option is to contest her residency and file for divorce in your own state. The person who files the divorce is in control of the process and this can be an advantage. The laws of NY might be more beneficial to you, over the laws in Texas too.
    These are things you need a lawyer to help you decide, unless the two of you work to write up your agreed to divorce settlement. Which is a little late now, as she has already filed for divorce. Currently she has served you and her demands should be in those divorce papers you should have been given a copy of.
    As to ROC, gather up every bit of paper evidence you can get your hands on now. If the divorce goes sour, she may not be willing to help you get that information later. I would ask common friends for a affidavits too. They may not hold a lot of weight, but when filing for ROC, every little bit of evidence adds up.
