My son received his US immigration visa about a month ago. He decided to return to Russia to wrap up several things going on in his life then travel to the US in March. Now it appears he wants to marry his girlfriend. Has anyone heard of a situation like this? I'm not sure what to tell him, can he get married in Russia then fly to the US by himself with the idea of bringing her over later? Would it be better for them to wait until he gets settled in the US? Any ideas or information would be helpful.

Should I report a perceived fraud?

I became aware of something that I believe may constitute an immigration fraud.
My acquaintance, a Ukrainian woman, got married to a citizen of Israel in 2018. The marriage was registered in Cyprus. The marriage lasted only few months, the couple resided in Israel. After breaking up, the wife moved back to her country. The Israeli spouse filed for divorce and she was summoned to a court in Israel, to which she refused. At that time she argued that she did not inform her home country authorities of her marriage, thus she remained "unmarried" in Ukraine and did not need to go through the divorce procedures. In communication with friends she admitted that she tried to extort some "compensation" from the Israeli spouse in exchange to her appearance in a court. The husband rejected the claims and that's where their communication ceased.
In 2020 the said lady met an American man on the Internet and visited him in the US. Then last summer she entered the country along with her minor child on B1/B2 visas with the intent to stay. I learned that they recently got married and plan to apply for AOS. When I confronted the lady regarding her previous marriage and whether she was going to disclose it in her I-485 application, she evaded and stopped communicating. I warned her that what she was doing considered illegal. I am not discussing the moral aspect of the story. I am not sure whether her US husband is aware of the previous marriage. I believe he may be not.
Now I am facing a dilemma, do I have a legal/moral obligation to report her actions to USCIS? Please advise.

Expedite at NVC stage/ rejectedI-864 co-sponsor/ resubmitted

On December 8th we heard from NVC saying co-sponsor s form was rejected. Further information said that all pages must be submitted even if blank. Our lawyer said all pages were submitted correctly and it is the fault of NVC s antiquated system that sometimes doesn t accept all pages. Lawyer resubmitted our cosponsor form that day, but we haven t heard anything back from NVC to say this submittal was accepted.

Also petitioner did not file taxes 2020. Lawyer said no problem and no need to explain to NVC why he didn t file. Son thought he should write explanation, but lawyer assured him he didn t need to. Well, NVC notified petitioner that he needs to submit explanation so that was done immediately and submitted the next day. Again we haven t heard anything back from NVC about the resubmitted form or the tax explanation or whether it is accepted or not.
Then on December 16th a message from the state department to our congresswomen (who is helping us expedite for medical reasons and who asked that the application skip the review process and go straight to the IV unit) said the petition for wife s spousal visa was transferred directly to the US embassy in Tbilisi. We thought maybe this was good news, but as of January 9th We have not heard anything from the US embassy as to whether or not the expedite has been approved or whether we will have an interview soon. We have no response to the re-submitted cosponsor form or the petitioner s explanation for not filing taxes last year.

First, has anyone else had a form Rejected for not all pages going through? Could it really be the fault of NVC s antiquated system as our lawyer said?

Secondly, does anyone have any idea why the petition got transferred to embassy, but no mention of acceptance of cosponsor form ? And no mention of approving or denying expedite?

Any advice , suggestions, or insight from members here is appreciated.

My fiance id Russian, I am asuming she will go to Warsaw for her interview.

She cannot go directly to Poland, she has a Shengen visa, and I was wondering what countries are the best to transit through!

Does the 2 year marriage determination for IR-1 versus CR-1 apply when you file or when you receive the visa?

Hello,

My wife and I have an unusual situation and I was curious about how it will affect her spousal visa. Here is a quick timeline of our major life events together. I know most of this is irrelevant to my question but I wanted to give an overview of the entire situation as USCIS will see it.

- She came to America from Russia on a K-1 in 2011.

- We married in America within the 90 days and she received a TLR (conditional 2 year 'green card')

- We had a child together in America in 2012.

- We separated and she moved back to Russia just prior to us filing the AOS, so we never filed it.

- She got a divorce in Russia in 2015 which we never had adopted in America ( I know that it is still recognized by America regardless).

- We resumed our relationship and I moved to Russia in 2015.

- We had a second child together in Russia in 2019.

- We remarried in Russia in 2021.

- I received my PRP (permanent residence permit) in Russia in 2021.

- We are about to file the I-130 from Russia this year in 2022 and then upon approval return to America as a family (Both of our children have dual citizenship with both Russian and American passports).

We plan to file the I-130 within the next month or so but we will have only been married (the second time) for a year. I assume they will use the most recent marriage date for visa purposes. If processing takes a year or longer, do they consider us married for the two years? will we receive a CR-1 or an IR-1? I read someplace that the determination is made when the visa is issued but I do not know if that is accurate or not. If they issue her a CR-1 then do we have to wait the full two years after that to file an AOS or can we change it as soon as we have been married for two years? I found this which makes it sound like the day we enter America will be the determining factor. So if we have been married for two years by the day we come to America then we get the IR-1 instead of the CR-1? Also, will they give her some kind of visa prior to entry then the 'green card' after entry like they did with the K-1? It actually just dawned on me that CR-1/IR-1 is actually the visa to enter the country then you get the 'green card' after just like the K-1, correct?
