USCIS Lost I-129F Submission

I had an RFE from USCIS. They wanted proof of my 1st marriage ending. My wife died in DEC22 and I sent them an original from the Records Office. Somehow they lost it. I have copies of that record but I went back and purchased another official copy and sent it in. The $20 is not the problem. The problem is the lost time. There has already been a complete halt to USCIS processing since they fired the 400 people in APR/MAY this year. People who filed in APR and MAY received approvals in under 60 days. I am on day 150 and counting. This is ridiculous.

I am so happy that Trump has a Dept of Government Efficiency (DOGE) and I certainly hope they attack the USCIS and get them straight. It should not take this long to process these forms. I understand these are government employees and they work at a snail's pace. Maybe they should outsource this to a company that can be more efficient. I will have my approval soon after they review my RFER but hopefully others will benefit from Trump's new policies.

Wife has her US Citizenship. We bought land in the Philippines for retirement hopefully by next summer. She tried to get an appointment at an outreach center and I uploaded everything they asked for. However the issue is although we filed the ROM in 2019, they said that was just a certified receipt that they received it, but we need to get a "certificate" from the PSA in order to continue. She already has a US passport with her married name AND renewed her Ph passport in her married name. $20 per copy and DHL is over $100 for delivery. I just wanted to be sure they are not going to just send us a copy of the copy that is was received and filed. Anyone?

J1 to AOS, do I need i765?

My spouse is currently in the United States on a J1 visa. We got married in the United States while she was on her J1. Her J1 does not have a 2-year home residency requirement. We are planning on concurrently filing i130 and i485 to adjust her status.

Filing the i485 allows her to stay in the United States while it's processing, but does it allow her to work once her J1 expires? Or does she need to apply for i765 as well?

NOA2 Expiration/Validity Date and Interview Date

Hello, The expiration date on our NOA2 is 26Dec2024. We are needing to conduct the medical and interview at the US embassy in Manila in late January 2025 so to give me the petitioner time to fly to Manila to be with my fianc due to her needing my help in navigation everything in Manila. She is unable to do it on her own. The case was updated to 'Ready' on 7Nov2024. Neither me nor my fianc have received any communication from NVC nor the US embassy in Manila. I submitted public inquiry to both NVC and the embassy inquiring about having not received any notification. The NVC just told me that they had sent the K1 petition to the US embassy and did not address not having sent me a FTP email notification. I sent the inquiery to the US Embassy in Manila about two weeks ago and finally received this response:

"Dear Mr. .....

We are writing in response to your November 8, 2024, inquiry to the Immigrant Visa Unit concerning the fianc e (K1) nonimmigrant visa case of Ms. ...........
An approved K1 nonimmigrant visa petition (I-129F) is valid for four months from the date of its approval by the U.S. Citizenship and Immigration Services (USCIS). Consular officers may revalidate the petition during the applicant s visa interview if eligibility requirements are met. Each revalidation is good for an additional four months. However, if the officer determines that there is insufficient evidence of continued intent to marry, the petition may be returned to the approving USCIS office.
If the petition is expired, the applicant is still able to proceed with an interview and the determination will be made at that time. The revalidation happens, when approved, at the time of interview and not in advance.
The applicant must now schedule an appointment at the Visa Application Center (VAC) for the fingerprints and photo requirements, and an interview appointment at the embassy through the Embassy s Customer Service Center. English and Filipino-speaking customer service agents are also available at telephone numbers (+632) 7792-8988 or (+632) 8548-8223. The call center is open Monday through Friday, from 8:00 a.m. to 5:00 p.m. (Manila time), except on Philippine and U.S. holidays. Callers in the United States should call (703) 520-2235 on its Eastern Standard Time equivalent of operation hours.
Prior to their appointments, applicants must ensure that all details are correct in their visa application (Form DS-160). Including given name, surname, gender, passport number, and date of birth. The barcode number on the DS-160 confirmation page must match the number indicated in the applicant s appointment letter.
Applicants should follow all interview preparation instructions located on the State Department's website. The website identifies the required documents as well as procedures to follow prior to the interview date. Applicants must bring the original required documents to the interview.
If the applicant needs reasonable accommodation (PWDs) for the visa interview appointment, please follow the instructions on our website.
We hope this information is helpful."

At this time I have submitted the DS-160 and paid the visa fee on usatraveldocs. It sound like from the response from the embassy that I can go ahead and schedule the interview after the NOA2 expiration/validity date. At this it does not appear that the US embassy in Manila has opened any appointments yet for January.

My questions are : If the embassy does not open any January dates prior to my NOA2 expiring and I end up having to schedule the interview after the NOA2 expiries, will that cause a problem? Could someone who has experience and knowledge on this topic provide some feedback?

ADJUSTMENT OF STATUS - proof of bona fide evidence of marriage

Hi all! Im taking a long shot here but hoping somebody can help.

So we dont have a lot of legal documents with both are names

i.e :

  • Deed to property showing both names
  • Mortgage or loan documents showing both names
  • Lease agreement showing both names
  • Driver s licenses or IDs showing the same address
  • Bank statements showing both names
  • Utility bills showing both names (electricity, water, gas, trash, cable, internet, cell phone, etc.)
  • Correspondence from friends, family, or businesses showing both names
We only have my husbands updated life insurance, medical insurance with my name and an updated Emergency Data document from the DoD with my name on it too.
We are filing our AOS through rapid visa and they are asking for:
  • Explanation letter signed by the Petitioner why there is limited proof of bona fide evidence of marriage. It must be notarized.
  • In addition, we will need both of your signed comprehensive letters that include a statement/narration about your relationship (how you met, got engaged, details about your marriage, and future plans) signed and prepared individually to support the bona fide marriage evidence. Just a signed statement from both and doesn't need to be notarized.

Anyone has a sample for this two I can maybe get an idea of what to write? would be a big help! TIA!
