I am looking at filing 2020 taxes jointly for the first time with my Filipina wife who is resident in the Philippines. We will have a copy of her Philippine passport that is certified by the Philippines Department of Foreign Affairs, letter designating her to be treated as resident alien for tax purposes, form W-7 and 1040, all with wet signatures. Intuitively, if the application is for a foreign spouse, somewhere in the process I would need to prove that she is actually my spouse. But unless I missed it, nowhere in the instructions do I see any requirement for a marriage certificate or any other proof of marriage.

Is that correct, that all I need is a certified copy of her passport and the signed paperwork and apparently it is on the honor system that we are actually married? I would definitely rather NOT leave the marriage certificate in the possession of the IRS for an indefinite and probably extended period of time it takes for them to process a paper return these days.

Hello,

I came to the USA 10 years ago on a fianc e visa. My parents who are poor farmers in the Philippines have expressed interest in coming to live in the USA. However, I am not sure where to start. I have not worked while being in the USA. So I have several question I am hoping someone can answer.

1. I assume I file an I-30 for the to come here with a greencard. Does the financial sponsorship have to come from me or can it come to my husband or should I get a job first before I apply for them.

2. How long and expensive is the process from the Philippines?

3. ** Kind of Most important. They are now in their mid 50s and know very little to no English. How does USA social security work for permanent residents? Do they need to become U.S. Citizens before they would qualify for Social Security? My understanding is that you need to work 10 years, 40 quarters to be eligible for social security. So if they came here and both worked for wal-marts of some type of place only paying minimum wage. How much would their social security be with such a short work history and low wage? <--- This is probably the most important thing in deciding if it is a good idea for them to actually come here because I worry about their future if they were to come here.

Hello, everyone. I had a few questions.

My wife's two children live in the Philippines. They are both under 21 and my wife just received her 10-year green card.

What happens next after the I-130 approval and what is the approximate timeline? We were also wondering if we will receive any correspondence by mail or only the beneficiaries (her children) regarding the next steps?

Any input would be greatly appreciated. Thank you.

Seeking Advice Re: Job Resignation Pending Approval of AOS from K1 Visa

My Fil-Am partner and I are planning to apply for a K1 fiance visa this year and get married thereafter. However, I m at a loss as to when I should quit my current job.
Currently, I m working full-time here in the Philippines. I m also the breadwinner of my family. Through my current employment, I m able to fund my parents and siblings. However, knowing that K1 visa and AOS applications may take a year or more, I m not sure when to resign should it be right after I receive my K1 visa?
Or should it be after my AOS is granted? I read that I could travel outside of the US and return here after getting married pending AOS application as long as I get an approved Advanced Parole. Perhaps I could take a month and a half leave from work then return here while waiting for my green card. The problem with this scenario, though, is that an application for Advanced Parole takes months. I doubt my employer here would grant me paid leave for that long.
Needless to say, I m afraid of losing a steady source of income and eating up all of our savings as I prepare to move to the US with my future spouse. I also wouldn t want to rely too much on my future spouse when it comes to financially providing for my family here in the Philippines. So I was wondering if there s anyone here who could give any insights or suggestions on when it would be advisable for me to resign from my job. What would you do if you were in my place? :)
