Hello all, I hope that someone can help me. My wife is a Filipino and we are in a same sex marriage. I need to fill out the I-751 to do ROC so we can get our 10 year green card. However, we have begun to change her last name to mine. It has been changed at social security already. We need to change it on the green card. How do we go about doing this? Can I just fill out the I-751 with her new last name and put her old last name as other names used? We will not be able to change her name on her Filipino passport because gay marriage is not recognized in the Philippines. I don't know if this is a problem or not. Do I need to fill out any more forms? Do I need to fill out the I-90 and send it with my I-751? Do I need to pay the $455 for I-90 and the $455 + $85 for the I-751? Appreciate any advice that can be given. Thanks!

I was using the calculator for I-751 and N-400 and it seems like I am eligible to apply for ROC and N-400 at the same time...? On my greencard, it says Card Expires: 03/03/2022 Resident Since: 03/03/2020 This is what I am getting from the calculator: ROC N-400 (I am still married to my husband). Does this mean I can send out both applications at the same time (two separate files, of course)?

We are considering a trip to a third country. That is, not the US and not, in this case, the Philippines. Since we've already had out petition at NVC for 15 months, we keep thinking things should happen soon. How is the notification of the beneficiary's interview handled? Does the embassy just say show up on Friday at 10:00AM? Is there an appointment system? Do you get a choice of dates and times?

As some of you know I filed for an EED and 9(a) visa about 2 months ago. Well since the EED was no longer needed I reached out to the Consulate again about my visa. They sent me the requirements for the visa which were pretty much the same as the EED so I sent them again via email. They asked me to get the visa application notarized and email them a copy. Next they sent me an email to send all of it to the consulate along with my passport and prepaid return envelope and a money order for $30.00. They will notify me when they send me my visa. Here were the requirements: Copy of passport of applicant (valid at least 6 months from return date) Travel Itinerary (duration of stay in the Philippines) Proof of Financial Capacity (photocopy of latest bank statement and an employment certificate from the employer indicating position and salary, or affidavit of support), for Tourist Visa (for pleasure only). Additional documents for Foreign spouse and parent of Filipino nationals: - Proof of Marriage - PSA-issued Marriage Contract, for Philippines-issued documents or apostilled/authenticated, for documents issued by foreign governments - Proof of the citizenship of the Filipino spouse (copy of Philippine passport or dual citizenship documents) - Proof that the Filipino spouse is living and currently in the Philippines (e.g. barangay certificate) - Proof of parentage to the Filipino child - PSA-issued Birth Certificate, for Philippines-issued documents, or apostilled /authenticated, for documents issued by foreign governments - Proof of the citizenship of the Filipino child (copy of Philippine passport or dual citizenship documents) - Proof that the Filipino child is living and currently in the Philippines (e.g. barangay certificate)

With visa now in hand (she received it Friday 8/6) we registered for the CFO on Monday morning. With all I have read here I was somewhat worried. I will attach the list that they sent my wife. I was thinking I should submit as much as possible on the list at first, but instead I decided to just send the 4 things required and wait to see if they request anything else. After sending the documents we received and appointment for the following day at 11:00am. My wife was extremely nervous and I did my best to reassure her even though I was worried too. I called my wife in Skype during the counseling session so that she would feel at ease. I understand enough Tagalog to follow the conversation. She asked how we met and the usual questions you would expect. How long together, do we have kids, when did we get married, if I was married before, when I got divorced, do I have other children, how often I go there, where I live, what do I do for a living, etc. The call was less than 10 minutes total. The counselor told her that she comes across relationships that seem fake, but since we have been together for 10 years and have 2 children together she had no concerns and informed her that she has successfully completed the Guidance and Counseling Program of the Commission and to check her email to make payment and receive her certificate. Please send the digital copies of the following registration requirements for checking/verification at (email address of the person assigned to us) 1. Valid passport; 2. Valid visa or visa grant notice; and 3. Petitioner's passport 4. Marriage certificate or Report of Marriage - ROM (in PSA security paper) (if married) Additional documents may be required in the event that the counselor determines it to be essential to complete the guidance and counseling process. 1. Divorce decree/certificate (of Filipino spouse or foreign spouse, if previously married); 2. Annulment paper (of Filipino spouse or foreign spouse, if previously married); 3. Proof of residency/Alien Registration Card-ARC (of foreign spouse); 4. Proof of relationship (picture together, e-mails, among others); 5. Death certificate (of Filipino spouse or foreign spouse, if widow/widower); 6. Certificate of Family relations / registration (of foreign spouse); 7. Declaration of undertaking of travel in letter format to include the following activities to prepare for travel, Itinerary of Travel and How to ensure safe travel and stay (if will be required by counselor/facilitator); 8. Affidavit of invitation and support (financial support/safety/medical insurance) notarized and authenticated by the Philippine Embassy or Consulate who has jurisdiction over the destination or host country (if will be required by counselor/facilitator); 9. Explanation on why the foreign partner cannot travel to the Philippines in letter format (if will be required by counselor/facilitator); 10. Valid no criminal records certification/clearance or any equivalent document to indicate lack of criminal derogatory record or medical/psychological condition (if will be required by counselor/facilitator). CFO Officers will go over your documents which can take a few days to process. We will update your verification status thru another e-mail. In the event that your requirements are complete and verified, you will be notified of your tele-counseling schedule by your counselor/facilitator Important Reminders: 1. You need to complete the OF-CORS online registration prior to paying the registration and courier service fees. Carefully follow the procedure and input the correct information when you register to avoid unnecessary delay of the issuance of your temporary and original certificate and/or sticker. 2. You can't change your delivery details after paying for the CFO-OFCORS for GCP registration and courier service fees so please use the permanent and correct address. 3. Immediately after completion of CFO-OFCORS for GCP registration, pay your registration and courier fees and submit your proof of payment/deposit slip, and valid passport at ofcors.payment@cfo.gov.ph.
