I could really use some help please. My wife is here and I am filling out the AOS paperwork for her. Her son/k2 will be coming after 6 months. Do I include him on the paperwork for the 864 (Affidavit of Support) or do I wait until he is physically here in the USA? I'm confused on this. where it asks on Part 3, information about the immigrants you are sponsoring. I would just check I am sponsoring the principal immigrant named in Part 2, which would be just her right or would also check the box stating I am sponsoring the following family members who are immigrating more than six months after the principal immigrant? That's the part that confuses me and then listing her son as Family Member 1 with his info? If anyone could help. I'd greatly appreciate it!

Hello everyone. A big thank you to anyone who can offer some advice.

My wife entered with a K1 in June 2022, and we were married in the US later that same month. For various reasons, we did not file AOS paperwork, but we are ready to do it now.

-Aside from the I-485, do we need to file any additional documents due to my wife's unauthorized stay?

-Please confirm: we do NOT need to file I-130, correct?

-Throughout the I-485, there are fields to enter my wife's A number, but I don't see this anywhere in our documents. Am I missing it?

-I-485 item 22 asks for her non-immigrant visa number. Her K1 visa has two numbers that look like possibilities to me; what are the criteria for this number? Should I just list both?

-I-485 item 4 asks for receipt number of underlying petition. Is this the WAC number from the K1 petition, or the MNL number from the Manila embassy?

-Filing fees are $1140 for the I-485 and $85 for biometrics. Do I submit separate checks, or a single check for $1225?

-I was under the impression that we needed to submit lots of evidence of continued relationship, but the I-485 instructions don't mention any of that. Should I submit evidence anyway?

Annual Income Required for AOS.

To do the AOS, adjusted gross income is required to show (I am self employed). This whole covid thing really kept me from making the money I needed to make, but I did finally recover in 2022. How many year's back taxes do we need to show to do my Wife's AOS? Would 2022 alone be sufficient, or do we need to show 3 years of back taxes. She is not planning to work anywhere, so basically at this point, we just want to do a AOS, if more than last years taxes would be required. I had a loss for 2019, 2020, and 2021. Again, 2022 I did well and am quite a above the 125% of poverty level. Just me and the Wife here. Will I need a co-sponsor to get this done?

Good day VJ!

I posted an issue about receiving an email and NO mail about I-693 Courtesy Request. I'm so confused and so i called the USCIS about it and told me that i will only send a respond if i got a letter from the mail. I don't know what's going on all i know is that my medical was done overseas 12-22-21 and filed my AOS 03-18-22.

This is what the email:

An initial review of the evidence submitted for your Form I-485, Application to Register Permanent Residence or Adjust Status, determined that the evidence submitted was deficient for the following reasons.

A completed and signed I-693 was not submitted

If you already submitted a I-693, Report of Medical Examination and Vaccination Record or if you are a K-1 VISA holder, please disregard this notice, no further action is needed.

What You Need to Do

Submit a completed Form I-693, Report of Medical Examination and Vaccination Record. A USCIS civil surgeon must complete and sign the form, and you must also sign the form. If the civil surgeon refers you to a specialist, the specialist must include his or her medical exam results and complete the proper sections of the Form I-693 before the civil surgeon may sign the form. Once everyone has signed, the civil surgeon will place the completed Form I-693 in a sealed envelope and give it to you. You must submit the sealed envelope containing the original Form I-693 that the civil surgeon signed and the medical exam results; we will NOT accept photocopied Form I-693 and medical exam results.

Civil surgeons must use the current Edition of Form I-693. You can find the current edition of Form I-693 on USCIS website at www.uscis.gov. In addition, the civil surgeon must ensure that all parts of Form I-693 were properly completed.

Please Note: All Forms I-693 signed by civil surgeons on or after October 5, 2022, must use the 07/19/2022 edition of Form I-693. USCIS will not accept the 09/13/2021 version (or any previous editions) if the civil surgeon signed the Form I-693 after October 4, 2022. Therefore, the civil surgeon administering your immigration medical examination must complete and sign the 07/19/2022 edition of the Form I-693.

Reminder: Effective October 1, 2021, applicants subject to the immigration medical examination must complete the COVID-19 vaccine series before the civil surgeon can complete an immigration medical examination and sign Form I-693. This applies to Form I-693 signed by civil surgeon on or after October 1, 2021.

Please return the completed Form I-693 in an envelope sealed by the civil surgeon. Including a copy of this notice with your Form I-693 will facilitate matching the medical report with your file.

Important Warning: Only a designated civil surgeon authorized by USCIS to conduct medical examinations is qualified to complete the Form I-693. The civil surgeon must sign and date the Form I-693. Signatures by a nurse, physician s assistant, or a doctor not designated as a civil surgeon are not acceptable. You must also sign and date the Form I-693 when instructed to do so by the civil surgeon. When appropriately completed and signed, the original Form I-693 must be sealed in a separate envelope by the civil surgeon. The sealed envelope must be returned, unopened, to this office with any other requested evidence.

A list of designated civil surgeons can be obtained by calling the USCIS Contact Center at 1-800-375-5283, or via the USCIS website at www.uscis.gov and using the MyUSCIS Find a Doctor tool at my.uscis.gov/findadoctor. You will need to provide your zip code or address. If you are hearing impaired, please call the USCIS Contact Center TDD at 1-800-767-1833.

Although processing times cannot be guaranteed, to complete your case as soon as possible, we strongly encourage you to submit your complete Form I-693 via express mail.

Good day VJ!

I don't know if i post this at the right topic but i hope our experience help someone else who process the same way.

K2 FTJ over 1 year APRROVED!

Medical @SLEC:

2 exhausting days but worth it. No issues.

VISA Interview:

3 children age 9,7 and 6

- during interview only 9 y.o allowed to enter

- their biometrics is my left handprints.

- requirements asked ds160, pictures, birth certificate, kid's passport, medical, copy of expired K1 (cancelled passport).

- questions asked to me: are you the mother of (kid's name)? their date of birth, age and have you been to the US? Your maiden and married name pls? How old are you? when did you got married? Your POE? When did you adjust your AOS in America? name of the petitioner? How old is he? How do you like America? You like the cold? what state?

- questions to my son: How do you pronounce your name? "klod"? , have you seen snow before?, are you excited to come to America? *giggle*

consol: Alright, i see no reason not to approve your visa, Congratulations! and enjoy your travel!

*visa arrived in 10 days* (outside Manila)

K2 arrived in US: Feb 03, 2023

POE: Chicago, Illinois (O'Hare)

My question:

1. My husband and I want to process their adjustment as soon as possible get their social security first but i couldn't find for K2 requirements only. I will be pleased if anyone can help. They are going to school on the 20th or 23rd this month.

Advance Parole while adjusting AOS as K1(married) leaving the country experience:

Leaving the country (US): NO ISSUES

Leaving the Philippines with K2 kids and USC husband:

-if you renewed your passport to your married name always bring the old passport (cancelled) especially your expired visa is there cos they always asked for it.

- first plane, security took copy of my expired visa and AP (they don't know what AP is and how is it related to my expired visa and AOS) took them an hour to understand what it is for after me explaining again and again.

- layover -> before boarding security read and understand my AP and let me board in 15mins

- at POE kids visa are all good and the officer saw the envelop (AP) he immediately read and told us to wait on the side to get it stamp.

It's wild and exhausting experience travelling with 3 young kids but worth it and thank you VJ because lot of information from this site helped us a lot!
