US Immigration from Canada

Does all mail that comes from the USCIS and embassy go to the petitioner? Besides the visa, what other mail will come to the beneficiary? Beneficiary has had a change of address and now uses a P.O box.

Hello, I am just coming across this. I am going through DCF in Canada. We submitted our I-130 and most of the civil documents to the consulate in Calgary on August 1, 2023. Within a couple of weeks we got an email from the consulate in Montreal (where all immigrant visas are being processed in Canada) with instructions to fill out the DS-260 which we immediately did. The CEAC status was updated on September 5, 2023 saying that we are "ready" for the interview to be scheduled but we have not received anything from the consulate in Montreal since. We followed up in late December and received a response in early January saying that our application is still pending review by a consulate officer. Does anyone have any information on DCF processing time in Canada? Thanks in advance.

My husband (a LPR) petitioned for a I-130 for me in December 2022 which is unapproved as of today. At the time, I was pregnant.
As of today, we have a baby boy who is almost 1 year old and we are in the US on a TN visa (TD visa for my boy).
Question: Does this affect our I-130 in any way? I am asking this because if we were outside the US, we would have applied for a green card from abroad but now, we will be doing an AOS. Do we need to do anything such as inform USCIS as regards the I-130?

I'm overwhelmed by this entire process. My husband (USC sponsor/applicant) and I (Canadian, beneficiary) have been living in Canada together since 2010.

I sponsored him to come live in Canada because it was a much simpler process than the other way around. But we're not happy here.

The US has more options for tolerable weather, and my career.

I was stupid to think that the I-130 was the hard part. We applied online.

The good news is that it was approved in less than a year.

The NVC sent me an email last October "Introduction to Document Collection". I see that I need to fill out form I-864 Affidavit of Support, to provide proof of domicile and US income.

I'm just baffled that we have to proof we plan to establish domicile... like, why would we go to all this trouble just to stay in Canada?

We don't have anyone we can use as a joint sponsor. We have liquid assets that are cashable (we'll have to cash in TSFA's regardless as you can only hold TSFA if you have Canadian residency), so my plan is to cash it out and transfer funds to our US based bank account. But I have seen some scary comments on here and other forums saying that Montreal is notorious for not approving visa's for those using assets as proof of income. I also saw a comment somewhere that you have to have 5x the annual poverty-line income if using assets as proof of income -- but isn't it supposed to be 3 x?

We don't have kids. Potentially my husband could move down there, get a job and a place for us. But I don't know any employer who would be okay with him taking the time off he'd need for a consular interview and again later to move me and the dogs down to the USA.

Does anyone have any advice to offer?

October 2022: I-130 submitted online

September 2023: I-130 approved and notified via email and by physical mail

September 2023: NVC emailed us that they are ready to collect documents from us "Introduction to Document Collection"

September 2023 to Feb 2023: frozen in fear after seeing all the complex steps that we have to take to complete this process

Feb 5 2023: paid NVC filing fee and AOS fee

Currently: trying to figure out how to properly fill out I-864 and provide proof of income and domicile while living in Canada

Hi everyone, I have a bit of a marriage related predicament. Yes I'm "asking for a friend" (I'm person A in this case)

Person A:

• US Green Card Holder
• Expected to get US Citizenship through naturalization (5 year residency requirement will be met in June) by the end of 2024, unless something catastrophic happens.
• Canadian citizen.

Person B:

• Foreign Citizen, attending graduate school in Canada, holds Canadian student visa.
• Expected to get Post Graduate Work Permit for ~3 years after completing grad school.
• Apparently is part of a family relative petition that was submitted ~3-4 years ago. Petition was done for Person B's parents: B's mother's sister is a US Citizen, and petitioned for B's parents. B was included as a dependent.
• Applied for B1/B2 tourist visa in Canada, and has an interview scheduled for later in 2024. B has several extended family relatives in the US that they want to visit, as well as for tourism.

A and B plans on getting married, but will only do so after:

• A gets their US Citizenship
• B gets their Canada PGWP to extend their stay in Canada, as A is able to regularly visit Canada.

My questions are:

1. How does the pending family relative petition play into this? B is currently 24 and have potentially been aged out (need to confirm when exactly they submitted the petition however).
2. Is B even eligible for the B1/B2 visa that they applied for? (I suspect they might deny B's case because there has been an intent to permanently immigrate to the US, or am I wrong?)
