Hopefully that title isn't too confusing.

We're in a weird spot. Our interview is scheduled for Feb 1st. On this ais.usvisa-info.com website, our appointment is registered. We were never prompted to pay the fee.

We've gone back and forth in email with the tech support for this website and had a few calls with their customer support. This morning they told us the visa was misclassified as an 'immigrant visa', despite us picking the K-1 option while registering. They said we should contact the Consulate and have them sort it out with the NVC.

I called the NVC this morning and had good and long conversation with someone there who explained how it works, this is supposed to be an immigrant visa and there's nothing wrong with what they sent this website. They even went over some recommended next steps for talking to the website people and then to the consulate for last-resort stuff.

So, a few questions. I'm mostly wondering if anyone else might be running into similar issues.

  • Has anyone had this issue where they just can't pay the K-1 interview fee?
  • Is there some other way to pay it?
  • Finally, I'm trying to email the consulate at montreal-iv-dv@state.gov to ask for their take but I'm not getting an automatic reply. Which tells me they haven't actually gotten my email.

Reviewing Documents Required For I-130, Petition for Alien Relative

Hi all! My wife (the petitioner) and I (the beneficiary) received our Receipt Notice on October 19, 2021 for our I-130 petition. Since then, we have not received any other communications. We have received an estimated timeline for approval of around September 2022. We understand that time is something we can't change (duh!) but we wanted to make extra sure that we had our file submitted correctly, so that it can hopefully move as smoothly and efficiently as possible!

At the time we submitted our petition, we uploaded the following documents:

  • Form I-130A
  • Petitioner's 2 passport sized photos
  • Beneficiary's 2 passport sized photos
  • Petitioner's birth certificate
  • Petitioner's information page of passport
  • Marriage certificate (married in 2017)
  • 2 separate lease documents showing joint tenancy
  • Bank statements from joint account from 2019, 2020, and 2021

These are still the only documents we have on our USCIS account's Documents page. Our questions are:

  1. Are we missing anything obvious? (we've double-checked the requirements list, but you never know)
  2. We currently only have the information page of the petitioner's passport uploaded. Should we upload all pages of the passport to our file? Also, we have stamps showing a trip we made together to Mexico, and the beneficiary has numerous entry stamps to the USA over the past few years too. Would it be worthwhile to also upload all passport pages of the beneficiary?
  3. On Form 1-130A, Part 4, 6.a. (Spouse Beneficiary's signature), the beneficiary did not sign this section digitally or with pen. I remember reading that if this form is submitted digitally, no signature is necessary. Can anyone confirm this is true?
  4. Should we also upload 5-10 photos of ourselves in various places, or will the leases and joint accounts likely be enough to prove our relationship is legit?
  5. The beneficiary has previously lived abroad in 4 different countries (including the country we are applying from - Canada). We understand the next step in the process will require him to get a Criminal Record Check from each of those 4 countries. Should this be something we begin now? We are happy to get them organized and ordered now, but our only concern was if USCIS had a time limit for when they can be ordered. I.e. Please submit criminal record checks dated within 3 months of today. In that case, the CRCs we order now could potentially expire' down the line. Any help regarding this too would be much appreciated!

Hello! I'm brand new here, and plan to move to the United States from Canada to live with my fianc /future spouse.

However, there's a requirement when it comes to the K-1 visa, that you've had to have met in person in the past two years.

With the pandemic, I haven't been able to travel to see them since March of 2019, almost three years. I planned to go in 2020 but our plans had to be cancelled due to border closures.

So, my question is, when applying for a K-1 visa, are they taking the pandemic into consideration, or would I have to first visit them again before they start the application process?

How to file?

I've been trying to do some research for the last couple of hours and I think I have a handle on our tax situation but I want to make sure.

My wife is in the process of AOS, adjusting from a K1. She's been in the US a total of 270 days this year, she come to stay for 5 months at the beginning of 2021 while waiting for her K1 interview. She went back to Canada for the interview and come back to the US in September.

We had her quit her job at the end of 2020 so she could come to the US for that 5 months and go to the interview hassle free. So she hasn't made any income in 2021. We also got her SSN as soon as she got here to make it easier to file taxes this year.

So if I understand correctly we'll file as married filing jointly and will elect her as a resident alien since she's been in the US long enough. Since she has no income from Canada, no income at all, we won't have to file any foreign tax forms like a FEIE, or do we?

To elect resident alien does that mean I just file a tax return as normal, file a paper tax return with a specific option checked, or something else entirely?

Also am I correct in the assumption that she will qualify for the 3rd stimulus payment or do I need to do something special in that regards to not receive it by mistake?

I hope this makes sense and that I have as firm as an understanding as I think I have on our tax situation.

Processing Centres Close??

Has anyone realised that they closed 1 or 2 processing centres for the K1 and moved them all to California?? The wait times were 6-8 months and now its 7-9.5 months and only California has the K1 processing times. Does anyone know if they closed them or if something happened?
