Hi, I am a Canadian Citizen with an E3D visa that expires Aug 1, 2023 and an extended approval of status (E3S) until 2025. My husband is an Australian citizen with an E3 Visa and the same expiration but approval of extension until 2025. We own a home and work in Los Angeles with our 2 kids (one canadian and one American) and a baby on the way. I booked the soonest Visa appointment I could find in Canada but it is not until August 28, 2025 in Ottawa! We requested an expedited appointment in Vancouver for next week and were denied because of capacity limitations. This is my last chance to get back to see my family before our third baby arrives and my mother cannot travel here until next year as she has hit her 6 month limit in the US as a Canadian visitor. We were planning to return to Canada and update our visas but since that option has been denied I am trying to see if I can return to the US with the documents that I already have: a new Canadian passport (does not contain a hard copy E3D visa or any stamps as I lost my old passport), E-3S approved status until 2025, I94 and documentation showing our travel history in the US. If that doesnt work, what is the possibility of being denied entry as a temporary visitor from Canada to the US if I am traveling with my family who can re enter under their status? If I re enter as a visitor can we apply for new visas while in the US and ship our passports to Australia to get our visas processed? Any guidance here would be helpful. We have already lost the $630 in visa application fees as well as our families flight back to Canada should we not be able to return to the US.

Looking for some help. My USC wife and I live in Canada where I am employed but will not be employed immediately when we move to the USA. My wife is a stay at home mom and has a confirmed income of $0. My wife's dad lives in the USA and we will be moving in with him until we find a place. He has enough income to meet the requirements. So if my wife is the Sponsor and completes a i-864 with supporting documents (but has $0 income and we are not using assets for proof on income) does her dad just need to complete the i-864 as a Joint Sponsor and provide the required documents? I'm getting confused with the i-864a paper as well. Any help would be appreciated!

Hello! Sorry, stupid questions, need your expertise. I am helping a friend to get information to decide between the K1 and CR1 (I personally did the K1, and I will have her come to this forum, too). My friend, she's from Canada, and her fianc , he is a US citizen. -Is K1 and CR1 the only options to get her to come to the USA and get a green card? -She was told that she can come in USA, stay for 3 months (Canada - USA have agreement that we can legally visit for a short time), then get marry IN USA, then apply for "something"? Is that a thing? -From what I see on the processing time, both visa are kind of similar, would you think the CR1 would be a better choice? -Can she travel to the USA (for little vacations time to time) while waiting for the CR1? -Also, I assume you can't stay in USA extended period of time while CR1 is in progress? Hello, I am getting married in September to a Canadian citizen in Ontario who will be immigrating to the US most likely with the CR-1 Visa path. Does anyone know if there is a way to expedite receiving the Ontario marriage certificate from the 10 weeks that is listed on their website? We would rather not wait an extra 10 weeks to start the process. I see online that I can provide a "Proof of Urgency" with supporting documents. I also called Service Ontario and they said the proof of urgency has to be from a lawyer or immigration with some sort of deadline date. Anyone have any ideas for this?

Hello all, My wife and I are prepping her AOS package from our K1 visa. We are doing it a couple of years late so she's got an appointment to see the civil surgeon next week for her I-693 to get done again which we will send off with the I-485 package. Our questions are: 1. Current income - this is what I will be making this year, correct? I started a second part-time job last November, so I'm making about 20k more this year than last. The new job was on my taxes and I have a W2 for it since I started last year before the cut-off. So I can add that and my main job together? I hit the cut-off either way for last year by 6k for our family of 3, so I'm not worried about a co-sponsor either way, this just shows I can extra support her, right? 2. I should send in the tax transcripts for the last 3 years, 1040 for last year only (?), and the W2 for both jobs for last year - along with 6 months of paystubs for both? 3. The public charge question - the answer is yes, right? Do I put what my current income is this year or last year? 4. Where do I send the packet? - Scrap this question I just found the answer. 5. How should we put the packet together? 2 hole punch folders? Paperclips? Thanks, appreciate any help!
