Travel using AP, is it ok???????

hello everybody, i received now my advance parole, is there any problem using advance parole to travel in other country without green card??????????

please give me more info about it...

You are still traveling as a citizen of PI, not of the US. All visa requirements still apply.

That's the entire purpose of advance parole... to be able to travel outside the country & return without having a green card.

Correct, AP gets you back in to the US. As far as entering other countries it has no bearing.

That is what your AP is for.So you can travel while your green card is on process.

To best answer the question, I think that we need clarification on exactly what the OP means by "to travel in other country without green card."

So long as you had no overstay the AP will get you back into. It has no bearing on getting you into the "other" country so you still have to fulfill the "other" country visa requirements. All the best!

This is not quite true, the AP documents will not necessarily get you back into the US.

The AP is not like the Green Card, all rules of a visa apply.

Which means that any Officer at the Port of Entry can deny you entry into the US for any reason and on a whim.

And if you're denied entry, you have waived your rights to the GC.

Read the AP document, it states this clearly.

1) - Parole is not admission into the US

2) - Parole into the US is not guaranteed

3) - Travel warning regarding unlawful presence

4) - Inadmissibility in general

I highly discourage using the AP if you do not have a 'clear history' with the USCIS and unless for a real emergency.

I've always assumed that the AP is meant to be used for emergency purposes, not for friendly visits and the like. I may be wrong on this. As the above poster says, you can still be denied entry back-so I wouldn't risk it for anything other than an emergency. Seems like there will be plenty of time for travel after receiving the GC. But that's just me.

The AP can be used for any reason, emergency or otherwise. All things considered, however, it's far better to wait for the green card.

IMHO the AP is NOT a document to be used lightly to leave/re-enter the US for any purpose. I do recollect the wording when I applied certainly gave the impression it was to be used for emergency situations rather than fun trips. My attorney at the time also indicated it was for funerals, family illnesses and possibly to attend something like a wedding.

I only applied for an AP based upon my father being sick at the time.

From the USCIS site...

"Please note that issuance of an advance parole document does not guarantee admission into the United States. In fact, an alien who has an advance parole document will generally be paroled into the United States, rather than admitted."

From the I-131 instructions...

"Advanced Parole is an extraordinary measure used sparingly to bring an otherwise inadmissible alien to the United States for a temporary period of time due to a compelling emergency."

Unless you have an urgent need to leave the country I would delay any trip until you are approved and in receipt of your GC.

If your trip is a simple vacation I think it is like playing Russian Roulette to use the AP. At the end of the day, why risk it? I suspect you would be devastated if refused admission and deported back to your home country.
