K3 cancelled? Then should I not send it?

I just got my receipt notice for the I-130 and was getting ready to send it out right now, but figured I'd look on here if there was any releant info I might like to know. So seriously..... are they cancelling the K3 visa? Does that mean if I send it in, it will not only delay my I-130 but it will be basically thrown in the trash?!? I really really need an answer because If I should send it, I want to send it as soooooon as possible. But I don't want to send it if it will be worse than useless... really need an answer soon before the post office closes

I-130:

Married: 5/27/2006

Sent: 9/4/2007 (Vermont)

Check cleared: 1/25/2008

NOA1 : received 1/28/2008

NOA2 : received!!! 4/13/2008

NVC: First package arrived - AOS Fee sent: 4/23/2008

I-129:

Sent: 1/29/2008 (Vermont)

Received: 1/30/2008

NOA1 : received 2/7/2008

NVC Received (I-130) : 4/27/2008

It is the other way arround, they hold the I-130 and send the I-129F on to NVC for the K-3. They hold the I-130 assuming that the K-3 will spend the extra $1010 to adjust status in the USA, no sense in sending both to NVC, and wasting NVC's and Consulate's time doing both.

You decide NOW do you want the extra hasell of the K-3 (I-129F), or just stick with the CR-1(I-130 only)

CR-1 is the superior visa, it saves you from adjusting status, CR-1 is a GREEN-CARD visa.

K-3 is NON-Immigrant, requires AOS ($1010) is not work auth, (90 days or more waiting for EAD) EAD is required to get SSN, and ALL states require SSN to issue a driver's license, SO NO EAD, NO SSN, NO Drive.

CR-1 takes a bit longer to process than K-3 for most countries.

As far as i know there is NO word of the cancelling of K3 filing !!!....My husband filed I-130 for me in October 19th 2007 we got NOA1 Jan 14th and receipt in the mail on Friday 18th Jan...He filed the I-129F for K3 the following Tuesday 22nd Jan 2008.. He called USCIS yesterday and he was told we were in the system and even got to talk with Immigration Officer where upon he asked how long before the processing of I-129F would be comeplete the immigration Officer told him worst case it would take 4 months on average it takes 3 months. My hubby is in Florida and I am in UK so we are looking to go K3 and hopefully our file will be going to NVC around April or May at the latest then it will go to London.

I was told yesterday that they were canceling my K-3 because I-130 is moving faster now and that they will hold both my applications until the administrivately cancel my I-129F then they will approve my I-130.

so in other words we are being penalized for sending in the I-129F

I was told the same thing as Jimmy and Angela YESTERDAY. By someone in CSC, not a USCIS customer support gnome. Someone AT CSC. All the people on the board that want us all to ignore this are like the people who ask us to ignore the evidence that dinasours existed. Do what you feel is the best for yourself and your spouse, but I'm telling you what both CSC AND my congressmans office has told me: K3 apps, the I-129F, are being attached/grouped with the I-130, then cancelled when the I-130 is processed. Jimmy says it above and it's the same thing I've been told: K3 visas are taking LONGER to process than the I-130. DO NOT FILE IT. It will only delay you.

This came up last night, it may be that USCIS is having a hard enough time with the flood of cases since last summer, and are attempting to avoid an aditional flood of adjustment of status cases from the K-3, and are preventing this by pushing on any I-130 (CR-1) visa case for counselor processing.

This is a blessing, as I pointed out in earlier post, CR-1 is work authorized, and results in NO adjustment of status, it gets green-card.

In most cases K-3 is just a bit quicker than the CR-1.

K-3 original intention was for reuniting and waiting for counselor process to complete and then interview for the immigrant visa, this was at a time when CR-1 IR-1 visa was taking a very long time compared to K-1 visa.

Um, ok... I read that, and I guess I'm bad at reading comprehension, because it seemed like it said at the end I should file the I-129F form. Also.... he already has a SSN, he's spent a lot of time here in the US before he even met me. and the AOS...? *Scratches head* this is the first I've heard of that $1010. So, sorry if I sound slow, but... huh?

so, if I just leave the I-130 alone, and don't send the I-129F form.... the I-130 should go through faster and I can get my husband here faster... than if I sent in my I-129F?

Thats what I'm asking, i thought the process was (send I-139 -> get NAO1 --> Send I-129F with receipt notice of I-130 --> get I-129F approval (*crosses fingers*) --> Husband comes here --> wait for I-130 to process) am I wrong?

ok...there are two totally different things being discussed here. One is getting a petition 'approved' and the other is reuniting with your 'spouse in country'. A I-130 may be approved faster than an K3 (I-129F), but in many cases going the CR1-IR1 will take MUCH, MUCH longer for you and your spouse to be together.

PLEASE CHECK THE TIME LINE FOR THE COUNTRY AND CONSULATE WHERE YOUR INTERVIEW WILL HAPPEN!!. Determine what your wait time for an interview is AFTER approval - this can vary greatly depending on your country and the what petition you have been approved for.

For instance, people have been waiting about ONE MONTH for an interview for K3 at the Consulate we would be sent to (Vancouver does K3), and up to ONE YEAR for the NVC and Consulate wait time where we would be sent for CR1-IR1 (only Montreal does CR1-IR1).

I would be MORE than willing to pay the $1000+ for AOS to be re-united with my spouse a year earlier!!! The K3 process has not been officially changed, and knowing USCIS, it could unoffically change many times over the coming months....we have no control over it. Given the information available at this moment in time................We are sending our I-129F tomorrow, if it gets cancelled, so be it....if it doesn`t, we are together much, much sooner.

Hi guys. This could just be my paranoid side coming out, but could it be that they are just dismissing filers who "got away" with filing the I130 with the old fee, and then I129F with no fee? :blink:

My husband also got the same information from a CSC officer last night, saying that they are cancelling K3s filed AFTER July 31st.

I'm anxious to see what comes of the K3 Teleconference tomorrow.

By the way, my husbands call last night generated a touch on our I-130, but NOT on our I-129F.

Boy, did I have a bad night last night. :(

Hi,

in hindsight had i known the dimwits at USCIS CSC were so challenged with K3 and I130 receipt date/notice dates mixup, i would have simplified and stayed put with the I130.

my suggestion is evaluate the average timeline for a K3 from being approved to visa being granted and I130 being approved without K3 to visa granting if the time difference is huge and you would prefer to be with your spouse asap, then go with K3 else just stay put, bite the bullet and conitnue I130.

once again me not a lawyer, just a suggestion from my end.

I'm am currently in this situation now. My i-130 was approve almost 3 weeks ago. My i-129f is still pending. The NOA2 for my i-130 said it will be forwarded to NVC. However, almost 3 weeks have past and NVC still doesn't have it. Do you think that USCIS is hanging on to it? If I call USCIS they won't tell me anything because they say it can take up to 90 days for NVC to receive it, but that is ridiculous.

I'm am currently in this situation now. My i-130 was approve almost 3 weeks ago. My i-129f is still pending. The NOA2 for my i-130 said it will be forwarded to NVC. However, almost 3 weeks have past and NVC still doesn't have it. Do you think that USCIS is hanging on to it? If I call USCIS they won't tell me anything because they say it can take up to 90 days for NVC to receive it, but that is ridiculous.

It generally takes 3-4 weeks for the NVC to receive the approved petition. The reason for this is that it sits in the service centre's mail room until they have a trailer full of approved petitions, then they ship them all to the NVC in bulk.

The lower down in the new crate you are, the longer your wait will be :(
