I came to the US through a Fiance Visa. My fiance is a doctor. When I got here, we decided to wait at least before 90 days to get married so we would know each other more because though we've been talking with each other for almost 4 years, we've only spent time in person for a week.

To cut this story short, my fiance had been seeing this girl whom he dating or have been dating for 10 years. Because of my work background, I am able to access information from him including emails, pics, call logs, sms's and other information which he is unaware that I have access to. So basically, this is not accusations, I have profs and picture with dates on it. The worse part is when they both flew to vegas 2 months before I came here. This is evidenced by dated pics and credit card bill statement and confrontation with him which he admitted.

I am decided to go back home to my country because I can't marry him because of what he did and his incapabilities to recogniize his mistake and make amends to them. I have given him lots of chances, tried to work things out with him and compromised for him. I have dealt with his repeated infedility to me until my few days before my visa expires. He is unwilling to correct things and that is why I am going home.

Is there anyway for me to stay in the states "Legally" without having to marry him? What processes would there be? If none, I am more than happy to go home and restart a life and hopefully get my job back.

You must return back to your country. There is no need to for USCIS to continue with your process because you refuse to marry the US Citizen. This is an indication that you're not happy with him. And, they will probably not grant legal status to you because there's no reason for you to live here. Anybody has a better answer?

Nope. You have to return before the visa expires, or you risk removal proceedings.

Needs to be moved to another forum.

You answered your own question.

Nope. Go home and be thankful you found out BEFORE you got married.

what happens if i decide to stay but not marry him? You'll be out of status and unable to adjust to a legal one.

or can i stay until my visa expires or or i can only stay within 90 days that i am suppose to marry him? Your visa expires 90 days from your date of entry into the U.S.

Sorry things didn't work out for you. (F)

If you decide to stay without marrying him, then you become an illegal. K-1 or any other spousal visa is single entry VISA, once you enter US through K-1 you have to marry the petitoner within 90 days.

Its either marry him or leave the country. Sorry for the situation (F)

Your k-1 visa is good for 90 days once you entered the US. If you did not marry within the 90 days, you must go back. You cannot stay if you did not marry your fiance.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

She can stay, just not legally and she cannot adjust status while here unless she marries the petioner. Even if she marries another citizen, she will not be able to adjust status here. She will have to return home.

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”

When your I-94 expires, you'll be an illegal alien.

or can i stay until my visa expires or or i can only stay within 90 days that i am suppose to marry him?

Your K1 visa document expired the day you came into the United States. You have no valid visa anymore. The K1 is valid for 180 days, or until you use it to enter the United States.

What you have is an I-94 document giving you permission to stay in the US for 90 days. If you don't marry the man who originally petitioned to bring you here, then you must leave. There are no provisions for you to stay here under any other circumstances with the I-94.

If you had entered on a K3 visa (if you were already married to your sponsor) then you could file an I-539 to request an extension, but this isn't available to aliens who entered on a K1 visa.

Be sure to give your I-94 to the customs officer when you leave the US. If you don't, then your exit may not be recorded properly, and USCIS might presume you overstayed your visa and will ban you from returning.

Good luck!
