What happens if an American marries their foreign fiancee after 90 days? Do they have to fill out extra forms?

the alien can no longer adjust to permanent resident based on the K-1 status and you begin again with an I-130 petition

Timeline

If you fail to marry within the 90 days then as already said you can not file for AOS based on the K1 visa, You must file a I-130 along with the AOS so it is going to cost you another $355.00 on top of the $1010.00 for the AOS. You will be asked at your interview why you failed to comply with the terms of the K1 and you will need to fully disclose your reasons for failing to marry within the time given.

Also you need to remember that when the I-94 runs out your spouse will be out of status and have no way to prove they are here legally.

Not a good idea to go this route, much better to go to your town hall and have a quick marriage before the 90 days are up.

Did your fiance get stamped at POE with a temporary stamp to ebable him to work if not he is not permitted to until he get's a work permit

As others have said if you do not get married within the 90 days he will have to leave as he will become illegal after this period

Yes I know we are supposed to marry within the 90 days but my boyfriend has not shown signs of having any ambition or willingness to go out and try to find a job(he has a social security card) and my parents are afraid it will be a big mistake to marry him so soon.

If he came on a fiance visa, he's your fiance, not just your boyfriend. At least, you signed a letter of intent to that effect. It's your decision. You've been informed of the consequences and ramifications of delay with regard to immigration issues.

Just because he's got a SSN doesn't mean he's eligible to work. He still needs to have an EAD, and unless he got the stamp when he entered with the K1, he can't work until after you're married and send in the AOS stuff and gets an EAD. Even if he got the stamp at POE, he can only work for the 90 days on his I-94, so really what's the point? By the time he would find a job, he'd have to quit it because he's got no EAD.

Tell your parents to chill and go get married ASAP.

Are you 17 years old or somethin? Adults don't usually depend on their parents to make life decisions.

And if your fiance is lazy, that's something you should have known before wasting time and money getting him over here, no?

As others have said, having a social security card does not automatically allow him to work.

He may have received an EAD stamp when he first entered the country, but that only lets him work for the first 90 days. After that, he is unable to work until after you receive a ) an EAD or b ) green card. You can only file for these after you get married if he used a K-1 visa to enter the country.
