When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 12 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

I am sponsoring my Argentine husband from Argentina where we have lived for the past 27 years (so looking forward to joining our kids in the U.S.!)
The Embassy interview is on September 2, so we are trying to organized the medical exams in August. Can anyone tell me if the lab tests can be done on a walk-in basis? One doctor is saying that we see her in the morning, go to the lab, see her again and it's all finished in one day. This would be great since we live in Bah a Blanca. The other doctor works in the afternoon, so he is suggesting to go to the lab first, but I don't see how this would be possible without having written orders for the lab about which tests they should do.
Essentially, I am looking for people's experiences with this process in a chronological fashion, particularly for those who had to travel to Buenos Aires to do the exams.

I am a US citizen currently living abroad. I took a gap year from college and I am planning to return next year before the fall semester.
My fianc is Romanian and is a practicing physiotherapist. He is currently studying for his master's degree. He will graduate next year, around the same time as when I will start school. Our plan was for him to enter the US with a work visa and then later apply for a green card. However, since his line of work is healthcare, the USCIS screening process alone will take much longer than the date we wanted to move together, and then he will have to find a job, get a work visa etc.
I thought maybe he could enroll in a community college, and then later adjust his status from a student visa to a work visa? Since I am young and have no family in the US, we cannot start the green card process right away since I do not yet have the necessary finances to be a sponsor.
I'd like any type of advice, thank you!

3 RepliesJust wondering are people shipping their belongings? Im looking into UPS as I need to ship 2 boxes and it seems more reasonable than bringing and 3rd and 4th suitcase. Anyone have any recommendations for sending their personal belongings? Im not sure if I have to be there to receive them or if its ok to put down my fiance as the receiver but Im unsure if thatll cause delays in customs

2 RepliesHi, my case (F2A) was DQ'd on 1st April 2025 and the PD (Feb '22) became current with the July Visa Bulletin. Looking at the NVC scheduling tool, it appears that ILs should be sent (for family based visas) for those cases DQ's in April. However, it's been a few weeks and it's radio silence....
Is there anybody out there that's also waiting for interview for a family based visa?

Currently processing the I751 (filed Jan 2025) and I have 3 kids that I751 will be file in Sept (expires in Nov 2025).
When exactly is the right time to file for citizenship? Does my kids needs to file for citizenship also? they age 12, 9 and 8.p.s idk where exactly to post and ask. Thank you for those who can help and answer. I appreciate it!
