PSA: If entering the USA 2 years after marriage, kindly remind the immigration officer of this

When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 20 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

1 RepliesI had an I 94 expiration about six years ago when I was on H 1B. The I 94 expired because my passport had expired. I renewed my passport within 30 days, and on the 35th day I traveled to my home country and re entered the U.S., so the total gap was 41 days. I received my green card three years ago, and I will be eligible to apply for citizenship under the five year rule. I want to know if that past I 94 issue could affect my naturalization application.

Need advise on Potential H1B issue while AOS

1 RepliesI have been in the US on H1B for over 10 years. In 2023, I had a change of location with the same employer. While the payroll reflected the change end of Nov'23 and I made the move to the new city around this time while submitting the AR-11 (and making USPS change), the immigration team at my employers' were informed late and the H1B amendment for change of location was finally approved end of Dec'23. There is a 1 month gap between my move to the new city and the H1B amendment's start validity. Since Dec'23 the status has remained compliant with no issues associated with a renewal and a transfer. I realized the one month discrepancy as I was preparing my application for AOS I-485 where I have to provide specific dates associated with my last and current residence, where my current residence shows Nov'23 as last date in my previous location but my job history shows dec'23 as last date in my previous location based on I-797 records.
Any advises or thoughts on how to tackle this situation and its impact on AOS as well as future H1B petitions/ current H1B status if flagged during AOS.
Police Certificate for Montenegro

1 RepliesI submitted my two police certificates as listed on travel.state.gov for Montenegro which include a criminal and misdemeanor report. Also written on the state site was a notice that a basic court document was also to be submitted for immigrant purposes. I uploaded all 3 and NVC got back to me saying the document is invalid and when i responded and asked why they just referred me to the site. Does anyone have any experience with this? I know there is a pause on Montenegro but asking for the future.
So confused about taxes and N400 form

4 RepliesI would like to apply for my N400 in February. This is what is on the Document Checklist that is confusing to me:
4. Documents referring to you and your spouse:
a. Tax returns, bank accounts, leases, mortgages, or birth certificates of children;
or b. Internal Revenue Service (IRS)-certified copies of the income tax forms that you both filed for the past 3 years;
or c. An IRS tax return transcript for the last 3 years.
I have read some posts regarding this and many say that you have to send them a tax return transcript or certified copies. But in front of parts b and c, I see the word "or".
So does this mean I have a choice of tax returns, OR, certified copies, OR a tax return transcript.
As well, I want to apply now, before our tax filing. Does anyone think this is not a great idea and to wait until we filed. (I just don't want to wait another month because I have the funds now)
Oh, and one last question: If I file online is that quicker and also, I guess I send all supporting documents in PDF's. (I have always filed with hard copies for everything in the past.)
I was hoping to gain my citizenship this year since it is the 250 Birthday.
