When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 19 replies
Traveled to Canada for 20 days after entering the U.S. on a K-1 visa (June 1–22). Seeking reentry under Automatic Visa Revalidation (AVR).

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

3 RepliesHi - I am currently applying for N400 from overseas. I have a few questions regarding filling out the form.
1.) I am filing out under 3 year residency rule, married to a USC. Do I have to answer the residency and employment only for 3 or 5 years?
2.) If you can skip questions, do you just leave it blank, or answer 'No'?
3.) Do you put as a physical address your APO or foreign address?

I am a female U.S. citizen in my 30s who has lived in the United States for less than 5 years. I reside in Bolivia with my Bolivian husband, and my three children. The eldest is a U.S. citizen by birth, but my two younger children are Bolivian citizens, born in Bolivia. I am seeking guidance on the process of obtaining green cards for my husband and two kids, to facilitate their potential future residence in the United States.
I had a brief conversation with a lawyer who gave me the following information:
- I need to file an immigrant visa petition via form I-130 for my husband and 2 kids (I can't do a Consular Report of Birth Abroad since I've lived in the U.S. for less than 5 years)
- This can be done online from Bolivia and I would need to be interviewed in the consulate in Bolivia
- Initial documents that need to be translated to English before submission
- Proof of me being a U.S. citizen
- Proof of relationship to children: birth certificates

Proof of relationship to husband: marriage certificate

The initial cost is $510 per application (total for husband and 3 kids would be $1530) and another $500 per case before the interview (total $1500)

Before the interview, I need to provide proof that I have intention of moving to the U.S.

Time from application to interview can be 1.5-2 years
Questions:
- Is the above information accurate and is it missing anything?
- Is it recommended to hire a lawyer to file the I-130s and guide me through the process or should I do it myself? I don't have a lot of money, but if needed, I can try to come up with the money for a lawyer.
- I don't want to separate from my family, if possible. How many months before the interview should I get a U.S. job and a U.S. residence?
- Would my name showing up on an apartment lease be enough to prove U.S. residence? My brother lives in the U.S. and he can likely get me into his current lease.
- Can you send me a link to a guide to file the I-130s? I was told there is one on this site, but I wasn't sure which one to follow.
- I was told there would be other documents that would be requested from me before my interview. What documents are these? If these are in the guide provided for 5, disregard.

7 RepliesI ve been trying to fill out the DS-260 since my case has finally made it to NVC but the website is logging me out after every second, literally. When it comes to filling out the spouse section i cant even get to the drop down without it just randomly logging out. I ve tried on my phone, laptop, google chrome, safari, Firefox, edge, clearing cache, incognito mode and even working during off hours. I d understand if i was Idling or taking too long, but just by clicking the drop down I m getting logged off. Please help. I dont Know how to finish this
