When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 19 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

We are in the very early stages of planning for the K1. We were initially thinking of going the consular processing route but due to a change in circumstances, we're now planning to follow the K1 -> AoS route.
Can we marry in US Virgin Islands? I know that K1 is a single entry visa. If we fly directly from the mainland there should be no immigration. But what about the return? I am not familiar with the immigration procedures in USVI. Is travel to USVI similar to Hawai`i, where there's no immigration if coming from the mainland?
I am the USC (naturalized), my fiancee will be the beneficiary. I have to confess that I am not looking forward to dealing with USCIS again heh.

Would be perfect to hear the experience from people who were at the Swedish U.S. embassy!
When you finished DS-160, did they immediately offered you to schedule the visa interview? Like did they send you a link in email or?
Or did you need to go through a specific webpage to book?Or you just finished DS-160 and waited until embassy mails or emails you with the instructions?
I just have heard that people can immediately book an interview after paying for the DS-160, so I wouldn t want to waste my time just waiting until the embassy contacts me if I know there is a way to book for the interview faster! I don t know - I m confused!

My mother-in-law and I are trying to go through the I-134 questions.
We are a little bit confused and wanted to know what did you guys wrote/did.
Do we understand right that the sponsor is the petitioner and the joint sponsor is my mother-in-law?
So as I understand, they both will need to fill I-134.So at the question 18 - does my fianc need to check no ? As he doesn t have enough of income. And on my mother-in-law s form, it would be yes ?
When do I mention that I have a joint sponsor? When I will fill the DS-160? Or at the visa interview?
At the question 12 - Beneficiary s Anticipated Period of stay in The U.S.
Do we just write the approximate date that we think I ll be there with my visa? Even if I wouldn t be there from that date (we aren t psychics, haha), it wouldn t be a big of a deal right? It s just weird they are asking for a specific date. I hope it would be okay if the months maybe would be the same.And of course we would check no end date

My mother-in-law is wondering, where she can get a proof, like a document that she doesn t have any mortgages or anything?
What did you mention on the question 17? Does she need to mention car, houses, accounts?
If you have any tips or experience about joint sponsors, I would really appreciate! Maybe there are little things that we don t know.

3 RepliesI am writing this query in behalf of my aunt who petitioned her married son last 2016 and now a divorce.
Her question is, how can she change the status of the petition from F3(married son/daughter of USC) to F1(unmarried son/daughter of USC)?
Her case is pending at USCIS California Service Center. She mailed her son dvorcee decree, receipt number, and explaining letter 3 times over pass 2 yrs, but still waiting a response from USCIS?
Are there anyway can she do to speed up the case?
