PSA: If entering the USA 2 years after marriage, kindly remind the immigration officer of this

When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 20 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

3 RepliesMy name is Syed Jamshed Ali Husaini. I am an 83-year-old retired pharmaceutical professional from Karachi, Pakistan. For over three decades more than a third of my life I have lived with a single hope: to reunite my family with my sister in New Jersey.
Today, that hope is being systematically destroyed by a clerical error that was never mine to fix.
The Lifetime of Waiting
In October 1993, my sister filed a petition for me. At that time, I was a man in his 50s, working hard in the pharmaceutical industry to provide for my family. We waited through the 90s, the 2000s, and the 2010s. I followed every rule. I stayed in Karachi. I watched the priority dates move like sand through an hourglass while I dedicated my career to the medical field.
The "Vanishing" Case
When the date finally became current, my case was nowhere to be found. I wrote letters. I sent emails. I searched for answers while the NVC told me the case had "vanished."
We finally discovered why: A government data-entry error. In 1994, a clerk entered my birth year incorrectly. Because of that single digit, my life s file became untraceable. While I was knocking on the door, the NVC was looking at the wrong house.
The Ultimate Injustice
The NVC has admitted the date was wrong. They have seen my Matriculation Certificate from 1946. They have seen the U.S. Visas I have successfully used for 30 years with my correct birth date. They know the mistake is theirs.
But instead of correcting the record, they have ghosted me. They are choosing to "destroy" my file under INA 203(g) to cover up an administrative blunder that has already cost me years of my life.
The Human Cost
This is not just about a "file." This is about:
- My Children: They grew up waiting for a future that was promised in 1993. Because of this administrative failure, they have lost their right to reunite with their family.
- My Family in the U.S.: My sister and brother are waiting, hoping to see me again in our final years.
- A Lifetime of Service: I spent my career in the pharmaceutical industry helping others get the medicine they need. Now, at 83, I am asking for the "remedy" I am legally owed.
To the NVC and the U.S. Consulate: You cannot "terminate" 32 years of a human life to save yourselves from paperwork. I am 83 years old. I do not have another 20 years to start a new petition. I am asking for justice. I am asking for my 1993 priority date to be restored.

I m looking for some help/information from people who ve gone through an IR-5 (parent of U.S. citizen) interview in Ciudad Ju rez, especially if you had to correct DS-260 mistakes at the interview.
Here s our situation:
My mom has her immigrant visa interview coming up, and we realized there are a couple of inaccuracies in her DS-260 that were entered by our lawyer:
- Number of U.S. entries
- DS-260 says: 2 entries
- Reality: 3 entries (all on tourist visas)
- The third entry was disclosed during the process but wasn t reflected in the final form
- She also no longer has the physical visa from that second entry (it s old/lost)
- U.S. residence history (New York)
- DS-260 says she lived in NY continuously from 1996 2001
- In reality, it was multiple stays:
- 1996 1998
- 1998 2001
- 2003 2015
- So there s a gap (2001 2003) that isn t reflected and she did not live in ny from 1996-0201
I really want to avoid any chance of us getting denied since we've already been apart for five years now and i don't know what we'd do otherwise. Any help would be greatly appreciated.
would we just clarify this? would they know all of her entries? or do we leave it as is and hope for the best?

6 RepliesMy wife and I received letter 9/3/25 that our case was expedited. Another letter on 9/5/25 to tell us to upload our AOMs along with information on scheduling the Biometrics appointment. Our attorney uploaded the AOMS (1 for my Filipina wife and 1 for me) to my wife's portal as there was nowhere to upload under my name. There was a sentence with a link about RESHEDULING APPOINTMENTS which confused our lawyer who had us call Manila and they told us we had no interview scheduled. Another company who helped us fill my 130 also told us the rescheduling statement did not mean anything was scheduled but was in all letters.
We have heard nothing at all since 9/5/25. Is this normal right now. It seemed I saw others on the forum in January in manila who had already had interviews with original letters from manila later than our original letter from Manila. Is this delay just normal now or should we be inquiring about mistakes or anything?. Our priority date is October 25, 2023.

Fee for Adjustment of Status

Wanted to ask something, more for my peace of mind than anything:
We sent out form I-485 to adjust status, and filled out the form which authorizes them to take the fee via ACH. It was picked up at the USCIS lockbox in Phoenix one week ago at the time of writing, and the fee has yet to be taken out.
Could anyone who also used the Phoenix lockbox tell me how long it took for the fee to be taken out of the bank?
