When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 19 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

i wanted some assistance on my case. married to a us citizen, I applied concurrently with all the appropriate forms i-130, I-485 etc
i have had my green card interview scheduled. Attended the interview with my wife, during the interview we were told that the marriage is bonafide and that they are happy with all the documents. However, they do not see any evidence of intention to remain in the US. She said that she is worried I would get the green card then leave the country and since it is a 10 year green card, she wants to make sure that she sees intent to remain. So she asked to upload new documents to the I-485 portal, things such as a lease and insurance etc. or job.
i have since then moved into a rental property with my partner (as we were previously living with family)
I have also since uploaded all relevant documentation, lease agreement, water, gas and electric bills. And my new work contract.
she said if you upload it within a couple weeks she will get a notification that an upload has been made and she would approve my case if I upload the correct document.
so far it has been 2 months since my interview and since I uploaded the documents. I am wondering if it is just a waiting game? Or is there something I can do to get them going again on my case, since my interview they have approved my I-765 (work permit) and my I-130. But the I-485 remains as interview scheduled on the website.
if anyone can help that would be a great help.

Need some clarification - I am asking for someone, US citizen filed I-130 for parent in March 2025 - and estimated time until case decision is 13 months.
However, parent is going through Alzheimer's and might not able to remember much things when the interview comes around.
How long can the parent stay out of their country and stay in the US and can the case be expedited or the case being adjusted while visiting here in the US on a visitor's visa?

you probably get this question a lot because it seems unclear to me. My wife entered the U.S. on a K1 and K2 for her son. About to file AOS but it s saying I don t need to file I-693 medical form but instead I could send in a DS-3025 vaccination worksheet, however my wife says she and our son never got that when they did the medical in Jamaica.
should I just send in the application without medical or vaccination worksheet?
please advise the best way forward.
Naturalization Interview and DUI 9:21 am today

7 RepliesMy Uncle's naturalization interview is scheduled for November 6 (N400 filed in November last year). Unfortunately, he was charged with a DUI last weekend and has retained a DUI attorney. His first court date is on November 4, but the matter will not be resolved by then.
Given the current political climate - should he proceed with the interview, request to reschedule, or withdraw his N-400 application?
If he reschedules, will USCIS allow him to choose a new date, or will one be assigned?
If he contacts USCIS, what should he say to avoid negatively impacting his case?

20 RepliesLooking for some assistance or guidance. My wife arrived to the US on her IR-1 visa last week. We filed all the paperwork with her taking my last name. Her visa in her passport has her maiden name. Today we got her social security card and it has her maiden name. Any idea of the green card will come with her maiden name or my last name?
In the Latin American culture they generally don't change last names and we were not going to do it but we were advised to do it to make things easier.
If the green card will have her maiden name, I am fine with sticking with her maiden name. Have any of you dealt with this?
