When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 15 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

I ended up doing AOS while visiting US with my spouse on ESTA. He is a USC. We had a change of circumstance as our baby was unexpectedly born 2 months premature (we came here when I was 6.5 months pregnant and were planning to leave in 2-3 weeks). We ended up spending a month in NICU and did not feel comfortable traveling with a preemie. I sadly ended up overstaying the ESTA by 3 weeks because, for whatever reason, USCIS did not get our package in time (perhaps the lawyer submitted it later than she told us). The GC was approved and towards the end of this year I'm supposed to do the ROC. We have had a couple of happy years here by now but are considering moving back to Europe for several reasons. Mainly, I have a good career waiting for me (my maternity leave is about to end), and I feel like my child would benefit from attending a daycare and school there. My husband works remotely, and there is a high chance that his employer would allow him to work from EU (he is waiting for an answer).
We do, however, want to retain my ability to visit the US again and perhaps one day move back here for good. So my questions:- If I were to officially surrender my GC, would I be able to get a B visa in the future (I suspect ESTA is gone forever because of AOS?)? Or is that a very slim chance?
- If I were to officially surrender mg GC, could we in the future apply for a spousal visa? Would the fact that I did AOS from ESTA cast any shadow on that?

in the section where it asks Is your current mailing address the same as your physical address? i have answered yes, but me and my spouse both living abroad and the mailing address and physical address are not the same. because i have answered yes to this, my address history is starting from the US mailing address to the latest address. oldest to newest in this order.
and i have left every box that doesn't apply to me empty instead of N/A.
one more thing due to the character limit on i-130A form the apartment address is cropped. like in i-130 it says for example Floor 9, Apartment 43. in the i-130A it says Apt43
also some of the address is cropped in the i-130 as well even though i remember that i have written the full address
i have consulted a lawyer and she was advising to fill out a new i-130 form to fix the mistakes and upload it with an explanation letter in your account.
what do you guys think?

4 RepliesAs the title says, I was wondering if getting married shortly before DCF is a red flag and would result in a rejected application? For context, I am american and my girlfriend is from an asian country, but we met and live in sweden. In Sweden there is a concept called sambo which in the eyes of the law we are legal partners, we have been together 3 years and we bought an apartment together here.
Now I am anticipating a job offer back in the US and want to explore the DCF route for my girlfriend, but wondering if we get married here in sweden and then file for a green card will that be cause for rejection of her visa application?
