    PSA: If entering the USA 2 years after marriage, kindly remind the immigration officer of this
    When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1."  The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!).  I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
     
    Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before....  I would kindly remind the officer "We married >2 years ago.  We can enter with an IR-1 visa now right?"

    Traveled to Canada for 20 days after entering the U.S. on a K-1 visa (June 1–22). Seeking reentry under Automatic Visa Revalidation (AVR).
    I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?

    Wrong USCIS application form filed by my lawyer!
    Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…

    Seeking advice for Thai/US couple - What US visa path to take?
    My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

    Usc who petitioned siblings 20 years ago and now received welcome letter from Nvc this week. My sister original i130 did not have her child at the time, child is now 14 and will not have be registered for processing fee. How do we add derivative child to my sister case ds260 will ask biological children and he will be registered but how will he have his visa at the same time as my sister and spouse?

    ive read on other threads about dq date changing but not sure if that would be an issue with this case. Could some one please guide me through this? Greatly appreciated!

    Hello has anyone tried to get biometrics appointment at mumbai consulate recently? I am trying to register my parents at the ustraveldocs website ( as per instructions) as a new registration to set up biometrics appointment, however I get an error message that "your personal details match a profile which is already in the database". I am unable to proceed further? Has anyone faced this issue. Any help is appreciated. two years back, they had renewed their visitor visa and had got a biometrics done. could that be the reason why i am unable to login?

    Amending the 1040 before the CR1 interview?

    Hi! Petitioner here.

    Context: Originally, when I filed my taxes with a CPA and on my own for the past few years, the total income for each year fall 50% below the i864p poverty guideline. But I showed my tax documents to a different CPA today. He realized I've been filing wrong all these years. My total income for every year should actually be around $36000 for every year, which is $10,000 above the poverty line! So, the current CPA recommended that I amend all my federal tax returns for the past few years and send the amended forms to the NVC so that I will not need a joint sponsor.

    However, I've been DQ'd just yesterday, my original 3 tax forums have already been submitted to the NVC, and the NVC requested that "may" need to find a joint sponsor. I have not received the interview letter yet.

    Questions:
    1)
    Would it be wise to follow the current CPA's advice?
    2) Won't the Interviewer be suspect of the amendments? Or will the interviewer accept the amendments?
    3) Should I contact NVC regarding my situation? Or is there a likelihood that they'll see my situation as a red flag?
    4) Will amending tax forms delay the NVC process by months and months?
    5) Even having earned $36000 per year for all three years and its anticipated for 2025, should I still have a joint sponsor?

    I received an update from NVC for both my parent's applications.

    For my dad's:

    Case FE Review note: The birth certificate for Petitioner on submitted on 22July is incomplete. Please replace this with an acceptable birth certificate with all pages submitted. Please re-submit the correct document under the Petitioner's own name.

    However, my Birth Certificate WAS ACCEPTED under Civic Documents Tab.

    For my mom:

    Petitioner Birth Certificate: Part of this document is missing or is difficult to read. Please replace this with a scan that shows the complete text of the document. I uploaded the same document as my birth certificate for my dad, which was accepted with note above.

    Case FE Review note: The income reported as stated on formI-864, is insufficient to overcome the public charge grounds of inadmissibility for visa issuance. To avoid delays, an additional Affidavit of Support Form I-864 from a joint sponsor may be submitted. A consular officer will decide if you meet these requirements at the time of the interview.

    I uploaded my tax transcript with 1040 Tax Return, Schedule K with Business Tax Return (reflecting sufficient income to cover my household plus parents).

    Has anyone experienced this?

    All I-864 documents were accepted. No note under my dad's file but insufficient income note under mom's.

    Petitioner Birth Certificate (stating both parents names) was accepted for my dad but not mom?
