When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 19 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

Just need some guidance or any relevant info on the right process to adjust status when you are on a pending asylum application. I got married recently, my wife has a pending asylum application , I am US citizen and we want to file to AOS.
Any advise, if we file when do we need to withdraw her Asylum application? does withdrawing Asylum application affect the AOS application?Will appreciate any advice or referral to previous topics or cases.

My case is as follow : We got married( my spouse is a USC) in September 2024, then filled for our I-130 and I-485 in November 2024. I was in the USA since March 2024 and my Visa ( B2) expired on September 2024, so I overstayed about 3 months. I ve also worked for some time under the table until I got my EAD. USCIS is aware of this as I have stated it in the application.
2 weeks ago , I received my AP allowing me to travel , which I really want to do in order to see my family and celebrate our wedding back in Europe.
I m worried to travel because of the current administration as well as because of my past situation ( overstay and illegal work ). I don t want to be denied entry , be sent back to my home country ( Switzerland ) and having to start all over again . I d be crushed.
What is your insight regarding my situation and has anyone experienced a similar experience or has traveled on AP and came back in the USA without any issues. Is it worth the risk ?
Visa Status - Issued. But visa pick-up location changed from the original one we selected, why? 6:03 pm today

2 RepliesWe originally selected SM Cubao as the pick-up spot for convenience, and this was the location shown on usvisascheduling.com for the last month. Our status now changed to "ISSUED", and suddenly the pick-up location on usvisascheduling.com changed to "MANILA Visa Application Center".
1. Why did it change?
2. Is there a status on CEAC after "ISSUED" that is "READY FOR PICK UP"?
3. Or does "Ready for Pick-Up" a status that shows on usvisascheduling.com?
4. Are we waiting for any new status update or is the visa ready for pick-up?
5. And if so, is this Visa Application Center the same as the OFC Biometrics location, Parqual Building 8, level 3?
6. Or should we just call the help number to figure this out?

5 RepliesMy wife was Naturalized a couple weeks ago, and her mother is here with us in the US right now. She entered on humanitarian parole, but then got TPS. Her current TPS document expired on 4/19/25, but she timely filed 90 days before for "re-registration", which of course is still pending, but on USCIS's webpage for Ukrainian TPS it still says Ukrainian TPS is designated through Oct. 19, 2026. Trump has not made any termination on this program, but adjudication of pending applications seems to be at a stand still.
Obviously with my wife being naturalized now, we want to file I-130/485 for her mom now. On the questions about her mothers "When does the beneficiary's authorized stay expire?", should we be putting 4/19/25. With a pending TPS re-registration, she wasn't required to leave and from what I understand is in "authorized stay", but without an approval being issued I don't see how we can put any date other than 4/19/25.
We want to get her 485 filed as soon as possible which should then protect her from being required to leave while that is adjudicated, but I of course want to make sure we don't mess up on the applications. Is there anything else we should be aware of for those who were in a similar situation. My understanding is since she had a legal entry, and a green card is immediately available for her, overstays are forgiven, which I don't believe she has because of her pending TPS application.
Edit: Her I-94 Class of Admission is "DT"
