When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 19 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

I hope you're doing well.
I have a couple of questions regarding my I-130 application and would appreciate your guidance.
Firstly, when completing the form, I left all sections that did not apply to me blank. Could this be an issue?
Secondly, I am a dual citizen. My name is the same on both my U.S. passport and the civil documents from my other country. However, in the other country, they include my grandfather s name along with my surname. So while my surname is still present, it appears with the additional name of my grandfather. I did not include this variation on the I-130 form. Is it necessary to mention this? Could omitting it lead to a denial or a Request for Evidence (RFE)?

3 RepliesWe had our Marriage based green card interview on August 7 at 8:45am.
We walked into the building at 8:15am (thankfully very few people there).
USCIS is the only thing in the building and they are on the 3rd floor. The elevators are just to the right when you walk in the doors.
Security was super easy and they were very nice. They just needed ID and our appointment notice. Basically the same as airport security, everything in a box (belts and things included) and its just a walk through metal detector. We did not have to take our shoes off.
Then there was the check in just on the other side of security. That was super quick, they just asked for the appointment notice and then they took a picture of the green card applicant and scanned his index finger on both hands.
We then were told to take a seat and the number they gave us would be called. our number got called at just about 9am, so in total we waited about 30 minutes after walking in.
We had a very nice officer conducting our interview, she made it very easy.
First thing she asked for was all of the IDs that we had. So for the US Citizen we gave: passport and Real ID drivers license. for the green card applicant we gave: passport, state ID (non-Real ID), social security card, and his EAD card.
She then only asked a few questions about us.
How we met? (she asked me, the US Citizen) - we originally just gave a short answer, but then she wanted to know more.
When we met in person the first time (kinda directed a both of us) - since we met over Covid thats probably why she asked that
and that was pretty much the only questions she asked us about our relationship. The only thing she asked for document wise was to see the original certified copy of our marriage certificate and my husbands original birth certificate.
She then went over the inadmissibility questions from the I-485 - every answer was basically no, except for 2. one of which we had chosen the incorrect option, which she was able to fix. those questions were "Have you EVER violated the terms or conditions of your nonimmigrant status?" since he technically overstayed his K-1 visa, this answer should have been yes. We informed her of the overstay, she added a note of when his I-94 expired and the date when our AOS was filed, and then said it wasn't an issue anyway. the other question we answered yes to was "have you been unlawfully present in the United States? " again for the same reason above.
She then explained that she didn't see any issues with our application and she was going to mark it for approval, but it would go to a supervisor for the final approval. But that we should see an update in the system within the next day.
She also explained next steps for removing the conditions on the green card and when he can do that, as well as the time frame for when he could apply for citizenship if he chose to do so.For those who remember, we were one of the couples who chose the adjustment category "Spouse of a U.S. Citizen" instead of "Person admitted to the United States as a fianc (e) or child of a fianc (e) of a U.S. citizen (K-1/K-2 Nonimmigrant)." We did bring this up at the end of the interview when she asked if we had any questions. She said she knew it was a I-129f anyway and it was in the system that it was, so it was getting marked as a conditional green card and it wasn't a big deal.
Overall it was a very easy experience and much less stressful than we were expecting.
Hopefully we hear something soon!

Received notice of receipt twice (one for receiving the application, one for biometrics taken) two weeks later.
Left US on December 3,2024.
Question:
Do I need to get back in the US before December 3,2025 if I didn t get my re-entry permit till then?

I-864W Discontinued. How to request exemption? 12:01 am today

5 RepliesHello there. I intended to file Form I-864W to request an Affidavit of Support exemption for my adopted son during National Visa Center (NVC) processing. I recently learned that Form I-864W has been discontinued and that the exemption request is now incorporated into Form I-485. As Form I-485 applies to applicants already residing in the United States, what is the correct process for requesting this exemption for my son, who is currently outside the United States and about to undergo NVC processing? Thanks in advance.

Just need some guidance or any relevant info on the right process to adjust status when you are on a pending asylum application. I got married recently, my wife has a pending asylum application , I am US citizen and we want to file to AOS.
Any advise, if we file when do we need to withdraw her Asylum application? does withdrawing Asylum application affect the AOS application?Will appreciate any advice or referral to previous topics or cases.
